2.76.010 Definitions.

A. “Authorized person” means funeral director, member of immediate family, or other party showing authorization from lot owner or next of kin to permit an activity to occur on a particular gravesite.

B. “Cemetery supervisor” means the supervisor of personnel and operations at the City Cemetery.

C. “City Cemetery” means that portion of the Mountain View Cemetery, Catholic Cemetery, Masonic Cemetery, and the IOOF Cemetery, both developed and undeveloped, owned and maintained by the city.

D. “Director” means the director of parks and recreation of the city or his duly authorized agents.

E. “Endowed care” includes the repair and maintenance of all buildings, fences, drives, waterlines and other improvements belonging to the City Cemetery; cutting, trimming and watering of the grass; raising sunken graves; pruning of shrubs and trees; and such other work as may be necessary to insure proper maintenance of all buildings and grounds owned by the city. Endowed care shall not cover the maintenance, repair or the replacing of flower pots, grave markers, monuments or structures, and shall be limited to those activities that available, budgeted funds of the city will allow.

F. “Gravesite” means any grave, ground urn space, mausoleum crypt or urn niche intended for the disposition of human remains in the City Cemetery.

G. “Lot owner” means any person, firm or corporation who owns a certificate of use for a given gravesite or has a valid contract with the city for the purchase of the gravesite.

H. “Next of kin” means one of the following in the order named:

1. The surviving spouse;

2. The surviving children of the decedent;

3. The surviving parents of the decedent;

4. The surviving brothers or sisters of the decedent;

5. A guardian of the person of the decedent at the time of his death; or

6. Any other person authorized or under obligation to dispose of the body.

I. “Right of second interment” means to purchase the right to reuse and occupy grave for a second interment. (Ord. 95-37 § 1, 1995; Ord. 93-A-40 § 1, 1993; Ord. A-3740 § 1, 1992; Ord. 2.76.020 Gravesite purchase regulations.

A. All gravesites shall be purchased at the cost hereinafter stated in Section 2.76.070 by cash or purchase agreement according to the specific gravesite description as platted and filed in the office of the City Cemetery.

B. The city shall furnish a purchase agreement to be signed by the purchaser and approved by the cemetery supervisor. This purchase agreement shall show the name of the purchaser, the description of the site, amount of down payment, the date and amount of each installment, the applicable rate of finance charges, and the date of issuance of the purchase agreement.

C. When final payment of the purchase agreement is made, there shall be issued a certificate of use for that site described in the purchase agreement.

D. In the event an account is ninety days in arrears, the remainder of the account shall become due and payable in full with interest at the maximum allowable rate on the unpaid balance. On delinquencies, the purchaser shall be notified by certified mail at his last known address of the amount due and, if no payment is received within thirty days from date of said letter, this matter may be referred by the city to an attorney or collection agency. The purchaser or his estate will pay a reasonable attorney or collection fee plus other costs and expenses incurred by the city in connection with said collection. In the event the delinquent account is for the purchase of pre-need gravesites, the city may, at its option, make available such gravesites for resale and all payments already received shall be forfeited.

E. All gravesite purchase agreements and/or any other sales agreements concerning the sale of graves, service charges and care shall be made between the city and the persons requesting the service directly, rather than through a funeral director. All payment for city services shall be made directly to the city by the person requesting the services rather than through a funeral director. No interment shall be made in graves which have not been fully paid for, except by special permission of the cemetery supervisor. (Ord. 93-A-40, § 2, 1993; Ord. A-3703 § 2, 1991; Ord. 2.76.030 Interment regulations and restrictions.

All regulations and restrictions pertaining to interment in the City Cemetery shall be set forth in a policy manual, approved as to form and content by the director, and maintained in the office of the cemetery supervisor. 2.76.040 Markers and stones.

All regulations and restrictions pertaining to the setting and removal of markers and stones in the City Cemetery, including those located in the upright and flat sections of the City Cemetery, shall be set forth in a policy manual, approved as to form and content by the director, and maintained in the office of the cemetery supervisor. 2.76.050 Trees, plants, shrubs, flowers, flower vases and flower pots.

All regulations and restrictions pertaining to the placement and use of trees, plants, shrubs, flowers, flower vases and flower pots in the City Cemetery shall be set forth in a policy manual, approved as to form and content by the director, and maintained in the office of the cemetery supervisor. 2.76.060 Miscellaneous regulations.

A. The city manager, or his designee, shall be the only person empowered to repurchase grave lots and, funds permitting, shall be authorized to pay up to seventy-five percent of the current selling price for a similar lot, crypt, niche, or urn space, or offer a like amount of credit on another grave, crypt, niche, or urn space in the cemetery; provided that an individual may purchase from another individual for his or her own use a grave lot or lots; and provided further, that it is unlawful for any person, firm or corporation to purchase, to sell or offer to sell a grave lot upon the premise, promise, representation or inducement of resale at a financial profit. Each person violating this section shall be guilty of a misdemeanor and each violation shall constitute a separate offense.

B. The city shall place the amount noted for all graves, urn spaces, mausoleum crypts and urn niches in the city cemetery endowed care fund. This amount shall be added to the respective price of each grave, urn space, mausoleum crypt and urn niche as shown in Section 2.76.070 when sold. When ownership of a grave, urn space, mausoleum crypt or urn niche is deeded from one private party to another, and the current owner purchased said gravesite more than ten years ago, the new owner shall be required to pay endowed care on the gravesite, at the amount currently set forth for new gravesites, at the time of transfer of ownership.

C. The director shall have the authority of a police officer for the purpose of maintaining order, enforcing the rules and regulations of the cemetery, the laws of the state, and the ordinances of the city within the cemetery grounds and within such radius as may be necessary to protect the cemetery property, as set forth in RCW 68.56.060.

D. Other miscellaneous regulations pertaining to the City Cemetery, including gravesite preparation, shall be set forth in a policy manual, approved as to form and content by the director, and maintained in the office of the cemetery supervisor. D. Grave Accessories. The fee for various grave accessories including concrete liners and vaults will be as set forth on the retail price list for said grave accessories maintained in the office of the City Cemetery.

E. Cremation Urns. The fees for various models of cremation urns will be as set forth on the retail price list for said urns maintained in the office of the City Cemetery.

F. Charge Adjustments. The city manager is authorized, upon recommendation of the director, to make temporary adjustments to charges and fees as set forth in this section as deemed to be in the best interest of the city.

G. Service Fees. The fees for various services including marker repair and cleaning, records research and marker installation will be as set forth on the retail price list for said services maintained in the office of the City Cemetery.

H. Right of Second Interment. This fee will be assessed at the time a single grave is used for a second burial of remains. The fee varies and will be set forth on the retail price list maintained for said service in the office of the City Cemetery. “Right of second interment” means to purchase the right to reuse an occupied grave for a second interment.

I. Additional Charges. Additional charges which may apply will be as set forth on the retail price list maintained in the office of the City Cemetery. 2.76.080 Recording and handling fees.

A fee of ten dollars shall be collected by the cemetery supervisor at the time a burial property is recorded with the city. This fee shall be payable by the person purchasing the burial property. Whenever the director or his designee provides assistance to a cemetery property owner for the sale of his gravesite to another individual, the city shall be entitled to collect a handling fee from the seller equal to twenty-five dollars or five percent of the gross sales price for each gravesite sold, whichever is greater. 2.76.090 Mountain View Cemetery – Operation and regulations.

The city council shall fix by resolution the requirements for the operation and maintenance and regulation of the Mountain View Cemetery. (Ord. 99-6 §§ 4, 29, 1999: prior code § 1.64.090).
