15.26.010 Terminology--Amended definitions.

Wherever a reference is made to the “County Recorder” in the code adopted by this chapter, such reference shall mean the Yakima County auditor, and references to the “Clerk of this Jurisdiction” shall mean the city clerk of the city of Wapato.  (Ord. 1142(part), 2006)

15.26.020 Amendments to Chapters 1 and 2 of the International Property Maintenance Code, 2003 Edition.

Chapters 1 and 2 of the International Property Maintenance Code, 2003 Edition, are replaced with the following:

Chapter 1

TITLE AND SCOPE

Section 101––Title

These regulations shall be known as the Property Maintenance Code, may be cited as such, and will be referred to herein as “this code.”

Section 102––Purpose And Scope

102.1 Purpose.  It is the purpose of this code to provide a just, equitable and practicable method, to be cumulative with and in addition to any other remedy provided by the Building Code or otherwise available at law, whereby buildings, structures, or public nuisances which from any cause endanger the life, limb, health, morals, property, safety or welfare of the general public or their occupants may be required to be repaired, vacated or demolished.

102.2 Scope.  The provisions of this code shall apply to all dangerous buildings and public nuisances, as herein defined, which are now in existence or which may hereafter become dangerous in this jurisdiction.

Section 103––Alterations, Additions and Repairs

All buildings or structures which are required to be repaired under the provisions of this code shall be subject to the provisions of Chapter 34 of the Building Code.

Chapter 2

ENFORCEMENT

Section 201––General.

201.1 Administration.

The building official is hereby authorized to enforce the provisions of this code.  The building official shall have the power to render interpretations of this code and to adopt and enforce rules and supplemental regulations in order to clarify the application of its provisions.  Such interpretations, rules and regulations shall be in conformity with the intent and purpose of this code.  Enforcement of this Chapter may be accomplished by the building official in any manner authorized by the Chapter or by any other law including but not limited to issuance of criminal citations, civil actions and abatement.

201.2 Inspections.  The Building Official or the Building Official’s designee is hereby authorized to make such inspections and take such actions as may be required to enforce the provisions of this code.

201.3 Right of Entry.  When it is necessary to make an inspection to enforce the provisions of this code, or when the building official or the buildings official’s authorized representative has reasonable cause to believe that there exists in a building or upon a premises a condition which is contrary to or in violation of this code which makes the building or premises unsafe, dangerous or hazardous, the building official may enter the building or premises at reasonable times to inspect or to perform the duties imposed by this code, provided that if such building or premises be occupied that credentials be presented to the occupant and entry requested.  If such building or premises be unoccupied, the building official shall first make a reasonable effort to locate the owner or other persons having charge or control of the building or premises and request entry.  If entry is refused, or resisted, the building official is authorized to obtain an order for the purpose of inspecting the building or premises or for performing the duties imposed by this code, after submitting evidence in support of an application which is adequate to justify such an order from a court of competent jurisdiction as provided in Section 403 of this code.  “Authorized representative” shall include the officers named in Section 201.2 and their authorized inspection personnel.

201.4 Non-exclusive authority to abate.  The City of Wapato may choose to abate any public nuisance or violation of the Wapato Municipal Code through any of the abatement methods set forth in the Wapato Municipal Code or in other local, state or federal law, and nothing contained in this Chapter shall be construed as limiting, prejudicing or adversely affecting the City’s ability to concurrently or consecutively use any of those proceedings as the City may deem are applicable.  Proceeding under this Section will not preclude the City from proceeding under other Sections of this Chapter.  Whenever the building official determines that any condition exists in violation of the provisions of this Chapter, he/she may take enforcement action pursuant to this Section.

201.5 Duty to Enforce.  Nothing in this Chapter shall be construed as requiring the City to enforce the prohibitions in this Chapter against all or any properties which may violate the Chapter.  In the City’s prosecutorial discretion, and as the City’s resources permit, this Chapter may be enforced only as to a limited number of problem properties per year.  Nothing in this Section or the absence of any similar provisions from any other City law shall be construed to impose a duty upon the city to enforce such other provision of law.

Section 202 Abatement of Dangerous Buildings and Other Public Nuisances.

202A Abatement of Dangerous Buildings.  All buildings and portions thereof which are determined, after inspection by the building official, to be dangerous as defined in this code are hereby declared to be public nuisances and shall be abated by repair, rehabilitation or removal in accordance with the procedure specified in Section 401 of this code.

202.2 Abatement of Public Nuisances Other Than Dangerous Buildings.  All property and portions thereof which are determined, after inspection by the building official to contain conditions defined as public nuisances in this code are hereby declared to be public nuisances and shall be abated by repair, rehabilitation or removal in accordance with the procedure specified in Section 401 of this code.

Section 203––Violations

It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure or cause or permit the same to be done in violation of this code.

Section 204––Inspection of Work

All buildings or structures within the scope of this code and all construction or work for which a permit is required shall be subject to inspection by the building official in accordance with and in the manner provided by this code and Sections 108 and 1701 of the Building Code.

Section 205––Board of Appeals

205.1 The Board of Appeals established by Wapato Municipal Code 15.08.060 shall serve as the Board of Appeals for the International Property Maintenance Code.

205.2 Limitations of Authority.  The board of appeals shall have no authority relative to interpretation of the administrative provisions of this code nor shall the board be empowered to waive requirements of this code.

Chapter 3

DEFINITIONS

Section 301––General.

301.1 Scope.  Unless otherwise expressly stated, the following terms shall, for the purposes of this code, have the meanings shown in this chapter.

301.2 Interchangeability.  Words stated in the present tense include the future; words stated in the masculine gender include the feminine and neuter; the singular number includes the plural and the plural, the singular.

301.3 Terms defined in other codes.  Where terms are not defined in this code and are defined in the International Building Code, International Fire Code, International Zoning Code, Uniform Plumbing Code, International Mechanical Code, International Existing Building Code or the Electrical Code, such terms shall have the meanings ascribed to them as in those codes.

301.4 Terms not defined.  Where terms are not defined through the methods authorized by this section, such terms shall have ordinarily accepted meanings such as the context implies.

301.5 Parts.  Whenever the words “dwelling unit,” “dwelling,” “premises,” “building,” “rooming house,” “rooming unit,” “housekeeping unit” or “story” are stated in this code, they shall be construed as though they were followed by the words “or any part thereof.”

Section 302––General Definitions

APPROVED.  Approved by the building official.

ABANDONED.  In addition to those definitions provided by state codes, local ordinances and case law, the term “abandoned” means and refers to any item which has ceased to be used for its designed and intended purpose.  The following factors, among others, will be considered in determining whether or not an item has been abandoned:

(1)  Present operability and functional utility;

(2)  The date of last effective use;

(3)  The condition of disrepair;

(4)  The last time an effort was made to repair or rehabilitate the item;

(5)  The status of registration or licensing of the item;

(6)  The age and degree of obsolescence;

(7)  The cost of rehabilitation or repair of the item versus its market value; and

8)  The nature of the area and location of the item.

ABATE means to repair, replace, remove, destroy or otherwise remedy the condition in question by such means and in such a manner and to such an extent as the building official in his/her judgment shall determine is necessary in the interest of the general health, safety and welfare of the community.

ATTRACTIVE NUISANCE means any condition, instrument or machine, which is unsafe, unprotected, and may prove detrimental to children whether in a building, or the premises of a building, or on an unoccupied lot.  This includes any abandoned wells, shafts, basements or excavations; abandoned refrigerators and motor vehicles, junk motor vehicles, as defined in Wapato Municipal Code Chapter 8.28; unfenced swimming pools with water depth more than two feet; any structurally unsound fences or structures; or any lumber, trash, fences, debris or vegetation which may prove hazardous or dangerous to inquisitive minors.

BASEMENT.  That portion of a building which is partly or completely below grade.

BATHROOM.  A room containing plumbing fixtures including a bathtub or shower.

BEDROOM.  Any room or space used or intended to be used for sleeping purposes.

BUILDING CODE is the International Building Code as adopted by this jurisdiction.

BUILDING OFFICIAL.  The official who is charged with the administration and enforcement of this code, or any duly authorized representative.

CONDEMN.  To adjudge unfit for occupancy.

DANGEROUS BUILDING is any building or structure deemed to be dangerous under the provisions of Subsection 302.1 of this code.

DISMANTLED means that from which essential equipment, parts or contents have been removed or stripped and the outward appearance verities the removal.

DWELLING UNIT.  A single unit providing complete, independent living facilities for one or more persons, including permanent provisions for living, sleeping, eating, cooking and sanitation.

EASEMENT.  That portion of land or property reserved for present or future use by a person or agency other than the legal fee owner(s) of the property.  The easement shall be permitted to be for use under, on or above a said lot or lots.

ENFORCEMENT OFFICER means the building official or his designee.

EXTERIOR PROPERTY.  The open space on the premises and on adjoining property under the control of owners or operators of such premises.

EXTERMINATION.  The control and elimination of insects, rats or other pests by eliminating their harborage places; by removing or making inaccessible materials that serve as their food; by poison spraying, fumigating, trapping or by any other approved pest elimination methods.

GARBAGE.  The animal or vegetable waste resulting from the handling, preparation, cooking and consumption of food.

GUARD.  A building component or a system of building components located at or near the open sides of elevated walking surfaces that minimizes the possibility of a fall from the walking surface to a lower level.

HABITABLE SPACE.  Space in a structure for living, sleeping, eating or cooking.  Bathrooms, toilet rooms, closets, halls, storage or utility spaces, and similar areas are not considered habitable spaces.

HOUSEKEEPING UNIT.  A room or group of rooms forming a single habitable space equipped and intended to be used for living, sleeping, cooking and eating which does not contain, within such a unit, a toilet, lavatory and bathtub or shower.

IMMINENT DANGER.  A condition which could cause serious or life-threatening injury or death at any time.

INFESTATION.  The presence, within or contiguous to, a structure or premises of insects, rats, vermin or other pests.

INOPERABLE MOTOR VEHICLE.  A vehicle which cannot be driven upon the public streets for reason including but not limited to being unlicensed, wrecked, abandoned, in a state of disrepair, or incapable of being moved under its own power.

INOPERATIVE means incapable of functioning or producing activity for mechanical or other reasons.

LABELED.  Devices, equipment, appliances, or materials to which has been affixed a label, seal, symbol or other identifying mark of a nationally recognized testing laboratory, inspection agency or other organization concerned with product evaluation that maintains periodic inspection of the production of the above-labeled items and by whose label the manufacturer attests to compliance with applicable nationally recognized standards.

LIENHOLDER means any person, as defined in this Chapter, who has a recorded interest in real property, including mortgagee, beneficiary under a deed or trust, or holder of other recorded liens or claims of interest in real property.

LET FOR OCCUPANCY OR LET.  To permit, provide or offer possession or occupancy of a dwelling, dwelling unit, rooming unit, building, premise or structure by a person who is or is not the legal owner of record thereof, pursuant to a written or unwritten lease, agreement or license, or pursuant to a recorded or unrecorded agreement of contract for the sale of land.

NUISANCE means any public nuisance known at common law or in equity jurisprudence.

OCCUPANCY.  The purpose for which a building or portion thereof is utilized or occupied.

OCCUPANT.  Any individual living or sleeping in a building, or having possession of a space within a building.

OPENABLE AREA.  That part of a window, skylight or door which is available for unobstructed ventilation and which opens directly to the outdoors.

OPERATOR.  Any person who has charge, care or control of a structure or premises which is let or offered for occupancy.

OWNER.  Any person, agent, operator, firm or corporation having a legal or equitable interest in the property; or recorded in the official records of the state, county or municipality as holding title to the property; or otherwise having control of the property, including the guardian of the estate of any such person, and the executor or administrator of the estate of such person if ordered to take possession of real property by a court, renter(s), lessor(s) and other occupants residing permanently or temporarily on property.

PERSON.  An individual, partnership, joint venture, corporation, association, social club, fraternal organization, trust, estate, receiver, or any other entity or any other group acting as a unit.

PREMISES.  Any building, lot, parcel, real estate, or land or portion of land whether improved or unimproved, occupied or unoccupied, including adjacent streets, sidewalks, parkways and parking strips.

PROPERTY means any real property including but not limited to land, lot, or parcel of land, or any hereditament held by any owner, and shall include any alley, sidewalk, parkway or unimproved public easement abutting such real property, lot or parcel of land.

PUBLIC NUISANCE is defined to have the following meanings:

1.  It shall be a public nuisance for any owner or other person in control of said property or premises to keep or maintain property, premises or rights-of-way in such a manner that any of the following conditions are found to exist:

(a)  Abandoned, dismantled, wrecked, inoperable, unlicensed, and discarded objects, equipment or appliances such as, but not limited to vehicles, boats, water heaters, refrigerators, furniture which is not designed for outdoor use, household fixtures, machinery, equipment, cans or containers standing or stored on public or private property or on sidewalks or streets, or which are stored on private property in violation of any other law or ordinance;

(b)  Discarded putrescibles, garbage, rubbish, refuse, or recyclable items which have not been recycled within thirty (30) days of being deposited on the property which are determined by a building official to constitute a fire hazard or to be detrimental to human life, health or safety;

(c)  Oil, grease, paint, other petroleum products, hazardous materials, volatile chemicals, pesticides, herbicides, fungicides or waste (solid, liquid or gaseous) which is determined by a building official to constitute a fire or environmental hazard, or to be detrimental to human life, health or safety;

(d)  Lumber (excluding lumber for a construction project on the property with a valid permit), salvage materials, including but not limited to auto parts, scrap metals, tires, other materials stored on premises in excess of seventy-two (72) hours and visible from a public street, walkway, alley or other public property;

(e)  Receptacles for discarded materials and recyclables which are left in the front yard following the day of the regularly scheduled refuse pick-up for the property;

(f)  Swimming pool, pond, spa, other body of water, or excavation which is abandoned, unattended, unsanitary, empty, which is not securely fenced, or which is determined by the building official to be detrimental to life, health or safety;

(g)  Any premises which detrimentally impacts the surrounding neighborhood because of dilapidation, deterioration or decay or is unsafe for the purpose for which it is being used or is not secured or is improperly secured; and

(h)  Any condition on a property which meets the requirements of subparagraph (i) and (ii), below:

(i)  Is injurious to health, or is indecent or offensive to the senses or an obstruction to the free use of property, so as to interfere with the comfortable enjoyment of life or property; and

(ii)  Affects at the same time an entire community or neighborhood, or any considerable number of persons, although the extent of the annoyance or damage inflicted upon individuals may be unequal.

2.  Any public nuisance known at common law or in equity jurisprudence.

3.  Any attractive nuisance which may prove detrimental to children whether in a building, on the premises of a building, or upon an unoccupied lot.

4.  Any building or portion thereof, device, apparatus, equipment, combustible waste or vegetation which, in the opinion of the Fire Marshal or his Deputy, is in such a condition as to cause a fire or explosion or provide a ready fuel to augment the spread and intensity of fire or explosion arising from any cause.

5.  Those premises on which an accumulation of weeds, vegetation, junk, dead organic matter, debris, garbage, offal, rat harborage, stagnant water, combustible materials and similar materials or conditions constitute fire, health or safety hazards.

6.  Whatever is dangerous to human life or is detrimental to health, as determined by the Health Officer.

7.  Whatever renders air, food or drink unwholesome or detrimental to the health of human beings, as determined by the Health Officer.

8.  Public nuisances as enumerated in RCW 7.48.140.

9.  Any travel trailer that is occupied and for which a temporary use permit has not been issued.

10.  Any item or activity determined to constitute a nuisance under any ordinance adopted by the City of Wapato.

PUBLIC WAY.  Any street, alley or similar parcel of land essentially unobstructed from the ground to the sky, which is deeded, dedicated or otherwise permanently appropriated to the public for public use.

ROOMING HOUSE.  A building arranged or occupied for lodging, with or without meals, for compensation and not occupied as a one- or two-family dwelling.

ROOMING UNIT.  Any room or group of rooms forming a single habitable unit occupied or intended to be occupied for sleeping or living, but not for cooking purposes.

RUBBISH.  Combustible and noncombustible waste materials, except garbage; the term shall include the residue from the burning of wood, coal, coke and other combustible materials, paper, rags, cartons, boxes, wood, excelsior, rubber, leather, tree branches, yard trimmings, tin cans, metals, mineral matter, glass, crockery and dust and other similar materials.

SHALL is defined to have the following meanings:

1.  With respect to the functions and powers of the building official, any agents, officers or employees of the City of Wapato and Board of Appeals authorized hereunder, a direction and authorization to act in the exercise of sound discretion and in good faith;

2.  With respect to the obligations upon owners and occupants of premises and their agents, a mandatory requirement to act in compliance with this code at the risk of civil and criminal liability upon failure to so act.

STRICT LIABILITY OFFENSE.  An offense in which the prosecution in a legal proceeding is not required to prove criminal intent as a part of its case.  It is enough to prove that the defendant either did an act which was prohibited, or failed to do an act which the defendant was legally required to do.

STRUCTURE means anything constructed, built or planted upon, any edifice or building of any kind, or any piece of work artificially built up or compiled of parts joined together in some definite manner, which structure requires location on the ground or is attached to something having a location on the ground, including fences, gates, garages, carports, swimming and wading pools, patios, outdoor areas, paved areas, walks, tennis courts and similar recreation areas.

TENANT.  A person, corporation, partnership or group, whether or not the legal owner of record, occupying a building or portion thereof as a unit.

TOILET ROOM.  A room containing a water closet or urinal but not a bathtub or shower.

VENTILATION.  The natural or mechanical process of supplying conditioned or unconditioned air to, or removing such air from, any space.

WORKMANLIKE.  Executed in a skilled manner; e.g., generally plumb, level, square, in line, undamaged and without marring adjacent work.

WRECKED means that which has outward manifestation or appearance of damage to parts and contents which are essential to operation.

YARD.  An open space on the same lot with a structure.

302.1––Dangerous Building.

For the purpose of this code, any building or structure which has any or all of the conditions or defects hereinafter described shall be deemed to be a dangerous building, provided that such conditions or defects exist to the extent that the life, health, property or safety of the public or its occupants are endangered.

1.  Whenever any door, aisle, passageway, stairway or other means of exit is not of sufficient width or size or is not so arranged as to provide safe and adequate means of exit in case of fire or panic.

2.  Whenever the walking surface of any aisle, passageway, stairway or other means of exit is so warped, worn, loose, torn or otherwise unsafe as to not provide safe and adequate means of exit in case of fire or panic.

3.  Whenever the stress in any materials, member or portion thereof, due to all dead and live loads, is more than one and one half times the working stress or stresses allowed in the Building Code for new buildings of similar structure, purpose or location.

4.  Whenever any portion thereof has been damaged by fire, earthquake, wind, flood or by any other cause, to such an extent that the structural strength or stability thereof is materially less than it was before such catastrophe and is less than the minimum requirements of the Building Code for new buildings of similar structure, purpose or location.

5.  Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached or dislodged, or to collapse and thereby injure persons or damage property.

6.  Whenever any portion of a building, or any member, appurtenance or ornamentation on the exterior thereof is not of sufficient strength or stability, or is not so anchored, attached or fastened in place so as to be capable of resisting a wind pressure of one half of that specified in the Building Code for new buildings of similar structure, purpose or location without exceeding the working stresses permitted in the Building Code for such buildings.

7.  Whenever any portion thereof has wracked, warped, buckled or settled to such an extent that walls or other structural portions have materially less resistance to winds or earthquakes than is required in the case of similar new construction.

8.  Whenever the building or structure, or any portion thereof, because of (i) dilapidation, deterioration or decay; (ii) faulty construction; (iii) the removal, movement or instability of any portion of the ground necessary for the purpose of supporting such building; (iv) the deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to partially or completely collapse.

9.  Whenever, for any reason, the building or structure, or any portion thereof, is manifestly unsafe for the purpose for which it is being used.

10.  Whenever the exterior walls or other vertical structural members list, lean or buckle to such an extent that a plumb line passing through the center of gravity does not fall inside the middle one third of the base.

11.  Whenever the building or structure, exclusive of the foundation, shows 33 percent or more damage or deterioration of its supporting member or members, or 50 percent damage or deterioration of its nonsupporting members, enclosing or outside walls or coverings.

12.  Whenever the building or structure has been so damaged by fire, wind, earthquake or flood, or has become so dilapidated or deteriorated as to become (i) an attractive nuisance to children; (ii) a harbor for vagrants, criminals or immoral persons; or as to (iii) enable persons to resort thereto for the purpose of committing unlawful or immoral acts.

13.  Whenever any building or structure has been constructed, exists or is maintained in violation of any specific requirement or prohibition applicable to such building or structure provided by the building regulations of this jurisdiction, as specified in the Building Code or Housing Code, or of any law or ordinance of this state or jurisdiction relating to the condition, location or structure of buildings.

14.  Whenever any building or structure which, whether or not erected in accordance with all applicable laws and ordinances, has in any nonsupporting part, member or portion less than 50 percent, or in any supporting part, member or portion less than 66 percent of the (i) strength, (ii) fire-resisting qualities or characteristics, or (iii) weather-resisting qualities or characteristics required by law in the case of a newly constructed building of like area, height and occupancy in the same location.

15.  Whenever a building or structure, used or intended to be used for dwelling purposes, because of inadequate maintenance, dilapidation, decay, damage, faulty construction or arrangement, inadequate light, air or sanitation facilities, or otherwise, is determined by the health officer to be unsanitary, unfit for human habitation or in such a condition that is likely to cause sickness or disease.

16.  Whenever any building or structure, because of obsolescence, dilapidated condition, deterioration, damage, inadequate exits, lack of sufficient fire-resistive construction, faulty electric wiring, gas connections or heating apparatus, or other cause, is determined by the fire marshal to be a fire hazard.

17.  Whenever any building, structure or premises is in such a condition as to constitute a public nuisance as defined in this chapter.

18.  Whenever any portion of a building or structure remains on a site after the demolition or destruction of the building or structure or whenever any building or structure is abandoned for a period in excess of six months so as to constitute such building or portion thereof an attractive nuisance or hazard to the public.

Chapter 4

NOTICES AND ORDERS OF BUILDING OFFICIAL

Section 401––General

401.1 Commencement of Proceedings.  Whenever the building official has inspected or caused to be inspected any building or property and has found and determined that such building or property is a dangerous building or a public nuisance, he shall commence proceedings to cause the repair, removal, vacation or demolition of the building or public nuisance.

401.2 Notice and Order.  The building official shall issue a notice and order directed to the record owner of the building or property.  The notice and order shall contain:

1.  The street address and legal description sufficient for identification of the premises upon which the building or public nuisance is located.

2.  A statement that the building official has found the building or property to be dangerous or a public nuisance with a brief and concise description of the condition found to render the building or property dangerous or a public nuisance under the provisions of Section 302 of this code.

3.  A statement of the action required to be taken as determined by the building official.

3.1.  If the building official has determined that the building or structure must be repaired, the order shall require that all required permits be secured therefor and the work physically commenced within such time (not to exceed 60 days from the date of the order) and completed within such time as the building official shall determine is reasonable under all of the circumstances.

3.2.  If the building official has determined that the building or structure must be vacated, the order shall require that the building or structure shall be vacated within a certain time from the date of the order as determined by the building official to be reasonable.

3.3.  If the building official has determined that the building or structure must be demolished, the order shall require that the building be vacated within such time as the building official shall determine is reasonable (not to exceed 60 days from the date of the order); that all required permits be secured therefor within 60 days from the date of the order, and that the demolition be completed within such time as the building official shall determine is reasonable.

3.4.  If the building official has determined that a public nuisance exists on a property, the order shall require that the public nuisance be abated in an approved manner within such time as the building official shall determine is reasonable.

4.  Statements advising that if any required repair or demolition work (without vacation also being required) or abatement of a public nuisance is not commenced within the time specified, the building official (i) in the case of a dangerous building, will order the building vacated and posted to prevent further occupancy until the work is completed, and (ii) in the case of a dangerous building or public nuisance, may proceed to cause the work to be done and charge the costs thereof against the property or its owner.

5.  In the case of a dangerous building, statements advising (i) that any person having any record, title or legal interest in the building or property may appeal from the notice and order or any action of the building official to the Board of Appeals, provided that the appeal is made in writing as provided in this code and filed with the building official within 10 days from the date of service of such notice and order; and (ii) that failure to appeal will constitute a waiver of all right to an administrative hearing and determination of the matter.

6.  In the case of a public nuisance, statements advising (i) that any person having any record, title or legal interest in the property on which the public nuisance exists may appeal from the notice and order or any action of the building official to the Board of County Commissioners, provided that the appeal is made in writing as provided in this code and filed with the building official within 10 days from the date of service of such notice and order; and (ii) that failure to appeal will constitute a waiver of all right to an administrative hearing and determination of the matter.

401.3 Service of Notice and Order.  The notice and order, and any amended or supplemental notice and order, shall be served upon the record owner and posted on the property; and one copy thereof shall be served on each of the following if known to the building official or disclosed from official public records:  the holder of any mortgage or deed of trust or other lien or encumbrance of record; the owner or holder of any lease of record; and the holder of any other estate or legal interest of record in or to the building or the land on which it is located.  The failure of the building official to serve any person required herein to be served shall not invalidate any proceedings hereunder as to any other person duly served or relieve any such person from any duty or obligation imposed by the provisions of this section.

401.4 Method of Service.  Service of the notice and order shall be made upon all persons entitled thereto either personally or by mailing a copy of such notice and order by certified mail, postage prepaid, return receipt requested, to each such person at their address as it appears on the last equalized assessment roll of the county or as known to the building official.  If no address of any such person so appears or is known to the building official, then a copy of the notice and order shall be so mailed, addressed to such person, at the address of the building involved in the proceedings.  The failure of any such person to receive such notice shall not affect the validity of any proceedings taken under this section.  Service by certified mail in the manner herein provided shall be effective on the date of mailing.

401.5 Proof of Service.  Proof of service of the notice and order shall be certified to at the time of service by a written declaration under penalty of perjury executed by the persons effecting service, declaring the time, date and manner in which service was made.  The declaration, together with any receipt card returned in acknowledgment of receipt by certified mail shall be affixed to the copy of the notice and order retained by the building official.

Section 402.  If compliance is not had with the order within the time specified therein, and no appeal has been properly and timely filed, the building official shall file in the office of the county auditor a certificate describing the property and certifying (i) that the building or property is a dangerous building or a public nuisance and (ii) that the owner has been so notified.  Whenever the corrections ordered shall thereafter have been completed, the public nuisance removed, or the building demolished so that it no longer exists as a dangerous building or public nuisance on the property described in the certificate the building official shall file a new certificate with the county recorder certifying that the public nuisance has been removed the building demolished or all required corrections have been made so that the building is no longer dangerous, whichever is appropriate.

Section 403.  The following standards shall be followed by the building official (and by the Board of Appeals if an appeal is taken) in ordering the repair, removal, vacations or demolition of any public nuisance or dangerous building or structure:

1.  Any building declared a dangerous building under this code shall be made to comply with one of the following:

1.1 The building shall be repaired in accordance with the current code applicable to the type of substandard conditions requiting repair; or

1.2.  The building shall be demolished at the option of the building owner; or

1.3.  If the building does not constitute an immediate danger to the life, limb, property or safety of the public it may be vacated, secured and maintained against entry.

2.  If the building or structure is in such condition as to make it immediately dangerous to the life, limb, property or safety of the public or its occupants, it shall be ordered to be vacated.

3.  The public nuisance shall be removed to render the property in compliance with this code.

4.  The Building Official may apply for a warrant allowing entry into and upon premises to do any act provided for in Section 201 or 403, above.  Said application shall be made upon oath, in the form of an affidavit, stating, with particularity, (a) the condition sought to be abated, (b) whether, and in what manner, the procedural requirements of this chapter pertaining to notice and opportunity to be heard have been complied with, and (c) whether the condition sought to be abated remains in existence at the time of application for the warrant.

5.  Upon finding that:  (a) the condition complained of constitutes a violation of this chapter and (b) the owner or other person(s) having an interest in the property have been provided with notice of proceedings undertaken pursuant to this chapter and have had an opportunity to be heard in regard to those proceedings, the Judge shall cause a warrant to be issued allowing the Building Official and/or his designee, to enter into and upon the described premises in order to take such action as may be reasonably necessary in order to abate the complained of condition.  Said warrant shall authorize entry only during the hours of daylight unless otherwise approved by the court, and shall further authorize the Building Official and/or his designee to leave and return from day to day until such time as repair, removal or demolition necessary to abate the condition is completed.  Said warrant shall be executed within 45 days of issuance.

Section 404––Notice To Vacate

404.1 Posting.  Every notice to vacate shall, in addition to being served as provided in Section 401.3, be posted at or upon each exit of the building and shall be in substantially the following form:

DO NOT ENTER

UNSAFE TO OCCUPY

It is a misdemeanor to occupy this building, or to remove or deface this notice.

404.2 Compliance.  Whenever such notice is posted, the building official shall include a notification thereof in the notice and order issued under Section 401.2, reciting the emergency and specifying the conditions which necessitate the posting.  No person shall remain in or enter any building which has been so posted, except that entry may be made to repair, demolish or remove such building under permit.  No person shall remove or deface any such notice after it is posted until the required repairs, demolition or removal have been completed and a certificate of occupancy issued pursuant to the provisions of the Building Code.

Chapter 5

APPEAL

Section 501––General

501.1 Form of Appeal.  Any person entitled to service under 401.3 may appeal from any notice and order or any action of the building official under this code by filing at the office of the building official a written appeal containing:

1.  A heading in the words:  “Before the board of appeals of the City of Wapato.”

2.  A caption reading:  “Appeal of ___________,” giving the names of all appellants in the building or the land involved in the notice and order.

3.  A brief statement setting forth the legal interest of each of the appellants in the building, or the land involved in the notice and order.

4.  A brief statement in ordinary and concise language of the specific order or action protested, together with any material facts claimed to support the contentions of the appellant.

5.  A brief statement in ordinary and concise language of the relief sought and the reasons why it is claimed the protested order or action should be reversed, modified or otherwise set aside.

6.  The signatures of all parties named as appellants and their official mailing addresses.

7.  The verification (by declaration under penalty of perjury) of at least one appellant as to the truth of the matters stated in the appeal.

The appeal shall be filed within 10 days from the date of the service of such order or action of the building official; provided, however, that if the building or structure is in such condition as to make it immediately dangerous to the life, limb, property or safety of the public or adjacent property and is ordered vacated and is posted in accordance with Section 404, such appeal shall be filed within 10 days from the date of the service of the notice and order of the building official.

501.2 Processing of Appeal.  Upon receipt of any appeal filed pursuant to this section, the building official shall present it at the next regular or special meeting of the board of appeals.

501.3 Scheduling and Noticing Appeal for Hearing.  As soon as practicable after receiving the written appeal, the board of appeals shall fix a date, time and place for the hearing of the appeal by the board.  Such date shall not be less than 10 days nor more than 60 days from the date the appeal was filed with the building official.  Written notice of the time and place of the hearing shall be given at least 10 days prior to the date of the hearing to each appellant by the secretary of the board either by causing a copy of such notice to be delivered to the appellant personally or by mailing a copy thereof, postage prepaid, addressed to the appellant at the address shown on the appeal.

501.4 Filing Fee.  A filing fee shall be paid at the time the appeal is submitted.  The fee amount shall be as established in Wapato Municipal Code Section 15.40.100.

Section 502––Effect of Failure to Appeal.  Failure of any person to file an appeal in accordance with the provisions of Section 501 shall constitute a waiver of the right to an administrative hearing and adjudication of the notice and order or any portion thereof.

Section 503––Scope of Hearing on Appeal.  Only those matters or issues specifically raised by the appellant shall be considered in the hearing of the appeal.

Section 504––Staying of Order under Appeal.  Except for vacation orders made pursuant to Section 404, enforcement of any notice and order of the building official issued under this code shall be stayed during the pendency of an appeal therefrom which is properly and timely filed.

Chapter 6

PROCEDURES FOR CONDUCT OF HEARING APPEALS

Section 601––General

601.1 Hearing Examiners.  The board may appoint one or more hearing examiners or designate one or more of its members to serve as hearing examiners to conduct the hearings.  The examiner hearing the case shall exercise all powers relating to the conduct of hearings until it is submitted to the board for decision.

601.2 Record.  A record of the entire proceedings shall be made by tape recording or by any other means of permanent recording determined to be appropriate by the board.

601.3 Reporting.  The proceedings at the hearing shall also be reported by a phonographic reporter if requested by any party thereto.  A transcript of the proceedings shall be made available to all parties upon request and upon payment of the fee prescribed therefor.  Such fees may be established by the board, but shall in no event be greater than the cost involved.

601.4 Continuances.  The board may grant continuances for good cause shown; however, when a hearing examiner has been assigned to such hearing, no continuances may be granted except by the examiner for good cause shown so long as the matter remains before the examiner.

601.5 Oaths––Certification.  In any proceedings under this chapter, the board, any board member or the hearing examiner has the power to administer oaths and affirmations and to certify to official acts.

601.6 Reasonable Dispatch.  The board and its representatives shall proceed with reasonable dispatch to conclude any matter before it.  Due regard shall be shown for the convenience and necessity of any parties or their representatives.

Section 602––Form of Notice of Hearing.  The notice to appellant shall be substantially in the following form, but may include other information:

You are hereby notified that a hearing will be held before [the board of appeals or name of hearing examiner] at _______ on the ______ day of ______________, 20 _____, at the hour of _________, upon the notice and order served upon you.  You may be present at the hearing.  You may be, but need not be, represented by counsel.  You may present any relevant evidence and will be given full opportunity to cross examine all witnesses testifying against you.  You may request the issuance of subpoenas to compel the attendance of witnesses and the production of books, documents or other things by filing an affidavit therefor with [board of appeals or name of hearing examiner].

Section 603––Subpoenas

603.1 Filing of Affidavit.  The board or examiner may obtain the issuance and service of a subpoena for the attendance of witnesses or the production of other evidence at a hearing upon the request of a member of the board or upon the written demand of any party.  The issuance and service of such subpoena shall be obtained upon the filing of an affidavit therefor which states the name and address of the proposed witness; specifies the exact things sought to be produced and the materiality thereof in detail to the issues involved; and states that the witness has the desired things in possession or under control.  A subpoena need not be issued when the affidavit is defective in any particular.

603.2 Cases Referred to Examiner.  In cases where a hearing is referred to an examiner, all subpoenas shall be obtained through the examiner.

603.3 Penalties.  Any person who refuses without lawful excuse to attend any hearing or to produce material evidence which the person possesses or controls as required by any subpoena served upon such person as provided for herein shall be guilty of a misdemeanor.

Section 604––Conduct of Hearing

604.1 Rules.  Hearings need not be conducted according to the technical rules relating to evidence and witnesses.

604.2 Oral Evidence.  Oral evidence shall be taken only on oath or affirmation.

604.3 Hearsay Evidence.  Hearsay evidence may be used for the purpose of supplementing or explaining any direct evidence, but shall not be sufficient in itself to support a finding unless it would be admissible over objection in civil actions in courts of competent jurisdiction in this state.

604.4 Admissibility of Evidence.  Any relevant evidence shall be admitted if it is the type of evidence on which responsible persons are accustomed to rely in the conduct of serious affairs, regardless of the existence of any common law or statutory rule which might make improper the admission of such evidence over objection in civil actions in courts of competent jurisdiction in this state.

604.5 Exclusion of Evidence.  Irrelevant and unduly repetitious evidence shall be excluded.

604.6 Rights of Parties.  Each party shall have these rights, among others:

1.  To call and examine witnesses on any matter relevant to the issues of the hearing;

2.  To introduce documentary and physical evidence;

3.  To cross-examine opposing witnesses on any matter relevant to the issues of the hearing;

4.  To impeach any witness regardless of which party first called the witness to testify;

5.  To rebut the evidence; and

6.  To be represented by anyone who is lawfully permitted to do so.

604.7 Official Notice.

604.7.1 What may be noticed.  In reaching a decision, official notice may be taken, either before or after submission of the case for decision, of any fact which may be judicially noticed by the courts of this state or of official records of the board or departments and ordinances of the city or rules and regulations of the board.

604.7.2 Parties to be notified.  Parties present at the hearing shall be informed of the matters to be noticed, and these matters shall be noted in the record, referred to therein, or appended thereto.

604.7.3 Opportunity to refute.  Parties present at the hearing shall be given a reasonable opportunity, on request, to refute the officially noticed matters by evidence or by written or oral presentation of authority, the manner of such refutation to be determined by the board or hearing examiner.

604.7.4 Inspection of the premises.  The board or the hearing examiner may inspect any building or premises involved in the appeal during the course of the hearing, provided that (i) notice of such inspection shall be given to the parties before the inspection is made, (ii) the parties are given an opportunity to be present during the inspection, and (iii) the board or the hearing examiner shall state for the record upon completion of the inspection the material facts observed and the conclusions drawn therefrom.  Each party then shall have a right to rebut or explain the matters so stated by the board or hearing examiner.

Section 605––Method and Form of Decision

605.1 Hearing before board itself.  When a contested case is heard before the board itself, a member thereof who did not hear the evidence or has not read the entire record of the proceedings shall not vote on or take part in the decision.

605.2 Hearing before examiner.  If a contested case is heard by a hearing examiner alone, the examiner shall within a reasonable time (not to exceed 90 days from the date the hearing is closed) submit a written report to the board.  Such report shall contain a brief summary of the evidence considered and state the examiner’s findings, conclusions and recommendations.  The report also shall contain a proposed decision in such form that it may be adopted by the board as its decision in the case.  All examiner’s reports filed with the board shall be matters of public record.  A copy of each such report and proposed decision shall be mailed to each party on the date they are filed with the board.

605.3 Consideration of Report by Board--Notice.  The board shall fix the time, date and place to consider the examiner’s report and proposed decision.  Notice thereof shall be mailed to each interested party not less than five days prior to the date fixed, unless it is otherwise stipulated by all of the parties.

605.4 Exceptions to Report.  Not later than two days before the date set to consider the report, any party may file written exceptions to any part or all of the examiner’s report and may attach thereto a proposed decision together with written argument in support of such decision.  By leave of the board, any party may present oral argument to the board.

605.5 Disposition by the Board.  The board may adopt or reject the proposed decision in its entirety, or may modify the proposed decision.

605.6 Proposed Decision not Adopted.  If the proposed decision is not adopted as provided in Section 605.5, the board may decide the case upon the entire record before it, with or without taking additional evidence, or may refer the case to the same or another hearing examiner to take additional evidence.  If the case is reassigned to a hearing examiner, the examiner shall prepare a report and proposed decision as provided in Section 605.2 hereof after any additional evidence is submitted.  Consideration of such proposed decision by the board shall comply with the provisions of this section.

605.7 Form of Decision.  The decision shall be in writing and shall contain findings of fact, a determination of the issues presented, and the requirements to be complied with.  A copy of the decision shall be delivered to the appellant personally or sent by certified mail, postage prepaid, return receipt requested.

605.8 Effective Date of Decision.  The effective date of the decision shall be as stated therein.

605.9 Judicial Appeal.  Any person affected by a decision issued by the Board of Appeals may, within 14 days after the effective date of the decision, petition to the Superior Court for an injunction restraining the Building Official or Board of Appeals from carrying out the provisions of the decision.  In all such proceedings the court is authorized to affirm, reverse, or modify the decision and such trial shall be heard de novo.

Chapter 7

ENFORCEMENT OF THE ORDER OF THE BUILDING OFFICIAL OR THE BOARD OF APPEALS

Section 701––Compliance

701.1 General.  After any order of the building official or the Board of Appeals made pursuant to this code shall have become final, no person to whom any such order is directed shall fail, neglect or refuse to obey any such order.  Any such person who fails to comply with any such order is guilty of a misdemeanor.

701.2 Failure to Obey Order.  If, after any order of the building official or Board of Appeals made pursuant to this code has become final, the person to whom such order is directed shall fail, neglect or refuse to obey such order, the building official may (i) cause such person to be prosecuted under Section 701.1 and/or (ii) institute any appropriate action to abate such building or property as a public nuisance.

701.3 Failure to Commence Work.  Whenever the required repair removal or demolition is not commenced within 30 days after any final notice and order issued under this code becomes effective:

1.  The building official shall cause the building described in such notice and order to be vacated by posting at each entrance thereto a notice and order reading:

DO NOT OCCUPY

It is a misdemeanor to occupy this building, or to remove or deface this notice.

2.  No person shall occupy any building which has been posted as specified in this subsection.  No person shall remove or deface any such notice so posted until the repairs, demolition or removal ordered by the building official have been completed and a Certificate of Occupancy issued pursuant to the provisions of the Building Code.

3.  The building official may, in addition to any other remedy herein provided, cause the building to be repaired to the extent necessary to correct the conditions which render the building dangerous as set forth in the notice and order; or, in the notice and order required demolition, to cause the building to be sold and demolished and/or demolished and the materials, rubble and debris therefrom removed and the lot cleaned; or, if the property has been declared a public nuisance, to cause the nuisance to be removed to render the property in compliance with this code.  Any such repair, removal or demolition work shall be accomplished and the cost thereof paid and recovered in the manner hereinafter provided in this code.  Any surplus realized from the sale of any such building, or from the demolition thereof, over and above the cost of demolition and of cleaning the lot, shall be paid over to the person or persons lawfully entitled thereto.

Section 702.  Upon receipt of an application from the person required to conform to the order and by agreement of such person to comply with the order if allowed additional time, the building official may, at his discretion, grant an extension of time not to exceed an additional 180 days, within which to complete said repair, rehabilitation, removal, or demolition of the premises, if the building official determines that such an extension of time will not create or perpetuate a situation imminently dangerous to life or property.  The building official’s authority to extend time is limited to the physical repair, rehabilitation, removal, or demolition of the premises and will not in any way affect the time to appeal his notice and order.

Section 703.  No person shall obstruct, impede or interfere with any officer, employee, contractor or authorized representative of this jurisdiction or with any person who owns or holds any estate or interest in any building which has been ordered repaired, vacated, removed or demolished under the provisions of this code; or with any person to whom such building has been lawfully sold pursuant to the provisions of this code, whenever such officer, employee, contractor or authorized representative of this jurisdiction, person having an interest or estate in such building or structure, or purchaser is engaged in the work of repairing, vacating and repairing, or demolishing any such building, pursuant to the provisions of this code or in performing any necessary act preliminary to or incidental to such work or authorized or directed pursuant to this code.

Chapter 8

PERFORMANCE OF WORK OF REPAIR, REMOVAL, OR DEMOLITION

Section 801––General

801.1 Procedure.  All work of repair, removal, and demolition done pursuant to Section 701.3.3 of this code shall be performed by county personnel or accomplished by a private contract under the direction of the building official.  Plans and specifications therefore shall be prepared by the City or architectural and engineering assistance may be engaged by the City on a contractual basis as the building official may deem reasonably necessary, with the cost of such architectural or engineering services to be included in the amount to be collected from the property owner or by special assessment against the property involved.

801.2 Costs.  The cost of such repair, removal, and demolition shall be paid from the repair, removal and demolition fund, and may be made a special assessment against the property involved, or may be made a personal obligation of the property owner, whichever the City Council of the City of Wapato shall deem as appropriate.

Section 802––Repair Removal and Demolition Fund

802.1 General.  The legislative body of this jurisdiction shall establish a special revolving fund to be designated as the repair, removal and demolition fund.  Payments shall be made out of said fund upon the demand of the director of public works to defray the costs and expenses which may be incurred by this jurisdiction in doing or causing to be done the necessary work of repair, removal or demolition of dangerous buildings.

802.2 Maintenance of Fund.  The City Council of the City of Wapato may at any time transfer to the repair, removal and demolition fund, out of any money in the general fund of the City of Wapato, such sums as it may deem necessary in order to expedite the performance of the work of repair, removal or demolition, and any sum so transferred shall be deemed a loan to the repair, removal and demolition fund and shall be repaid out of the proceeds of the collections hereinafter provided for.  All funds collected under the proceedings hereinafter provided for shall be paid to the treasurer of the City of Wapato who shall credit the same to the repair, removal and demolition fund.

Chapter 9

RECOVERY OF COST OF REPAIR, REMOVAL OR DEMOLITION

Section 901.  The city clerk/treasurer shall keep an itemized account of the expense incurred by this jurisdiction in the repair, removal or demolition of any building done pursuant to the provisions of Section 701.3, Item 3 of this code.  Upon the completion of the work of repair, removal or demolition, the clerk of this jurisdiction shall file a report specifying the work done, the itemized and total cost of the work, a description of the real property upon which the building or structure is or was located and the names and addresses of the persons entitled to notice pursuant to Section 401.3.

Section 902––Notice of Hearing.  Upon receipt of said report, the clerk of this jurisdiction shall present it to the legislative body of this jurisdiction for consideration.  The legislative body of this jurisdiction shall fix a time, date and place for hearing said report and any protests or objections thereto.  The clerk of this jurisdiction shall cause notice of said hearing to be posted upon the property involved, published once in a newspaper of general circulation in this jurisdiction, and served by certified mail, postage prepaid, addressed to the owner of the property as the owner’s name and address appears on the last equalized assessment roll of the county, if such so appears, or as known to the clerk.  Such notice shall be given at least 10 days prior to the date set for the hearing and shall specify the day, hour and place when the legislative body will hear and pass upon the director’s report, together with any objections or protests which may be filed as hereinafter provided by any person interested in or affected by the proposed charge.

Section 903––Protests and Objections.  Any person interested in or affected by the proposed charge may file written protests or objections with the clerk of this jurisdiction at any time prior to the time set for the hearing on the report of the director.  Each such protest or objection must contain a description of the property in which the signer thereof is interested and the grounds of such protest or objection.  The clerk of this jurisdiction shall endorse on every such protest or objection the date of receipt.  The clerk shall present such protests or objections to the legislative body of this jurisdiction at the time set for the hearing, and no other protests or objections shall be considered.

Section 904––Hearing of Protests.  Upon the day and hour fixed for the hearing, the legislative body of this jurisdiction shall hear and pass upon the report of the director together with any such objections or protests.  The legislative body may make such revision, correction or modification in the report or the charge as it may deem just; and when the legislative body is satisfied with the correctness of the charge, the report (as submitted or as revised, corrected or modified) together with the charge, shall be confirmed or rejected.  The decision of the legislative body of this jurisdiction on the report and the charge, and on all protests or objections, shall be final and conclusive.

Section 905––Personal Obligation or Special Assessment.

905.1 General.  The legislative body of this jurisdiction may thereupon order that said charge shall be made a personal obligation of the property owner or assess said charge against the property involved.

905.2 Personal Obligation.  If the legislative body of this jurisdiction orders that the charge shall be a personal obligation of the property owner, it shall direct the attorney for this jurisdiction to collect the same on behalf of this jurisdiction by use of all appropriate legal remedies.

905.3 Special Assessment.  If the legislative body of this jurisdiction orders that the charge shall be assessed against the property, it shall confirm the assessment, cause the same to be recorded on the assessment roll, and thereafter said assessment shall constitute a special assessment against and a lien upon the property.

Section 906––Contest.  The validity of any assessment made under the provisions of this chapter shall not be contested in any action or proceeding unless the same is commenced within 30 days after the assessment is placed upon the assessment roll as provided herein.  Any appeal from a final judgment in such action or proceeding must be perfected within 30 days after the entry of such judgment.

Section 907––Authority for Installment Payment of Assessments with Interest.

The legislative body of this jurisdiction, in its discretion, may determine that assessments in amounts of $500.00 or more shall be payable in not to exceed five equal annual installments.  The legislative body’s determination to allow payment of such assessments in installments, the number of installments, whether they shall bear interest, and the rate thereof shall be by a resolution adopted prior to the confirmation of the assessment.

Section 908––Lien of Assessment.

908.1 Priority.  Immediately upon its being placed on the assessment roll the assessment shall be deemed to be complete, the several amounts assessed shall be payable, and the assessments shall be liens against the lots or parcels of land assessed, respectively.  The lien shall be subordinate to all existing special assessment liens usually imposed upon the same property and shall be paramount to all other liens except for state, county and property taxes with which it shall be a parity.  The lien shall continue until the assessment and all interest due and payable thereon are paid.

908.2 Interest.  All such assessments remaining unpaid after 30 days from the date of recording on the assessment roll shall become delinquent and shall bear interest at the registered warrant rate as established by the Yakima County Treasurer on the date of the resolution confirming the engineer’s report.

Section 909––Report to Assessor and Tax Collector:  Addition of Assessment to Tax Bill.

After confirmation of the report, certified copies of the assessment shall be given to the Yakima County Treasurer who shall add the amount of the total assessment or the authorized annual installment of the next regular tax statement levied against the parcel.  The City Clerk/Treasurer shall annually certify delinquent installment accounts to the Treasurer for collection according to the terms of this chapter.

Section 910––Filing of Report with County Auditor.

A certified copy of the assessment shall be filed with the County Auditor.  The descriptions of the parcels reported shall be those used for the same parcels on the County Assessor’s map books for the current year.

Section 911––Collection of Assessment:  Penalties for Foreclosure.

The amount of the assessment shall be collected at the same time and in the same manner as ordinary property taxes are collected and shall be subject to the same penalties and procedure and sale in case of delinquency as provided for ordinary property taxes.  All laws applicable to the levy, collection and enforcement of property taxes shall be applicable to such assessment.  If the legislative body of this jurisdiction has determined that the assessment shall be paid in installments, each installment and any interest thereon shall be collected in the same manner as ordinary property taxes in successive years.  If any installment is delinquent, the amount thereof is subject to the same penalties and procedure for sale as provided for ordinary property taxes.

Section 912––Repayment of Repair, Removal and Demolition Fund.

All money recovered by payment of the charge or assessment or from the sale of the property at foreclosure sale shall be paid to the treasurer of this jurisdiction, who shall credit the same to the repair, removal and demolition fund.

15.26.030 Amendments to Chapters 3 through 8 of the International Property Maintenance Code, 2003 Edition.

Chapters 3 through 8 of the International Property Maintenance Code, 2003 Edition, are amended as Chapters 10 through 15 as follows:

Chapter 10

GENERAL REQUIREMENTS

Section 1001––General

1001.1 Scope.  The provisions of this chapter shall govern the minimum conditions and the responsibilities of persons for maintenance of structures, equipment and exterior property.

1001.2 Responsibility.  The owner of the premises shall maintain the structures and exterior property in compliance with these requirements, except as otherwise provided for in this code.  A person shall not occupy as owner-occupant or permit another person to occupy premises which are not in a sanitary and safe condition and which do not comply with the requirements of this chapter.  Occupants of a dwelling unit, rooming unit or housekeeping unit are responsible for keeping in a clean, sanitary and safe condition that part of the dwelling unit, rooming unit, housekeeping unit or premises which they occupy and control.

1001.3 Vacant structures and land.  All vacant structures and premises thereof or vacant land shall be maintained in a clean, safe, secure and sanitary condition as provided herein so as not to cause a blighting problem or adversely affect the public health or safety.

Section 1002––Exterior Property Areas

1002.1 Sanitation.  All exterior property and premises shall be maintained in a clean, safe and sanitary condition.  The occupant shall keep that part of the exterior property which such occupant occupies or controls in a clean and sanitary condition.

1002.2 Grading and drainage.  All premises shall be graded and maintained to prevent the erosion of soil and to prevent the accumulation of stagnant water thereon, or within any structure located thereon.

Exception:  Approved retention areas and reservoirs.

1002.5 Rodent harborage.  All structures and exterior property shall be kept free from rodent harborage and infestation.  Where rodents are found, they shall be promptly exterminated by approved processes which will not be injurious to human health.  After extermination, proper precautions shall be taken to eliminate rodent harborage and prevent reinfestation.

1002.6 Exhaust vents.  Pipes, ducts, conductors, fans or blowers shall not discharge gases, steam, vapor, hot air, grease, smoke, odors or other gaseous or particulate wastes directly upon abutting or adjacent public or private property or that of another tenant.

1002.7 Accessory structures.  All accessory structures, including detached garages, fences and walls, shall be maintained structurally sound and in good repair.

1002.8 Motor vehicles.  Except as provided for in other regulations, no inoperative or unlicensed motor vehicle shall be parked, kept or stored on any premises, and no vehicle shall at any time be in a state of major disassembly, disrepair, or in the process of being stripped or dismantled.  Painting of vehicles is prohibited unless conducted inside an approved spray booth.

Exception:  A vehicle of any type is permitted to undergo major overhaul, including body work, provided that such work is performed inside a structure or similarly enclosed area designed and approved for such purposes.

Section 1003––Swimming Pools

1003.1 Swimming pools.  Swimming pools shall be maintained in a clean and sanitary condition, and in good repair.

1003.2 Enclosures.  Private swimming pools containing water more than 24 inches (610 mm) in depth shall comply with the provisions of Section 3109 of the International Building Code as adopted and amended in Yakima County Code Title 13.  No existing pool enclosure shall be removed, replaced or changed in a manner that reduces its effectiveness as a safety barrier.

Section 1004––Exterior Structure

1004.1 General.  The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare.

1004.3 Premises identification.  Buildings shall have approved address numbers placed in a position to be plainly legible and visible from the street or road fronting the property.  These numbers shall contrast with their background.  Address numbers shall be Arabic numerals or alphabet letters.  Numbers shall be a minimum of 4 inches (102 mm) high with a minimum stroke width of 0.5 inch (12.7 mm).

1004.4 Structural members.  All structural members shall be maintained free from deterioration, and shall be capable of safely supporting the imposed dead and live loads.

1004.5 Foundation walls.  All foundation walls shall be maintained plumb and free from open cracks and breaks and shall be kept in such condition so as to prevent the entry of rodents and other pests.

1004.6 Exterior walls.  All exterior walls shall be free from holes, breaks, and loose or rotting materials; and maintained weatherproof.

1004.7 Roofs and drainage.  The roof and flashing shall be sound, tight and not have defects that admit rain.  Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior portion of the structure.  Roof water shall not be discharged in a manner that creates a public nuisance.

1004.10 Stairways, decks, porches and balconies.  Every exterior stairway, deck, porch and balcony, and all appurtenances attached thereto, shall be maintained structurally sound, in good repair, with proper anchorage and capable of supporting the imposed loads.

1004.11 Chimneys and towers.  All chimneys, cooling towers, smoke stacks, and similar appurtenances shall be maintained structurally safe and sound, and in good repair.

1004.12 Handrails and guards.  Every handrail and guard shall be firmly fastened and capable of supporting normally imposed loads and shall be maintained in good condition.

1004.13 Window, skylight and door frames.  Every window, skylight, door and frame shall be kept in sound condition, good repair and weather tight.

1004.13.1 Glazing.  All glazing materials shall be maintained free from cracks and holes.

1004.13.2 Openable windows.  Every window, other than a fixed window, shall be easily openable and capable of being held in position by window hardware.

1004.15 Doors.  All exterior doors, door assemblies and hardware shall be maintained in good condition.  Locks at all entrances to dwelling units, rooming units and guestrooms shall tightly secure the door.  Locks on means of egress doors shall be in accordance with Section 702.3.

1004.18 Building security.  Doors, windows or hatchways for dwelling units, room units or housekeeping units shall be provided with devices designed to provide security for the occupants and property within.

1004.18.1 Doors.  Doors providing access to a dwelling unit, rooming unit or housekeeping unit that is rented, leased or let shall be equipped with a deadbolt lock meeting specifications set forth herein.  Such deadbolt locks shall be operated only by the turning of a knob or a key and shall have a lock throw of not less than 1-inch.  For the purpose of this section, a sliding bolt shall not be considered an acceptable deadbolt lock.  Such dead bolt locks shall be installed according to manufacturer’s specifications and maintained in good working order.  All deadbolt locks required by this section shall be designed and installed in such a manner so as to be operable inside of the dwelling unit, rooming unit or housekeeping unit without the use of a key, tool, combination thereof or any other special knowledge or effort.

1004.18.2 Windows.  Operable windows located in whole or in part within 6 feet (1828 mm) above ground level or a walking surface below that provide access to a dwelling unit, rooming unit or housekeeping unit that is rented, leased or let shall be equipped with window sash locking devices.

1004.18.3 Basement hatchways.  Basement hatchways that provide access to a dwelling unit, rooming unit or housekeeping unit that is rented, leased or let shall be equipped with devices that secure the units from unauthorized entry.

Section 1005––Interior Structure

1005.1 General.  The interior of a structure and equipment therein shall be maintained in good repair, structurally sound and in a sanitary condition.  Occupants shall keep that part of the structure which they occupy or control in a clean and sanitary condition.  Every owner of a structure containing a rooming house, housekeeping units, a hotel, a dormitory, two or more dwelling units or two or more nonresidential occupancies, shall maintain, in a clean and sanitary condition, the shared or public areas of the structure and exterior property.

1005.2 Structural members.  All structural members shall be maintained structurally sound, and be capable of supporting the imposed loads.

1005.3 Interior surfaces.  All interior surfaces, including windows and doors, shall be maintained in good, clean and sanitary condition.  Cracked or loose plaster, decayed wood and other defective surface conditions shall be corrected.

1005.4 Stairs and walking surfaces.  Every stair, ramp, landing, balcony, porch, deck or other walking surface shall be maintained in sound condition and good repair.

1005.5 Handrails and guards.  Every handrail and guard shall be firmly fastened and capable of supporting normally imposed loads and shall be maintained in good condition.

1005.6 Interior doors.  Every interior door shall fit reasonably well within its frame and shall be capable of being opened and closed by being properly and securely attached to jambs, headers or tracks as intended by the manufacturer of the attachment hardware.

Section 1006––Handrails and Guardrails

1006.1 General.  Every exterior and interior flight of stairs having more than four risers shall have a handrail on one side of the stair and every open portion of a stair, landing, balcony, porch, deck, ramp or other walking surface which is more than 30 inches (762 mm) above the floor or grade below shall have guards.  Handrails shall not be less than 30 inches (762 mm) high or more than 42 inches (1067 mm) high measured vertically above the nosing of the tread or above the finished floor of the landing or walking surfaces.  Guards shall not be less than 30 inches (762 mm) high above the floor of the landing, balcony, porch, deck, or ramp or other walking surface.

Exception:  Guards shall not be required where exempted by the adopted building code.

Section 1007––Rubbish and Garbage

1007.1 Accumulation of rubbish or garbage.  All exterior property and premises, and the interior of every structure, shall be free from any accumulation of rubbish or garbage.

1007.2 Disposal of rubbish.  Every occupant of a structure shall dispose of all rubbish in a clean and sanitary manner by placing such rubbish in approved containers.

1007.2.1 Rubbish storage facilities.  The owner of every occupied premises shall supply approved covered containers for rubbish, and the owner of the premises shall be responsible for the removal of rubbish.

1007.2.2 Refrigerators.  Refrigerators and similar equipment not in operation shall not be discarded, abandoned or stored on premises without first removing the doors.

1007.3 Disposal of garbage.  Every occupant of a structure shall dispose of garbage in a clean and sanitary manner by placing such garbage in an approved garbage disposal facility or approved garbage containers.

1007.3.1 Garbage facilities.  The owner of every dwelling shall supply one of the following:  an approved mechanical food waste grinder in each dwelling unit; an approved incinerator unit in the structure available to the occupants in each dwelling unit; or an approved leak proof, covered, outside garbage container.

1007.3.2 Containers.  The operator of every establishment producing garbage shall provide, and at all times cause to be utilized, approved leak proof containers provided with close-fitting covers for the storage of such materials until removed from the premises for disposal.

Section 1008––Extermination

1008.1 Infestation.  All structures shall be kept free from insect and rodent infestation.  All structures in which insects or rodents are found shall be promptly exterminated by approved processes that will not be injurious to human health.  After extermination, proper precautions shall be taken to prevent reinfestation.

1008.2 Owner.  The owner of any structure shall be responsible for extermination within the structure prior to renting or leasing the structure.

1008.3 Single occupant.  The occupant of a one-family dwelling or of a single-tenant nonresidential structure shall be responsible for extermination on the premises.

1008.4 Multiple occupancy.  The owner of a structure containing two or more dwelling units, a multiple occupancy, a rooming house or a nonresidential structure shall be responsible for extermination in the public or shared areas of the structure and exterior property.  If infestation is caused by failure of an occupant to prevent such infestation in the area occupied, the occupant shall be responsible for extermination.

1008.5 Occupant.  The occupant of any structure shall be responsible for the continued rodent and pest-free condition of the structure.

Exception:  Where the infestations are caused by defects in the structure, the owner shall be responsible for extermination.

Chapter 11

LIGHT, VENTILATION AND OCCUPANCY LIMITATIONS

Section 1101 General

1101.1 Scope.  The provisions of this chapter shall govern the minimum conditions and standards for light, ventilation and space for occupying a structure.

1101.2 Responsibility.  The owner of the structure shall provide and maintain light, ventilation and space conditions in compliance with these requirements.  A person shall not occupy as owner-occupant, or permit another person to occupy, any premises that do not comply with the requirements of this chapter.

1101.3 Alternative devices.  In lieu of the means for natural light and ventilation herein prescribed, artificial light or mechanical ventilation complying with the International Building Code shall be permitted.

Section 1102 Light

1102.1 Habitable spaces.  Every habitable space shall have at least one window of approved size facing directly to the outdoors or to a court.  The minimum total glazed area for every habitable space shall be 8 percent of the floor area of such room.  Wherever walls or other portions of a structure face a window of any room and such obstructions are located less than 3 feet (914 mm) from the window and extend to a level above that of the ceiling of the room, such window shall not be deemed to face directly to the outdoors nor to a court and shall not be included as contributing to the required minimum total window area for the room.

Exception:  Where natural light for rooms or spaces without exterior glazing areas is provided through an adjoining room, the unobstructed opening to the adjoining room shall be at least 8 percent of the floor area of the interior room or space, but not less than 25 square feet (2.33 m2).  The exterior glazing area shall be based on the total floor area being served.

1102.2 Common halls and stairways.  Every common hall and stairway in residential occupancies, other than in one- and two-family dwellings, shall be lighted at all times with at least a 60-watt standard incandescent light bulb for each 200 square feet (19 m2) of floor area or equivalent illumination, provided that the spacing between lights shall not be greater than 30 feet (9,144 mm).  In other than residential occupancies, means of egress, including exterior means of egress stairways shall be illuminated at all times the building space served by the means of egress is occupied with a minimum of 1 foot-candle (11 lux) at floors, landings and treads.

1102.3 Other spaces.  All other spaces shall be provided with natural or artificial light sufficient to permit the maintenance of sanitary conditions, and the safe occupancy of the space and utilization of the appliances, equipment and fixtures.

Section 1103 Ventilation

1103.1 Habitable spaces.  Every habitable space shall have at least one openable window.  The total openable area of the window in every room shall be equal to at least 45 percent of the minimum glazed area required in Section 1102.1.

Exception:  Where rooms and spaces without openings to the outdoors are ventilated through an adjoining room, the unobstructed opening to the adjoining room shall be at least 8 percent of the floor area of the interior room or space, but not less than 25 square feet (2.33 m2).  The ventilation openings to the outdoors shall be based on a total floor area being ventilated.

1103.2 Bathrooms and toilet rooms.  Every bathroom and toilet room shall comply with the ventilation requirements for habitable spaces as required by Section 1103.1, except that a window shall not be required in such spaces equipped with a mechanical ventilation system.  Air exhausted by a mechanical ventilation system from a bathroom or toilet room shall discharge to the outdoors and shall not be recirculated.

1103.3 Cooking facilities.  Unless approved through the certificate of occupancy, cooking shall not be permitted in any rooming unit or dormitory unit, and a cooking facility or appliance shall not be permitted to be present in a rooming unit or dormitory unit.

Exception:  Where specifically approved in writing by the code official.

1103.4 Process ventilation.  Where injurious, toxic, irritating or noxious fumes, gases, dusts or mists are generated, a local exhaust ventilation system shall be provided to remove the contaminating agent at the source.  Air shall be exhausted to the exterior and not be recirculated to any space.

1103.5 Clothes dryer exhaust.  Clothes dryer exhaust systems shall be independent of all other systems and shall be exhausted in accordance with the manufacturer’s instructions.

Section 1104 Occupancy Limitations

1104.1 Privacy.  Dwelling units, hotel units, housekeeping units, rooming units and dormitory units shall be arranged to provide privacy and be separate from other adjoining spaces.

1104.2 Minimum room widths.  A habitable room, other than a kitchen, shall not be less than 7 feet (2134 mm) in any plan dimension.  Kitchens shall have a clear passageway of not less than 3 feet (914 mm) between counter fronts and appliances or counter fronts and walls.

1104.3 Minimum ceiling heights.  Habitable spaces, hallways, corridors, laundry areas, bathrooms, toilet rooms and habitable basement areas shall have a clear ceiling height of not less than 7 feet (2134 mm).

Exceptions:

1.  In one- and two-family dwellings, beams or girders spaced not less than 4 feet (1219 mm) on center and projecting not more than 6 inches (152 mm) below the required ceiling height.

2.  Basement rooms in one- and two-family dwellings occupied exclusively for laundry, study or recreation purposes, having a ceiling height of not less than 6 feet 8 inches (2033 mm) with not less than 6 feet 4 inches (1932 mm) of clear height under beams, girders, ducts and similar obstructions.

3.  Rooms occupied exclusively for sleeping, study or similar purposes and having a sloped ceiling over all or part of the room, with a clear ceiling height of at least 7 feet (2134 mm) over not less than one-third of the required minimum floor area.  In calculating the floor area of such rooms, only those portions of the floor area with a clear ceiling height of 5 feet (1524 mm) or more shall be included.

1104.4 Bedroom requirements.  Every bedroom shall comply with the requirements of Sections 1104.4.1 through 1104.4.5.

1104.4.1 Area for sleeping purposes.  Every bedroom occupied by one person shall contain at least 70 square feet (6.5 m2) of floor area, and every bedroom occupied by more than one person shall contain at least 50 square feet (4.6 m2) of floor area for each occupant thereof.

1104.4.2 Access from bedrooms.  Bedrooms shall not constitute the only means of access to other bedrooms or habitable spaces and shall not serve as the only means of egress from other habitable spaces.

Exception:  Units that contain fewer than two bedrooms.

1104.4.3 Water closet accessibility.  Every bedroom shall have access to at least one water closet and one lavatory without passing through another bedroom.  Every bedroom in a dwelling unit shall have access to at least one water closet and lavatory located in the same story as the bedroom or an adjacent story.

1104.4.4 Prohibited occupancy.  Kitchens and non-habitable spaces shall not be used for sleeping purposes.

1104.4.5 Other requirements.  Bedrooms shall comply with the applicable provisions of this code including, but not limited to, the light, ventilation, room area, ceiling height and room width requirements of this chapter; the plumbing facilities and water-heating facilities requirements of Chapter 12; the heating facilities and electrical receptacle requirements of Chapter 13; and the smoke detector and emergency escape requirements of Chapter 14.

1104.5 Overcrowding.  Dwelling units shall not be occupied by more occupants than permitted by the minimum area requirements of Table 1104.5.

1104.5.1 Sleeping area.  The minimum occupancy area required by Table 1104.5 shall not be included as a sleeping area in determining the minimum occupancy area for sleeping purposes.  All sleeping areas shall comply with Section 1104.4.

1104.5.2 Combined spaces.  Combined living room and dining room spaces shall comply with the requirements of Table 1104.5 if the total area is equal to that required for separate rooms and if the space is located so as to function as a combination living room/dining room.

1104.6 Efficiency unit.  Nothing in this section shall prohibit an efficiency living unit from meeting the following requirements:

1.  A unit occupied by not more than two occupants shall have a clear floor area of not less than 220 square feet (20.4 m2).  A unit occupied by three occupants shall have a clear floor area of not less than 320 square feet (29.7 m2).  These required areas shall be exclusive of the areas required by Items 2 and 3.

2.  The unit shall be provided with a kitchen sink, cooking appliance and refrigeration facilities, each having a clear working space of not less than 30 inches (762 mm) in front.  Light and ventilation conforming to this code shall be provided.

3.  The unit shall be provided with a separate bathroom containing a water closet, lavatory and bathtub or shower.

4.  The maximum number of occupants shall be three.

1104.7 Food preparation.  All spaces to be occupied for food preparation purposes shall contain suitable space and equipment to store, prepare and serve foods in a sanitary manner.  There shall be adequate facilities and services for the sanitary disposal of food wastes and refuse, including facilities for temporary storage.

Chapter 12

PLUMBING FACILITIES AND FIXTURE REQUIREMENTS

Section 1201 General

1201.1 Scope.  The provisions of this chapter shall govern the minimum plumbing systems, facilities and plumbing fixtures to be provided.

1201.2 Responsibility.  The owner of the structure shall provide and maintain such plumbing facilities and plumbing fixtures in compliance with these requirements.  A person shall not occupy as owner-occupant or permit another person to occupy any structure or premises which does not comply with the requirements of this chapter.

Section 1202 Required Facilities

1202.1 Dwelling units.  Every dwelling unit shall contain its own bathtub or shower, lavatory, water closet and kitchen sink which shall be maintained in a sanitary, safe working condition.  The lavatory shall be placed in the same room as the water closet or located in close proximity to the door leading directly into the room in which such water closet is located.  A kitchen sink shall not be used as a substitute for the required lavatory.

1202.2 Rooming houses.  At least one water closet, lavatory and bathtub or shower shall be supplied for each four rooming units.

1202.3 Hotels.  Where private water closets, lavatories and baths are not provided, one water closet, one lavatory and one bathtub or shower having access from a public hallway shall be provided for each ten occupants.

1202.4 Employees’ facilities.  A minimum of one water closet, one lavatory and one drinking facility shall be available to employees.

1202.4.1 Drinking facilities.  Drinking facilities shall be a drinking fountain, water cooler, bottled water cooler or disposable cups next to a sink or water dispenser.  Drinking facilities shall not be located in toilet rooms or bathrooms.

Section 1203 Toilet Rooms

1203.1 Privacy.  Toilet rooms and bathrooms shall provide privacy and shall not constitute the only passageway to a hall or other space, or to the exterior.  A door and interior locking device shall be provided for all common or shared bathrooms and toilet rooms in a multiple dwelling.

1203.2 Location.  Toilet rooms and bathrooms serving hotel units, rooming units or dormitory units or housekeeping units, shall have access by traversing not more than one flight of stairs and shall have access from a common hall or passageway.

1203.3 Location of employee toilet facilities.  Toilet facilities shall have access from within the employees’ working area.  The required toilet facilities shall be located not more than one story above or below the employees’ working area and the path of travel to such facilities shall not exceed a distance of 500 feet (152 m).  Employee facilities shall either be separate facilities or combined employee and public facilities.

Exception:  Facilities that are required for employees in storage structures or kiosks, which are located in adjacent structures under the same ownership, lease or control, shall not exceed a travel distance of 500 feet (152 m) from the employees’ regular working area to the facilities.

1203.4 Floor surface.  In other than dwelling units, every toilet room floor shall be maintained to be a smooth, hard, nonabsorbent surface to permit such floor to be easily kept in a clean and sanitary condition.

Section 1204 Plumbing Systems and Fixtures

1204.1 General.  All plumbing fixtures shall be properly installed and maintained in working order, and shall be kept free from obstructions, leaks and defects and be capable of performing the function for which such plumbing fixtures are designed.  All plumbing fixtures shall be maintained in a safe, sanitary and functional condition.

1204.2 Fixture clearances.  Plumbing fixtures shall have adequate clearances for usage and cleaning.

1204.3 Plumbing system hazards.  Where it is found that a plumbing system in a structure constitutes a hazard to the occupants or the structure by reason of inadequate service, inadequate venting, cross connection, back-siphonage, improper installation, deterioration or damage or for similar reasons, the code official shall require the defects to be corrected to eliminate the hazard.

Section 1205 Water System

1205.1 General.  Every sink, lavatory, bathtub or shower, drinking fountain, water closet or other plumbing fixture shall be properly connected to either a public water system or to an approved private water system.  All kitchen sinks, lavatories, laundry facilities, bathtubs and showers shall be supplied with hot or tempered and cold running water in accordance with the Uniform Plumbing Code.

1205.2 Contamination.  The water supply shall be maintained free from contamination, and all water inlets for plumbing fixtures shall be located above the flood-level rim of the fixture.  Shampoo basin faucets, janitor sink faucets and other hose bibs or faucets to which hoses are attached and left in place, shall be protected by an approved atmospheric-type vacuum breaker or an approved permanently attached hose connection vacuum breaker.

1205.3 Supply.  The water supply system shall be installed and maintained to provide a supply of water to plumbing fixtures, devices and appurtenances in sufficient volume and at pressures adequate to enable the fixtures to function properly, safely, and free from defects and leaks.

1205.4 Water heating facilities.  Water heating facilities shall be properly installed, maintained and capable of providing an adequate amount of water to be drawn at every required sink, lavatory, bathtub, shower and laundry facility at a temperature of not less than 110°F (43°C).  A gas-burning water heater shall not be located in any bathroom, toilet room, bedroom or other occupied room normally kept closed, unless adequate combustion air is provided.  An approved combination temperature and pressure-relief valve and relief valve discharge pipe shall be properly installed and maintained on water heaters.

Section 1206 Sanitary Drainage System

1206.1 General.  All plumbing fixtures shall be properly connected to either a public sewer system or to an approved private sewage disposal system.

1206.2 Maintenance.  Every plumbing stack, vent, waste and sewer line shall function properly and be kept free from obstructions, leaks and defects.

Section 1207 Storm Drainage

1207.1 General.  Drainage of roofs and paved areas, yards and courts, and other open areas on the premises shall not be discharged in a manner that creates a public nuisance.

Chapter 13

MECHANICAL AND ELECTRICAL REQUIREMENTS

Section 1301 General

1301.1 Scope.  The provisions of this chapter shall govern the minimum mechanical and electrical facilities and equipment to be provided.

1301.2 Responsibility.  The owner of the structure shall provide and maintain mechanical and electrical facilities and equipment in compliance with these requirements.  A person shall not occupy as owner-occupant or permit another person to occupy any premises which does not comply with the requirements of this chapter.

Section 1302 Heating Facilities

1302.1 Facilities required.  Heating facilities shall be provided in structures as required by this section.

1302.2 Residential occupancies.  Dwellings shall be provided with heating facilities capable of maintaining a room temperature of 68°F (20°C) in all habitable rooms, bathrooms and toilet rooms based on the winter outdoor design temperature for the locality indicated in TABLE R301.2(1) of the International Residential Code.  Cooking appliances shall not be used to provide space heating to meet the requirements of this section.

Exception:  In areas where the average monthly temperature is above 30°F (-1°C), a minimum temperature of 65°F (18°C) shall be maintained.

1302.3 Heat supply.  Every owner and operator of any building who rents, leases or lets one or more dwelling unit, rooming unit, dormitory or guestroom on terms, either expressed or implied, to furnish heat to the occupants thereof shall supply heat to maintain a temperature of not less than 68°F (20°C) in all habitable rooms, bathrooms, and toilet rooms.

Exceptions:

1.  When the outdoor temperature is below the winter outdoor design temperature for the locality, maintenance of the minimum room temperature shall not be required provided that the heating system is operating at its full design capacity.  The winter outdoor design temperature for the locality shall be as indicated in TABLE R301.2(1) of the International Residential Code.

2.  In areas where the average monthly temperature is above 30°F (-1°C) a minimum temperature of 65°F (18°C) shall be maintained.

1302.4 Occupiable work spaces.  Indoor occupiable work spaces shall be supplied with heat to maintain a temperature of not less than 65°F (18°C) during the period the spaces are occupied.

Exceptions:

1.  Processing, storage and operation areas that require cooling or special temperature conditions.

2.  Areas in which persons are primarily engaged in vigorous physical activities.

1302.5 Room temperature measurement.  The required room temperatures shall be measured 3 feet (914 mm) above the floor near the center of the room and 2 feet (610 mm) inward from the center of each exterior wall.

Section 1303 Mechanical Equipment

1303.1 Mechanical appliances.  All mechanical appliances, fireplaces, solid fuel-burning appliances, cooking appliances and water heating appliances shall be properly installed and maintained in a safe working condition, and shall be capable of performing the intended function.

1303.2 Removal of combustion products.  All fuel-burning equipment and appliances shall be connected to an approved chimney or vent.

Exception:  Fuel-burning equipment and appliances which are labeled for unvented operation.

1303.3 Clearances.  All required clearances to combustible materials shall be maintained.

1303.4 Safety controls.  All safety controls for fuel-burning equipment shall be maintained in effective operation.

1303.5 Combustion air.  A supply of air for complete combustion of the fuel and for ventilation of the space containing the fuel-burning equipment shall be provided for the fuel burning equipment.

1303.6 Energy conservation devices.  Devices intended to reduce fuel consumption by attachment to a fuel-burning appliance, to the fuel supply line thereto, or to the vent outlet or vent piping there from, shall not be installed unless labeled for such purpose and the installation is specifically approved.

Section 1304 Electrical Facilities

1304.1 Facilities required.  Every occupied building shall be provided with an electrical system in compliance with the requirements of this section and Section 605.

1304.2 Service.  The size and usage of appliances and equipment shall serve as a basis for determining the need for additional facilities in accordance with the Electrical Code.  Dwelling units shall be served by a three-wire, 120/240 volt, single phase electrical service having a rating of not less than 60 amperes.

1304.3 Electrical system hazards.  Where it is found that the electrical system in a structure constitutes a hazard to the occupants or the structure by reason of inadequate service, improper fusing, insufficient receptacle and lighting outlets, improper wiring or installation, deterioration or damage, or for similar reasons, the code official shall require the defects to be corrected to eliminate the hazard.

Section 1305 Electrical Equipment

1305.1 Installation.  All electrical equipment, wiring and appliances shall be properly installed and maintained in a safe and approved manner.

1305.2 Receptacles.  Every habitable space in a dwelling shall contain at least two separate and remote receptacle outlets.  Every laundry area shall contain at least one grounded type receptacle or a receptacle with a ground fault circuit interrupter.  Every bathroom shall contain at least one receptacle.  Any new bathroom receptacle outlet shall have ground fault circuit interrupter protection.

1305.3 Lighting fixtures.  Every public hall, interior stairway, toilet room, kitchen, bathroom, laundry room, boiler room and furnace room shall contain at least one electric lighting fixture.

Section 1306 Elevators, Escalators and Dumbwaiters

1306.1 General.  Elevators, dumbwaiters and escalators shall be maintained to sustain safely all imposed loads, to operate properly, and to be free from physical and fire hazards.  The most current certificate of inspection shall be on display at all times within the elevator or attached to the escalator or dumbwaiter; or the certificate shall be available for public inspection in the office of the building operator.

1306.2 Elevators.  In buildings equipped with passenger elevators, at least one elevator shall be maintained in operation at all times when the building is occupied.

Exception:  Buildings equipped with only one elevator shall be permitted to have the elevator temporarily out of service for testing or servicing.

Section 1307 Duct Systems

1307.1 General.  Duct systems shall be maintained free of obstructions and shall be capable of performing the required function.

Chapter 14

FIRE SAFETY REQUIREMENTS

Section 1401 General

1401.1 Scope.  The provisions of this chapter shall govern the minimum conditions and standards for fire safety relating to structures and exterior premises, including fire safety facilities and equipment to be provided.

1401.2 Responsibility.  The owner of the premises shall provide and maintain such fire safety facilities and equipment in compliance with these requirements.  A person shall not occupy as owner-occupant or permit another person to occupy any premises that do not comply with the requirements of this chapter.

Section 1402 Means of Egress

1402.1 General.  A safe, continuous and unobstructed path of travel shall be provided from any point in a building or structure to the public way.  Means of egress shall comply with the International Fire Code.

1402.2 Aisles.  The required width of aisles in accordance with the International Fire Code shall be unobstructed.

1402.3 Locked doors.  All means of egress doors shall be readily openable from the side from which egress is to be made without the need for keys, special knowledge or effort, except where the door hardware conforms to that permitted by the International Building Code.

1402.4 Emergency escape openings.  Required emergency escape openings shall be maintained in accordance with the code in effect at the time of construction, and the following.  Required emergency escape and rescue openings shall be operational from the inside of the room without the use of keys or tools.  Bars, grilles, grates or similar devices are permitted to be placed over emergency escape and rescue openings provided the minimum net clear opening size complies with the code that was in effect at the time of construction and such devices shall be releasable or removable from the inside without the use of a key, tool or force greater than that which is required for normal operation of the escape and rescue opening.

Section 1403 Fire-Resistance Ratings

1403.1 Fire-resistance-rated assemblies.  The required fire-resistance rating of fire resistance-rated walls, fire stops, shaft enclosures, partitions and floors shall be maintained.

1403.2 Opening protectives.  Required opening protectives shall be maintained in an operative condition.  All fire and smoke-stop doors shall be maintained in operable condition.  Fire doors and smoke barrier doors shall not be blocked or obstructed or otherwise made inoperable.

Section 1404 Fire Protection Systems

1404.1 General.  All systems, devices and equipment to detect a fire, actuate an alarm, or suppress or control a fire or any combination thereof shall be maintained in an operable condition at all times in accordance with the International Fire Code.

1404.2 Smoke alarms.  Single or multiple-station smoke alarms shall be installed and maintained in Groups R-2, R-3, R-4 and in dwellings not regulated in Group R occupancies, regardless of occupant load at all of the following locations:

1.  On the ceiling or wall outside of each separate sleeping area in the immediate vicinity of bedrooms.

2.  In each room used for sleeping purposes.

3.  In each story within a dwelling unit, including basements and cellars but not including crawl spaces and uninhabitable attics.  In dwellings or dwelling units with split levels and without an intervening door between the adjacent levels, a smoke alarm installed on the upper level shall suffice for the adjacent lower level provided that the lower level is less than one full story below the upper level.

Single or multiple-station smoke alarms shall be installed in other groups in accordance with the International Fire Code.

1404.3 Power source.  In Group R occupancies and in dwellings not regulated as Group R occupancies, single-station smoke alarms shall receive their primary power from the building wiring provided that such wiring is served from a commercial source and shall be equipped with a battery backup.  Smoke alarms shall emit a signal when the batteries are low.  Wiring shall be permanent and without a disconnecting switch other than as required for over-current protection.

Exception:  Smoke alarms are permitted to be solely battery operated in buildings where no construction is taking place, buildings that are not served from a commercial power source and in existing areas of buildings undergoing alterations or repairs that do not result in the removal of interior wall or ceiling finishes exposing the structure, unless there is an attic, crawl space or basement available which could provide access for building wiring without the removal of interior finishes.

1404.4 Interconnection.  Where more than one smoke alarm is required to be installed within an individual dwelling unit in Group R-2, R-3, R-4 and in dwellings not regulated as Group R occupancies, the smoke alarms shall be interconnected in such a manner that the activation of one alarm will activate all of the alarms in all bedrooms over background noise levels with all intervening doors closed.

Exceptions:

1.  Interconnection is not required in buildings which are not undergoing alterations, repairs, or construction of any kind.

2.  Smoke alarms in existing areas are not required to be interconnected where alterations or repairs do not result in the removal of interior wall or ceiling finishes exposing the structure, unless there is an attic, crawl space or basement available which could provide access for interconnection.

This chapter lists the standards that are referenced in various sections of this document.  The standards are listed herein by the promulgating agency of the standard, the standard identification; the effective date and title and the section or sections of this document that reference the standard.  The codes and standards referenced in this chapter shall be considered part of the requirements of this code to the prescribed extent of each such reference.  Where differences occur between provisions of this code and the referenced standards, the provisions of this code shall apply.
