6.20.010 Hours for public use.

The city burning area is open for use by the citizens and taxpayers of the city. The hours of use by the public are from 8:30 a.m. to 4:30 p.m., Monday through Friday. (Ord. 590 § 1, 1979)

6.20.020 Entry procedure.

The gate to the city burning area shall, at all times, remain locked. Citizens and taxpayers of Westport desiring to use the facilities shall obtain a key to the gate from the city clerk at the City Hall and shall, at that time, pay the fees provided for in WMC 6.20.030. (Ord. 590 § 2, 1979)

6.20.030 Prohibited items and products Fees.

(1) There shall be a charge of $8.00 per cubic yard with a minimum of $40.00 by contractors, and $2.50 per cubic yard for citizens disposing of natural vegetation and wood waste from a residential lot with the site with a minimum of $15.00 per load. The contractor rate is defined as anyone in commercial business who is being paid for a service to dispose of natural vegetation and/or wood waste, or is furthering the development of any property for commercial interests. Residential rates have been established for persons to dispose of natural yard waste (leaves, trees, clippings, etc.) in the regular upkeep of residential lots or property.

(2) Only natural vegetation and wood waste from within the city limits of Westport is allowed to be transported to the site. All material transported to the site must be clean and free of earth and sand. Individuals and/or contractors responsible for transporting wood waste loads containing debris other than natural wood waste shall pay the actual cost for its removal and disposal.

(3) All users of the burn site shall indemnify, defend and hold the city of Westport harmless for every cause of action and every damage claim in any way related to their use of the “burn site.” (Ord. 1395, 2006; Ord. 659, 1981; Ord. 614, 1980; Ord. 590 § 3, 1979)

6.20.050 Penalty for violation.

Any violation of this chapter shall constitute a misdemeanor and be punished by a fine of not less than $50.00. (Ord. 590 § 4, 1979)

6.20.060 Unlawful trespass at burning site.

It is unlawful for any person to trespass in a motor vehicle, or cause a motor vehicle to be brought to the city burning site described as follows: 50 feet north and 50 feet south of the centerline of Pacific Street, commencing at a point 100 feet east of the intersection of Pacific Street and Montesano Avenue, east to the Grays Harbor estuary; provided, however, that persons may cause motor vehicles to be brought on said property after paying the fee established by ordinance or resolution by the city of Westport for traversing said property, and after having received authorization from a duly authorized official of the city of Westport or the city police department.
