MISCELLANEOUS REGULATIONS

9.12.010 Expectoration and obstruction of passageway prohibited.

Every person who shall expectorate upon the floor of any public building, or on any sidewalk, steps leading to the entrance of any place of business, or upon any guardrail structure, or wall adjacent thereto, or upon any door, window or structure, in any manner connected therewith, or shall cast or cause to become precipitated into any staircase or entrance leading to any place of business any refuse of any kind, character or description, or shall stand or loiter in or about the doorway or entrance to any building or entrance to any business establishment or office in such manner as to obstruct any passageway or to the annoyance of the owner or occupant thereof shall be deemed to have committed a civil infraction as set forth in Section 1.08.030.  (Ord. 376 §12, 2001:  Ord. 367 §17, 2001:  Ord. 9.12.020 Discharging firearms prohibited.

A.  It is unlawful for any person willfully and without lawful authority to fire, set off, or discharge any bomb, gun, pistol or firearm of any kind in the town, except that this section shall not apply to:

1.  Police officers while in the discharge of their lawful duties;

2.  Persons practicing target shooting in a duly licensed shooting gallery or at a target range maintained and operated by a law enforcement agency or by an organized rifle or gun club affiliated with a national shooting organization.

B.  Every person convicted of a violation of this section shall be guilty of a misdemeanor punishable in accordance with state law.  (Ord. 367 §18, 2001:  Ord. 249 §§1, 2, 1991)

9.12.030 Trapping and hunting prohibited.

It is unlawful to hunt, trap, capture any animal or bird within the city; provided, that this section shall not apply to law enforcement officers, or game department personnel while engaged in the performance of their official duties; provided further, that this section shall not apply to the hunting, trapping or capturing of rats, mice, moles, skunks or raccoons if it is otherwise lawful to trap or hunt the same; and provided further, that this section shall not apply to the humane destruction of a dangerous animal or an animal or bird suffering from serious injury or disease.  Every person convicted of a violation of this section shall be guilty of a misdemeanor punishable in accordance with state law.  (Ord. 367 §19, 2001:  Ord. 248 §1, 1991)
