10.24.010 Purpose.

The purpose of this chapter is to regulate in a reasonable manner the operation of snowmobiles within the town and to provide the circumstances and conditions when and where snowmobiles may be legally operated upon the public roadways of the town.  (Ord. 89-B §1, 1979)

10.24.020 Definition.

The term "snowmobile" means any self-propelled vehicle capable of traveling over snow or ice, which utilizes as its means of propulsion an endless belt thread or cleats or any combination of these, or other similar means of contact with the surface upon which it is operated, and which is steered wholly or in part by skis or sled-type runners, and which is not otherwise registered as or subject to the motor vehicle excise tax in the state.  (Ord. 89-B §2, 1979)

10.24.030 Street operation--Where allowed.

It is lawful to operate a snowmobile upon any of the streets and alleys of the town except those streets and alleys specifically designated as being closed for the operation of snowmobiles, as per Exhibit A, as set out in this chapter.  (Ord. 89-B §3, 1979)

10.24.040 Hours of operation.

The streets and alleys specifically opened for the operation of snowmobiles may be used for the operation of snowmobiles only between the hours of seven a.m. and eleven p.m.  (Ord. 89-B §4, 1979)

10.24.060 Unlawful to permit operation by unqualified person.

It is unlawful for any person to knowingly permit, allow or encourage the operation or driving of a snowmobile by a person who is not otherwise qualified to operate a snowmobile.  (Ord. 89-B §6, 1979)

10.24.080 Regulations for operation.

A.  It is unlawful to drive, operate, or park a snowmobile on any sidewalk in the town.

B.  No snowmobile shall be operated at a speed in excess of fifteen miles per hour in the town.

C.  No snowmobile shall carry passengers or weights in excess of the capacity recommended by the manufacturer thereof.

D.  No sled, toboggan, trailer or any other device shall be towed by a snowmobile except by means of a rigid tow bar connecting the same to such device.

E.  No person on skis shall be towed behind a snowmobile.

F.  It is unlawful to drive or operate a snowmobile under the influence of intoxicating liquor or habit-forming drugs.

G.  All snowmobiles shall come to a full stop at all street intersections.

H.  All snowmobiles shall be operated in single file on the right-hand side of the street.

I.  Operation of snowmobiles on the streets of the town shall be limited to ingress and egress to and from the town; the town streets and alleys designated are not to be used as a place of recreation for snowmobiles.

J.  No person shall operate a snowmobile carelessly and needlessly, or without due caution and circumspection and at a speed or in a manner as to endanger or be likely to endanger any person or property.

K.  No person shall operate a snowmobile on those parts of State Highway No. 21 and U.S. No. 2 which are in the confines of the town unless there is a valid reason to cross such highway, and then only when done in accordance with RCW 46.10.100, which is expressly adopted by reference and incorporated herein as if fully set forth; there shall be no other type of snowmobile traffic allowed in this area.

L.  It is unlawful to operate a snowmobile in any area or in such manner so as to expose the underlying soil or vegetation, or to injure, damage, or destroy trees or growing crops.

M.  It is unlawful to operate any snowmobile on any private, city and school property without written authorization to do so from the property owner or his authorized agent.

N.  In addition to the regulations for operation of snowmobiles established herein, operators of snowmobiles upon the public streets and alleys of the town shall be required to adhere to and obey all of the rules of the road for operating motor vehicles as set forth in RCW Chapter 46.61.  (Ord. 89-B §8, 1979)

10.24.090 Registration required.

All snowmobiles operating within the town shall be registered as required under the provisions of RCW Chapter 46.10.  (Ord. 89-B §9, 1979)

10.24.100 Violation--Penalty.

Any person violating any provision of this chapter shall be deemed to have committed a civil infraction punishable by a fine as set forth in Section 1.08.030.  (Ord. 376 §15, 2001:  Ord. 367 §23, 2001:  Ord. 89-B §11, 1979)
