1.75.010 When awarded.

The city council shall award the contract for the city legal advertising annually on the third Tuesday in February of each year in the manner described in this chapter. (Ord. 2597 § 1, 1982: Ord. 1919 § 2 (part), 1976).

1.75.020 Council to prescribe contract form—Date—Call for bids—Specifications for city newspaper.

The city council shall, on the first Tuesday in February of each year, by resolution prescribe the form of contract for the printing and publishing of city advertising for the ensuing year, and the city clerk shall then forthwith publish a notice calling for sealed proposals for such contract in two successive issues of the newspaper then publishing the city advertising, which notice shall contain a general statement of the terms of the contract to be awarded, together with notification of the time and place of public opening and reading of the sealed proposals; provided, proposals will be accepted for publication only in those newspapers posted as legal newspapers by the clerk of the Yakima County Superior Court according to the provisions of RCW 65.16.070; and provided further, such proposals will be accepted for publication only in those newspapers published within and having general circulation within the city of Yakima. 1.75.030 Opening proposals—Award of contract—Rejection of bids.

A.    At the time and place specified in the notice, the city clerk and purchasing agent of the city shall publicly open the sealed proposals, shall tabulate the results and make a recommendation to the city council as to the proposal which constitutes the lowest responsible proposal which complies with the requirements of this chapter and with the published notice calling for the sealed proposals.

B.    At the regular city council meeting on the third Tuesday of February of each year, the city council shall consider such proposals and the recommendation of the city clerk and purchasing agent and shall, by motion, accept the lowest responsible proposal which complies with the requirements of this chapter and with the published notice calling for the sealed proposals, and shall award a contract therefor; provided, the city council may reject any and all proposals and direct that a further call for proposals be published, according to procedures prescribed by this chapter, until a satisfactory proposal is received. Such further call for proposals shall be published in the newspaper which published the city’s legal advertising for the previous year. (Ord. 2597 § 3, 1982; Ord. 1919 § 2 (part), 1976).

1.75.040 Notification of award and execution of contract.

Upon the award of the contract by the city council as provided in subsection B of Section 1.75.030, the clerk shall forthwith notify the successful bidder by mail, or in person, of the award of the contract to that successful bidder who shall, within three days from the date of such notification, execute a contract in the form prescribed by the resolution adopted pursuant to Section 1.75.020. In the event of the failure or refusal of the successful bidder to execute that contract, the city council may award the contract to the next lowest bidder. (Ord. 1919 § 2 (part), 1976).

1.75.050 Award of contract without calling for bids.

Notwithstanding the provisions of Sections 1.75.020, 1.75.030 and 1.75.040, if only one newspaper is posted as legal and is published within and having circulation within the city of Yakima, the city council in its discretion may award the legal advertising contract without calling for bids.
