9.24.010 Permit – Required.

No person shall operate or move any vehicle or combination of vehicles of a size, weight of vehicle or load exceeding the maximum specified in RCW 46.12, 46.16 and 46.44, as amended, upon any public highway under the jurisdiction of Yakima County without first obtaining a special permit as required by this chapter.

9.24.020 Permit – Issuance Conditions.

In compliance with laws of this state governing special permits, additional gross loads (restricted route permits) the county road engineer is authorized to issue said permits on Yakima County roads under the following conditions:

(1)    Truck owners must first have restricted route permit from State Highway Department;

(2)    County permit is valid for collection and delivery of commodities on Yakima County roads and void if Yakima County roads are used as an alternate haul route;

(3)    County permit void on roads and/or bridges posted restricting gross loads of vehicles.

9.24.030 Permit – Issuance.

The special permit required by this chapter shall be issued in writing by the Yakima County road engineer, upon application therefor and upon good cause being shown therefor. No over-legal load permit shall be issued to any vehicle or combination of vehicles unless such vehicle or combination of vehicles is licensed for the maximum gross weight allowed by law.

9.24.040 Permit – Fees.

Over-legal load permits issued under this Chapter will not require the payment of a Fee; except that, over-width loads which are greater than twenty-five (25) feet in width will require the payment of a non-refundable fee of Two Hundred Fifty ($250) dollars. All funds collected shall be deposited in the county road fund.

9.24.050 Permit – Combination of Roads.

When the move involves a combination of State highways, city roads or streets and County roads, it shall be the sole responsibility of the permittee to acquire the necessary permits from the affected City. The issuance of an over-legal permit by Yakima County shall not be considered approval to move any over-legal load on any City or Town street or any State Highway.

9.24.060 Permit – Misrepresentation – Inspection.

Any person who misrepresents the size or weight of any load in obtaining a special permit or does not follow the requirements and conditions of the special permit is guilty of a misdemeanor and upon conviction thereof shall be punished as provided in Section 1.24.010.

Any person who operates any vehicle, the gross weight of which is in excess of the maximum for which such vehicle may be eligible for license, or in excess of legal size limitations, without first obtaining a special permit is guilty of a misdemeanor and upon conviction thereof shall be punished as provided in Section 1.24.010.

Every special permit issued hereunder shall be carried in the vehicle or combination of vehicles to which it refers and shall be open to inspection by any peace officer or authorized agent of any authority granting such permit.

9.24.070 State Law.

This chapter is to be construed in conjunction with the laws of the state, RCW Title 46, as heretofore or hereafter amended.
