SWIMMING, SKINDIVING AND WATER SKIING

11.12.010 Swimming.

Swimming in the harbor shall be confined to:

A. Restricted swimming areas;

B. Within a distance of 100 feet from the shore, unless the swimmer is accompanied by a watercraft. (Ord. 507 § 1, 2001)

11.12.020 Skindiving – Scuba diving.

A. Skindiving and scuba diving are prohibited unless a diver’s flag is displayed.

B. Skindiving and scuba diving are prohibited when done more than 100 feet from the shoreline or a pier unless the diver is accompanied by a watercraft displaying a diver’s flag.

C. Skindiving and scuba diving shall be prohibited within 300 feet of any public boat launch, pier or dock. (Ord. 507 § 1, 2001)

11.12.030 Water skiing.

A. Night Skiing. No night water skiing shall be allowed within the town harbor. “Night,” as used herein, shall mean for one-half hour after sunset to sunrise; provided, that this subsection shall not apply to watercraft used in duly authorized water ski tournaments, competitions, expositions, or trials therefor. A violation of this subsection is a misdemeanor.

B. It is unlawful for any watercraft, vessel or personal watercraft to tow or otherwise assist anyone on water skis, aqua-plane, surfboard or similar contrivance within 100 yards of the shoreline, a pier, a dock, a bridge, a public swimming area or any restricted area; provided, however, water skiers may start from or return to shore or a shore installation so long as said start or return is made directly or from open water. “Open water”, for the purpose of this section, means that portion of the harbor which is more than 100 yards from the shore or a shore installation.
