RESTRICTED AREAS AND OBSTRUCTIONS

11.08.010 Restricted areas.

In interests of safe navigation, life safety and the protection of property, the director of public safety shall designate restricted areas and testing courses of within 100 feet lakeward from any public swimming area; provided, that this section shall not apply to vessels or watercraft engaged in or accompanying the activity to which the area is restricted, nor to patrol or rescue craft or in the case of an emergency. 11.08.020 Obstruction – Moving of same.

A. No master, person or owner having charge of any vessel, watercraft or obstruction shall anchor or moor the same in any anchorage, fairway, or harbor or make the same fast to any buoy, pier or other structure owned by or under the authority, control or within the jurisdiction of the town without first obtaining a permit from the town.

B. Only Yarrow Point residents who have obtained a permit from the U.S. Army Corps of Engineers prior to the date of the adoption of the ordinance codified in this section (June 8, 2004) shall be allowed to continue to moor or anchor in the harbor of the town as though the town had issued a permit.

C. Permits for moorage or anchoring in the harbor of the town shall be limited to waterfront land owners and shall be issued by the town through the substantial development process as stated in the Yarrow Point Municipal Code.

D. No master, owner or other person in charge of any towboat shall, while towing any vessel, watercraft or obstruction, obstruct any channel, fairway, or harbor.

E. The marine patrol or any duly authorized officer of the town shall have the power to cause the removal of any:

1. Vessel, watercraft or obstruction anchored in any channel or fairway, the harbor, or made fast to any buoy, pier or other structure owned by or under the authority and control of the town:

2. Towboat and/or its tow which is obstructing navigation in any channel, fairway or harbor;

3. Vessel, watercraft or obstruction lying at any pier in the harbor which is obstructing any slip, fairway or other vessel or watercraft;

4. Buoy that is anchored in the harbor, channel or fairway within the jurisdiction of the town;

5. In the event that the town of Yarrow Point through authorized agents, such as the marine patrol, causes to have removed from any channel, fairway or harbor any vessel, watercraft, buoy or obstruction, then the actual cost thereof shall be borne by and paid for by the master or owner of such vessel, watercraft, buoy or obstruction.

F. It shall be unlawful to fail to remove or refuse to remove any vessel, watercraft, buoy or obstruction after being requested to do so by any authorized marine patrol officer or agent of the town. (Ord. 535 § 1, 2004; Ord. 507 § 1, 2001)
