13.15.010 Water users located outside of town corporate limits – Applicable water rates.

Each water user residing outside the corporate limits of the town using water furnished through the mains of the town or using water supplied by the town shall pay one and one-half times the rates charged like consumers residing within the corporate limits. [Ord. 412 § 1, 1976. 1996 Code § 16-30.]

13.15.020 Water users located outside of town corporate limits – Applicability of provision relative to water usages of chapter.

All users of water from the town residing outside the corporate limits shall be deemed to have subscribed and agreed to all provisions of this chapter applicable to water usage. [Ord. 412 § 3, 1976. 1996 Code § 16-31.]

13.15.030 Permit for connection to town system – Required.

No person shall tap or connect to any part of the water system of the town or use any water therefrom without first obtaining a permit to do so from the town. [Ord. 415 § 1, 1976. 1996 Code § 16-32.]

13.15.040 Permit for connection to town system – Application.

Any person desiring to make a connection to the water system or to use water therefrom shall make written application to the town for a permit. The application for a permit to make any connection to the water system shall state the name of the person to whom the permit is to be issued, the size of the tap, the location thereof, the premises upon which the water is to be used and the purpose for which the water is to be used. All permits issued shall state the name of the person to whom the permit is issued, the date of the permit, the size of the tap, the premises upon which the water is to be used and the purpose for which the water is to be used. 13.15.050 Water meter installation fees.

(a) There shall be assessed and collected a water meter installation fee in the amount of $1,000 for each one-inch water meter connected to the main water distribution line of the town of Wheatland. In the event the actual costs of the materials exceeds $1,000, then the actual costs of the materials will be assessed and collected.

(b) All new water meters shall be one inch. In the event someone desires to change their existing three-quarter-inch water meter to a one inch water meter, there shall be assessed and collected a water meter upgrade fee equal to the actual cost of the materials and labor for the upgrade.

(c) For any water meter installation of a meter larger than one inch, there shall be assessed and collected a fee equal to the actual cost of the materials and labor for any water meter larger than one inch connected to the main water distribution line of the town. 13.15.060 Payment of fees.

All charges relative to connection to the town water system shall be paid to the town when the application for the connection permit is made.

All charges shall be paid prior to the actual connection of the water line and the installation of the meter to the main water distribution system of the town. [Ord. 415 §§ 7, 8, 1976. 1996 Code § 16-35.]

13.15.070 Responsibility for connection to town system.

All connections to the main water system of the town and all meter installations shall be made by a person duly employed by the town or under a town employee’s supervision. [Ord. 415 § 6, 1976. 1996 Code § 16-36.]

13.15.080 Water rates and fees.

(a) Definitions. The following words and phrases shall have the meaning respectively ascribed to them by this section:

(1) “Residential” means water services for all properties that are used exclusively for living purposes and their outbuildings, with exception to outbuildings or homes which are master metered or are being used for business purposes.

(2) “Commercial” means water services for nonresidential property and master metered properties in which the property is used for providing a business or service. This shall include a water service provided to a residential property that provides business or services.

(3) “Large commercial” means water services for nonresidential property or master metered property in which the property is used for providing a business or service and which requires an electrical service greater than 200 amps.

(4) “Bulk water” shall mean water which is obtained from the town’s water system and is transported from one location to another.

In the event a dispute arises about the type of customer, the town council shall determine, by a majority vote, whether a place is residential, commercial, or large commercial after receiving information from all interested parties.

(b) Each water user shall pay to the town the following monthly rates and fees effective October 1, 2023:

(1) Residential Water Rates and Fees.

(2) Commercial Water Rates and Fees.

(4) Privately Owned and Operated Public Recreational Vehicle (RV) Water Supply and Sewage Dump Site Rates.

Fee shall be applied if spaces are rented or vacant.

RV sewage dump sites shall meet the following criteria:

a. Only used by individuals having rented an RV space at the storage facility. Sewage vacuum trucks, portable toilet vacuum trucks, or any similar commercial or agricultural waste shall be strictly prohibited. Industrial waste, chemically treated waste, or waste containing sediment shall be strictly prohibited. The owner shall supply sufficient security to ensure unauthorized dumping shall not occur.

b. An accessible screen shall be installed to collect and eliminate any solid larger than two inches from entering the town sewage system.

c. Flushing water shall be provided at the sewage dump site.

d. The town reserves the right to access, monitor, and inspect the sewage dump site to ensure that no violation or unauthorized usage of the sewage dump site occurs.

e. If additional spaces are added, or removed, it is the responsibility of the owner/operator to inform the town of Wheatland within 10 days of the change.

f. Violations shall result in fines not to exceed $750.00 or complete and total termination of the sewage dump site at the facility.

(5) Consumers having a separate meter for sprinkler systems (lawn and garden) shall be charged at residential rates for water used.

(6) Water services outside town limits shall pay one and one-half times the household or commercial rates for water users residing within the town limits as stated in WMC 13.15.010.

(7) Requests for water meters to be turned off (or on) during regular business hours shall be charged a $25.00 fee per call (off and then back on is considered one call).

(8) Seasonal sprinkler or household (snowbird) meters which are turned on for the season shall be charged a $25.00 fee per call (on and then back off is one call).

(9) Bulk water purchases shall be charged $25.00 per 1,000 gallons plus a $150.00 service fee.

(10) Any unauthorized use of a water hydrant will be subject to a $750.00 fine. [Ord. 844, 2023; Ord. 841, 2023; Ord. 763, 2011.]
