13.60.010 Imposed.

There is levied and imposed upon any occupied premises within the city of Dinuba and boundaries, having any sewer connection with the sewerage system of the city, or otherwise discharging wastewater which ultimately passes through the city’s sewerage system or to which a public sewer is available according to Section 13.16.010 of this division, and upon the owner or occupant thereof, a monthly service or standby charge as hereinafter provided. 13.60.015 Low-income senior rate discount.

There is established a sewer rate discount for senior citizens and residents of the city. This discount will apply to qualified low-income seniors ages sixty-five or older meeting low-income guidelines established in the Tulare County Regional Housing Needs Assessment Plan and as that plan is subsequently amended. The discount will be five percent of the city’s current sewer charges. This section shall remain in effect, unless, by ordinance, the city council repeals or amends this section. 13.60.020 Unclassified uses.

For premises having a sewer connection, but for which a specific classification for sewer service charges has not been set forth in Chapter 13.56, the city shall charge such rate as in its sole discretion it deems most applicable for the type of use being made of the premises in relation to the uses made of classified premises and the rate fixed for said classified premises. 13.60.030 Rate computation information—Furnished to city.

Whenever required, sewer service charge rate computation information shall be furnished to the city, on forms furnished by the city, upon written request therefor. (Ord. 648 § 1 (part), 1982)

13.60.040 Failure to furnish rate computation information—City computation shall apply.

In the event of failure to furnish rate computation information when requested and within the time allowed, the city may compute the rate based on such information as it finds reasonably available and such computation shall be conclusive and final. (Ord. 648 § 1 (part), 1982)

13.60.050 Truck disposal rates.

Truck disposal of sanitary wastes may be accepted by the city at the treatment plant during normal daytime working hours, or at such other times as the director may elect, for a service charge per gallon, load or portion thereof. The rate to be established by the city council. (Ord. 648 § 1 (part), 1982)

13.60.060 Collection.

The city may elect to have such sewer service charges collected by any manner authorized in the applicable sections of the city municipal code, in which event such charges shall be delinquent on the date indicated in the bills rendered therefor, after which date a delinquent penalty shall be charged as established by the city council. 13.60.070 Collection by suit.

As an alternative to any other procedures provided for in this chapter, the city may collect any delinquent sewer service charges and penalties thereon by suit, in which event judgment therefor shall include the cost of suit and reasonable attorney’s fees arising from such action.
