17.45.010 Purpose.

The purpose of this district is to implement the objectives of the Kerman general plan with respect to properties deemed appropriate for mixed use development.  The district is intended to allow for a combination of residential, office and commercial uses.  The district discourages uses of a service or industrial nature or those generating high volumes of vehicle traffic.  All uses in the M-U zone shall be processed as a conditional use and shall be required to obtain a conditional use permit prior to establishment of the use.  All project proponents shall also submit a master plan of development as required in Section 17.45.080, Master plan.  (Ord. 96-05 §1(part), 1996).

17.45.020 Conditional uses.

Any use listed as a permitted or conditionally permitted use within the CN, CG, PA or R-3 zones shall be permitted subject to approval of a conditional use permit.  In addition, senior citizen housing projects not exceeding forty units may be permitted subject to a conditional use permit.  (Ord. 97-04 §3, 1997:  Ord. 96-05 §1(part), 1996).

17.45.030 Development standards.

The following development standards together with applicable standards specified in Chapter 17.78 shall apply to all land and structures within this district.

A. Minimum Lot Size.  The minimum lot size in the M-U district shall be three acres.

B. Height Limitation.  The maximum height of any structure shall be thirty-five feet.

C. Yards.

1. Front Yard.  There shall be a ten foot landscaped setback where parcels abut on a street right-of-way, except that parcels fronting Whitesbridge Road shall have a front yard setback that is sixty feet from the centerline of Whitesbridge.  To the maximum extent possible, this area shall be landscaped.

2. Side Yard.  None.

3. Rear Yard.  There shall be no rear yard setback unless the parcel abuts a residential district in which case the setback distance shall be ten feet.  Developments within the M-U district that abut residential uses also within the M-U district shall not be subject to this requirement.  (Ord. 99-04 §2, 1999; Ord. 96-05 §1(part), 1996).

17.45.040 Signs.

Signs shall be consistent with the requirements of Chapter 17.76.  (Ord. 96-05 §1(part), 1996).

17.45.050 Fences, walls and hedges.

Fences, walls and hedges shall be consistent with the requirements of Section 17.40.070.  A solid masonry wall not less than seven feet in height shall be constructed along the property line which separates this district from a residential district.  Developments within the M-U district that abut residential uses also located within the M-U district shall not be subject to this requirement.  The requirement for a masonry wall may also be waived when an alley separates this district from a residential district.  (Ord. 96-05 §1(part), 1996).

17.45.060 Parking.

Off-street parking and loading standards shall be consistent with the requirements of Chapter 17.74.  Parking lots in the M-U district shall not be located between any structure and the front property line but shall be located along the side or rear of the parcel.  Parking lots shall not be permitted to occupy more than one-half of the front area of a parcel nor abut more than one-half of the front property line.  (Ord. 96-05 §1(part), 1996).

17.45.070 Accessory structures.

Construction of accessory structures within this district shall be consistent with the standards established in Chapter 17.62.  (Ord. 96-05 §1(part), 1996).

17.45.080 Master plan.

A master plan of development shall be submitted for review in conjunction with a conditional use permit for all projects proposed in the M-U district.  The master plan shall be prepared to show that the proposed project conforms with the objectives of the mixed use designation under the Kerman general plan.  The master plan shall be prepared to allow detailed review of the following items:

A. Buildings and structures, including architectural design, colors and materials.  Architectural renderings and exterior elevations shall be submitted;

B. Yards and spaces between buildings, including proposed surface materials;

C. Proposed landscaping, including location and plant types;

D. Proposed signs, including location, size, height and type of illumination;

E. Proposed lighting, including location and fixture type;

F. Walls and fences, including location, height, proposed materials and colors;

G. Off-street parking, including the location, number of spaces and dimensions of parking, landscaping features and internal circulation patterns.  (Ord. 96-05 §1(part), 1996).
