10.52.010 ESTABLISHMENT OF PARKING METER ZONE.

The parking of vehicles upon the streets, portions of streets and off-street parking lots in this city, as hereinafter designated, within the parking meter zone as hereinafter described shall be controlled, regulated and inspected with the aid of parking meters, and shall be governed by the provisions of this chapter. This parking meter zone is hereby established and described as follows:

All that area bounded on the east by the centerline of the San Lorenzo River from its terminus northerly to State Highway One between said river and the intersection of Chestnut Street with State Highway One; on the west by the westerly boundary of Chestnut Street from its intersection with State Highway One to the southerly end of Chestnut Street, south of Laurel Street; thence along an imaginary line extended from said Chestnut Street to the southwesterly corner of the intersection of Bay Street and West Cliff Drive thence easterly to the southern terminus of the Santa Cruz Municipal Wharf thence easterly from said Wharf terminus to the point of beginning at the terminus of the San Lorenzo River.

The zone shall also include:

The area bounded on the north by Water Street, on the east by Ocean Street, on the south by Soquel Avenue, and on the west by the San Lorenzo River.

Seabright Avenue, between Hall Street and Murray Street.

The city traffic engineer shall cause parking meters to be installed and maintained within the parking meter zone and provide the rate of fees thereon as authorized by the city council and this chapter.

10.52.020 MANNER OF INSTALLATION.

Parking meters shall be installed upon the curb or sidewalk area immediately adjacent to each parking space. Each meter shall be placed in such a manner as to show or display by a sign or signal that the parking space adjacent thereto is or is not legally in use. Each parking meter shall be set to display, after the operational procedure has been completed, a sign or signal indicating legal parking for that period of time conforming to the limit of parking time for the parking meter rate, and shall continue to operate from the time of the completion of the operational procedure until the expiration of the time fixed as the parking limit or a portion thereof for the part of the street upon which said meter is placed. Each said meter shall also be so arranged that upon the expiration of said legal parking time, it will indicate by a mechanical operation and by the proper signal that the lawful parking period has expired.

10.52.030 TIME OF OPERATION OF PARKING METERS.

The provisions of this chapter relating to the operation of parking meters shall be effective during the following days and hours:

•    On-street meters, excluding Downtown (Parking District No. 1) area and Beach area: Monday through Sunday, excepting holidays, from 8:00 a.m. to 8:00 p.m.

•    Downtown (Parking District No. 1) area: Monday through Sunday, excepting holidays, from 8:00 a.m. to 8:00 p.m.

•    Beach area: Monday through Sunday, including holidays, from 8:00 a.m. to 8:00 p.m.

10.52.040 OPERATIONAL PROCEDURE TO BE FOLLOWED.

Immediately after occupancy of a parking meter space, the operator of a vehicle shall deposit a coin of the United States in said parking meter and, if necessary, turn a crank, knob, or handle in accordance with the instruction posted on the face of the parking meter to activate the parking meter and indicate the parking time limit achieved by the coin deposited therein.

10.52.050 UNLAWFUL TO PARK AFTER METER TIME HAS EXPIRED.

No operator of any vehicle shall permit said vehicle to remain parked in any parking space during any time that the meter is showing a signal indicating that such space is illegally in use other than such time immediately after the original occupancy as is necessary to operate the meter to show legal parking.

10.52.060 LEAVING VEHICLE PARKED AFTER RECEIPT OF PARKING METER VIOLATION CITATION.

No operator of any vehicle shall permit said vehicle to remain parked in a metered parking space after receipt of a violation citation for exceeding the parking time limit. Violation of this section will occur only after the passage of the succeeding time limit of the metered parking space as recorded by the preceding violation citation.

10.52.070 UNLAWFUL TO EXTEND TIME BEYOND LIMIT.

No person shall follow the operational procedure established by this chapter for the purpose of increasing or extending the parking time of any vehicle beyond the maximum legal parking time established for the particular parking meter. Each successive maximum period of time, or portion thereof, during which the maximum legal parking time has been extended in excess of the initial period, shall constitute a separate offense.

10.52.080 Repealed by Ord. 95-26 § 1.

10.52.090 PARKING METERS AND PARKING STANDARDS NOT TO BE USED FOR CERTAIN PURPOSES.

No person shall attach anything to or allow a bicycle, newsrack or any other article or thing to lean against a parking meter or a parking meter standard.

10.52.100 IMPROPER USE OF METER.

No person shall deposit or cause to be deposited in any parking meter any defaced or bent coin, or any slug, device or metallic substitute for a coin of the United States, or deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter.

10.52.110 PARKING SPACE INDICATED.

The city shall have lines or markings painted or placed upon the curb or street adjacent to each parking meter, designating the parking space for which said meter is to be used, and each vehicle parked adjacent to or next to any parking meter shall park within the lines or markings so established. No person shall park any vehicle across any such lines or markings or park a vehicle in such a position that the same shall not be entirely within the space designated by such lines or markings.

10.52.111 PAYMENT OF PRESCRIBED FEE REQUIRED.

In any parking lot or on-street parking location owned or controlled by the city, where the city council has, by resolution, established a fee for parking with either pay-by-space or pay-and-display multi-space meters, it shall be unlawful to park any vehicle without paying the prescribed fee. This section shall not apply to lots regulated by parking meters.

10.52.115 TOUR/SCHOOL BUS PARKING.

(a)    The city council may, by resolution, designate on-street parking spaces for the use of tour/school bus parking, while in the process of legitimately loading and unloading passengers in the area, and direct tour/school bus operators to these designated parking areas. Tour/school buses parked at locations designated for their use are exempt from paying parking meter fees and may disregard parking time limitations. Tour/school bus operators may not park tour/school buses in these designated parking areas between the hours of 12:00 a.m and 6:00 a.m.

(b)    “Tour bus” means a bus which is operated by or for a charter-party carrier of passengers, as defined in Section 5360 of the Public Utilities Code, or a passenger stage corporation, as defined in Section 226 of the Public Utilities Code, or any highway carrier of passengers required to register with the California Public Utilities Commission pursuant to Section 3910 of the Public Utilities Code. A school bus is any motor vehicle designed, used, or maintained for the transportation of any school pupil at or below the twelfth-grade level to or from a public or private school or to or from public or private school activities as defined in Section 82321 of the California Vehicle Code.

10.52.120 APPLICATIONS FOR PERMITS.

The city traffic engineer is authorized to approve applications for permits in lieu of the payment of parking meter fees and use of free time-limited parking spaces in public parking lots and garages and without regard to parking time limitations at the lots, garages or parking meters.

10.52.130 PERMIT ISSUANCE.

Upon approval of the application by the city traffic engineer or his/her designated representative, staff is authorized to issue annual service vehicle parking permit to be placed on the left side of the rear bumper of the vehicle for which the permit is issued. Temporary construction permits may be issued by the city traffic engineer or his/her designated representative. Construction permits may be purchased by the month or day. Permit rates will be set by resolution.

10.52.140 PERMIT ELIGIBLES.

Only repair service, maintenance, and construction vehicles are eligible to make application for annual service vehicle and construction vehicle parking permits. These are vehicles and equipment necessary and incidental to building, construction, and maintenance work and the servicing of equipment and appliances, which for reasons of convenience and necessity are exempted from use of the parking meter or the time limits of lots and garages. Permit rates will be set by resolution.

The city traffic engineer or his/her designated representative is authorized to establish employee parking meter permit parking programs with the review and approval of the downtown commission or the city transportation and public works commission. These permits shall be sold on a quarterly basis. Parking meter permit rates will be set by resolution.

10.52.150 PERMIT TIME LIMIT.

Service and construction permits issued on an annual basis shall expire on the date indicated on the permit. Service and construction monthly permits shall expire one month from date of issuance.

Parking meter permits shall be issued on a quarterly basis, starting in January, April, July and October.

10.52.160 TRANSFER AND LOSS OF PERMIT.

Permits may not be transferred from one vehicle to another; however, a transfer sticker shall be issued for the remainder of the year for the transfer fee of one dollar. Loss or destruction of the permit sticker shall be covered by issuance of a replacement sticker to the registered permit holder for the time period remaining at a fee of one dollar.

10.52.170 REVOCATION OF PERMIT.

The city traffic engineer may revoke permits for any of the following reasons:

(1)    Failure to pay renewal fee;

(2)    Failure to place permit on eligible vehicle.

10.52.180 RULE OF EVIDENCE.

The parking or standing of any motor vehicle on a parking space, at which space the parking meter displays the sign or signal indicating illegal parking, constitutes a prima facie presumption that the vehicle has been parked or allowed to stand in such space for a period longer than permitted by this chapter.

10.52.190 APPLICATION OF OTHER PROVISIONS.

No section of this chapter shall be construed as permitting any parking in violation of any other provision of this code, or of the California Vehicle Code.

10.52.200 PARKING METER RATES FOR THE CENTRAL BUSINESS DISTRICT.*

10.52.205 PERFORMANCE PRICED PARKING METER RATE – PACIFIC AVENUE FROM WATER STREET TO LAUREL STREET.

A performance priced parking rate for parking meters located within the Downtown Parking District No. 1 on both sides of Pacific Avenue from Water Street to Laurel Street is established and shall be between one dollar an hour and five dollars an hour. Within that range, the rates may be adjusted periodically based on vehicle occupancy on any block or set of blocks during the hours of parking meter operation according to the following criteria: (a) if occupancy is eighty-five percent or above, rates will be increased by twenty-five cents per hour; (b) if occupancy is sixty percent or above but below eighty-five percent, rates will not be changed; (c) if occupancy is below sixty percent, rates will be lowered by twenty-five cents per hour. Rates shall be adjusted for any particular block or set of blocks not more than once every twenty-eight days.

A variable rate is established on the following streets and portions of streets:

(1)    All the meters in the parking area within the area bounded by the prolongation of a southerly line of Beach Street, the easterly line of the Municipal Wharf and the Dream Inn Hotel, commonly known as the Annex.

(2)    Beach Street, north side, from West Cliff Drive to Raymond Street.

(3)    Cliff Street, west side, from Beach Street to First Street.

(4)    Front Street, east side, from Pacific Avenue to Second Street.
