12.10.010 General.

Proposed street improvements within the City shall conform to the pattern as established in the Major Street Plan as adopted by the City of Gardner. This states, on a general basis, that the thoroughfare classification of streets shall be constructed on section line roads at one-mile intervals and collector classification of streets shall be spaced at approximate midway locations between thoroughfares. Street improvements and public infrastructure shall be designed to conform to applicable codes, regulations, ordinances, and the “Technical Specifications for Public Improvement Projects, City of Gardner, Kansas” (Technical Specifications), as established by the City of Gardner. Plans for said improvements shall be submitted to the City Engineer for approval and shall include all information as may be required or described hereinafter.

A. The City Engineer is authorized to revise the Technical Specifications, as necessary, based on sound engineering principles. The City Engineer shall file any revisions to the Technical Specifications with the City Clerk.

B. Functional Classification of Streets. The classification of streets shall be generally defined as follows:

1. Local Streets. A “local street” shall mean a street that is primarily used to provide access to abutting residential property.

2. Collector/Service Streets. A “collector street” shall mean a street which in addition to serving abutting residential property, intercepts residential streets, carries neighborhood traffic to major arterial street system, and connects with community facilities. The number of lots fronting collector streets should be held to a minimum.

3. Arterial Thoroughfare Streets. An “arterial thoroughfare street” shall mean a street of considerable continuity which serves or is intended to serve as the principal traffic way between separated areas or districts.

C. Street Design Standards. All streets shall conform to the requirements of the Technical Specifications, latest edition. All variances must be approved by the City Engineer.

D. Maximum Gradient. The maximum gradient for streets as noted in subsection (C) of this section may be exceeded only upon written approval of the City Administrator after recommendation by the City Engineer. Such approval will only be granted in unusual cases where grades within the acceptable limits cannot be obtained.

E. Off-Center Street Intersections. Off-center street intersections shall be separated by a minimum centerline dimension of 150 feet.

F. Storm Drainage. All storm drainage works shall be designed in accordance with American Public Works Association Section 5600 Storm Drainage Systems and Facilities (APWA), which was approved by the Kansas City Metropolitan Chapter of APWA in December 2005 and formally adopted by the Executive Board on February 15, 2006.

1. The City Engineer is authorized to adopt any revisions to APWA Section 5600 approved by the Kansas City Metropolitan Chapter of APWA and its Board or may adopt additional revisions to APWA Section 5600 that are based on sound engineering principles. The City Engineer shall file any revisions so adopted with the City Clerk.

2. Stream corridor requirements are presented in Chapter 14.10 GMC.

3. The following paragraph is added to the end of APWA 5601.5 A 4:

If there are no existing flooding problems and flooding problems will not occur as a result of the proposed development as documented by a stormwater management plan approved by the City Engineer, runoff from the development shall be controlled by limiting the stormwater release rate for the ten percent (10%) and one hundred percent (100%) storm to the predevelopment peak flow rates for the ten percent (10%) and one hundred percent (100%) storms, respectively.

4. A stormwater management plan must be submitted for each development. A preliminary stormwater management plan must be provided with submittal of the preliminary plat, site plan, or the preliminary or final development plan for a planned zoning district, and a final stormwater management plan must be submitted to and approved by the City Engineer prior to issuance of building permits. The stormwater management plan shall be prepared by a licensed professional engineer in the State of Kansas and shall contain such information including, but not limited to, maps and diagrams, design data and calculations, plans and detailed drawings, and specifications prepared in accordance with APWA 5600 and applicable local, state, and federal regulations.

G. Cul-de-Sacs. At locations where streets are to be terminated and a vehicular connection between adjacent streets is not required, a cul-de-sac may be permitted. Such a cul-de-sac shall be constructed with a minimum radius of 39 feet to the back of the curb and shall not exceed 800 feet in length.

H. Temporary Turnarounds. At locations where streets are to be temporarily terminated which will be extended at a later date, and said street extends beyond the intersection of an adjacent street more than three lots, a temporary cul-de-sac shall be constructed with a minimum radius of 35 feet. The temporary cul-de-sac shall be constructed of asphaltic concrete with a minimum depth of six inches. Curb and gutter will not be required. 12.10.020 Minimum street standards.

Streets constructed in the City of Gardner, Kansas, shall conform with the minimum requirements set forth in the Technical Specifications which are made a part hereof.

The minimum standards set forth below are minimum design criteria. The City may deem it necessary to increase the minimum design thickness of asphalt and base material due to extreme traffic generation or particularly poor subsoil conditions.

A. Construction Drawings and Details. Construction drawings for all street construction shall be submitted to and approved by the City Engineer prior to construction work on any street. Drawings shall be prepared by a registered professional engineer and shall clearly show horizontal and vertical street alignment, sight distance, vertical curvature, storm drainage facilities, street pavement details, and other pertinent information as may be required by the City Engineer in completing his review of the proposed improvements.

B. Residential Driveways.

1. Residential driveways connecting to residential streets shall be installed at locations approved by the City Engineer and shall be constructed of portland cement concrete within the street right-of-way. Driveway construction shall comply with the Technical Specifications.

2. Residential driveways will be held to a minimum on collector/service streets. Residential driveways will not be allowed on thoroughfare streets.

C. Private Entrances.

1. Private entrances connecting to local and collector/service streets shall be installed at locations approved by the City Engineer.

2. Private entrances connecting to thoroughfare streets will be discouraged and shall be installed only at locations approved by the City Governing Body.

D. Private Streets. Proposed private streets shall conform to the same applicable standards and specifications as set forth in the Technical Specifications for public streets. The developer shall be responsible for all costs associated with City review of construction plans and inspection services necessary to ensure compliance. Private streets shall be designated as a separate tract or tracts under common ownership on the plat and inspected by the City. In addition, public access easements shall be dedicated to assure access to all adjacent property owners.

E. Parking Lot Construction.

1. General. Proposed parking lot construction in the City of Gardner shall in all respects be designed to conform to applicable codes, regulations, and ordinances as established by the City of Gardner. Any person, firm, or corporation proposing to construct any parking lot improvement within the City shall apply to the City for approval of the location, dimensions, design, construction methods, and materials of such parking lot construction. Plans shall be forwarded to the City Engineer for approval and shall include all information as may be required or described hereinafter.

2. City Engineer’s Approval. The City Engineer shall approve all parking lot design.

F. Parking Lot Construction Plan Preparation.

1. Introduction. The following criteria are being established to provide a uniform system of plan preparation for work within the City of Gardner relating to parking lot construction.

2. General. All plans for parking lot construction are to be prepared by a professional engineer licensed in the State of Kansas and submitted to the office of the City Engineer for review. Subsequent to the review, the engineer will be notified of the approval of the plans as submitted, or of any necessary changes. (Ord. 2234 § 1; Ord. 1635 § 1. Code 1990 § 13-102)

12.10.030 Funds deposited with City Clerk.

Prior to City issuance of a permit for construction of street improvements, the developer shall deposit with the City Clerk a performance bond in an amount to be set by the City Governing Body as a guarantee on the part of the developer that the said street improvements will be completed within a period not to exceed one year in complete conformance with all provisions and requirements. The bond shall be in the amount of 100 percent of the construction cost and guarantee the work for a period of two years from the date of issuance of the project completion certificate. 12.10.040 Plans and specifications – Cost of inspection.

Any person, firm, partnership or corporation desiring to construct permanent streets within the City of Gardner shall first submit plans and specifications to the City and obtain approval of the Governing Body. Following the review of said plans and specifications, the City shall determine the amount of funds to be deposited with the City Clerk (GMC 12.10.030). These funds along with the required performance bond (or cashier’s check) shall be deposited with the City Clerk prior to issuance of a construction permit for said improvements. 12.10.050 Minimum requirements met.

No street constructed or improved in the City of Gardner shall be considered a permanent street unless the minimum requirements set forth in GMC 12.10.010 through 12.10.040 are met. (Ord. 1635 § 1. Code 1990 § 13-105)
