15.02.030 Definitions.

The following definitions shall apply in the interpretation and enforcement of this chapter and the codes adopted herein:

“Appointing authority” means the mayor of the city or his duly authorized representative.

Board of Appeals. The city board of adjustment shall act as the city’s board of appeals.

“Building” means any building or structure now existing or hereafter erected within the city.

“Chief,” “chief of the fire department” or “chief of the bureau of fire prevention” means the fire chief of Fire Protection District No. 6 or his duly authorized representative.

“Chief of police” or “police department” means the Castle Rock police chief or his authorized representative.

“Department,” “fire department,” or “bureau of fire prevention” means Fire Protection District No. 6.

“Executive body” means the city council.

“Jurisdiction” means the city of Castle Rock.

“Person” means any individual, firm, partnership, association or corporation, not including any officer, agent or employee of a political subdivision of the state when acting in an official capacity. [Ord. 2004-04 § 1, 2004].

15.02.040 Building codes adopted.

A. International Building Code – International Residential Code. There is adopted and by this reference made a part of this chapter as though fully set forth herein, at length, that certain code, known as the International Building Code, 2003 Edition, or latest edition, as amended by Chapter 51-50 WAC, including the Appendices “H – Signs” and “J – Grading” as amended herein, and the International Residential Code, 2003 Edition, or latest edition, as amended by Chapter 51-51 WAC, including Appendix G, as the building code of the city of Castle Rock; provided, that those sections of the International Building Code and Residential Code set forth in CRMC 15.02.050 are amended to read as set forth in said section.

B. International Plumbing Code, 2003 Edition, or latest edition, as amended by Chapter 51-56 WAC, published by the International Association of Plumbing and Mechanical Officials, as amended by Chapter 51-46 WAC, including Appendix A as amended; provided, that any provisions of such code affecting fuel gas piping are not adopted, is adopted as the plumbing code for the city.

C. International Fire Code. There is adopted, except as amended in this chapter, that certain code known as the International Fire Code, 2003 Edition, or latest edition, as amended by Chapter 51-54 WAC, including those standards of the National Fire Protection Association specifically referenced in the International Fire Code; provided, that notwithstanding any wording in this code, participants in religious ceremonies shall not be precluded from carrying handheld candles. Section 503, Fire Apparatus Access Roads, is also adopted. Appendices B and C are adopted.

D. International Mechanical Code and International Fuel Gas Code. There is adopted and by this reference made a part of this chapter as though fully set forth herein, at length, that certain code, known as the International Mechanical Code and International Fuel Gas Code, or latest edition, as amended by Chapter 51-52 WAC, published by the International Code Council, and the International Fuel Gas Code, 2003 Edition, or latest edition, except that the standards for liquefied petroleum gas installations shall be NFPA 58 (Storage and Handling of Liquefied Petroleum Gases) and ANSI Z223.1/NFPA 54 (National Fuel Gas Code), as the mechanical code of the city; provided, that those sections of the International Mechanical Code set forth in CRMC 15.02.080 are amended or deleted as set forth in said section.

E. International Property Maintenance Code. There is adopted and by reference made a part of this chapter as though fully set forth herein, at length, that certain code known as the International Property Maintenance Code or latest edition published by the International Code Council; provided, that those sections set forth in CRMC 15.02.081 are amended to read as set forth in said section.

F. Abatement of Dangerous Buildings. The 1997 Edition of the Uniform Code for the Abatement of Dangerous Buildings as published by the International Conference of Building Officials is adopted and by reference made a part of this chapter, except that references to the uniform codes shall be replaced with the appropriate technical codes and section as adopted by the city. 15.02.050 Amendments to the International Building and Residential Codes.

The International Building and Residential Codes are amended as follows:

Section 101.1 These regulations shall be known as the Building Code of the City of Castle Rock, Washington, hereinafter referred to as “this code.”

Section 101.4.1. Electrical. The provisions of the National Electrical Code (NFPA), latest edition as amended and adopted in Washington State shall apply to the installation of electrical systems, including alterations, repairs, replacement, equipment, appliances, fixtures, fittings and appurtenances thereto.

Section 101.4.4. Plumbing. The provisions of the International Plumbing Code, latest edition as amended and adopted by Washington State shall apply to the installation, alteration, repair and replacement of plumbing systems, including equipment, appliances fixtures, fittings and appurtenances, and where connected to a water or sewage system and all aspects of a medical gas system.

Section 101.4.7. Energy. The provisions of the State of Washington Energy Code as amended and adopted, latest edition and the State of Washington Ventilation and Indoor Air Quality Code shall apply to all matters governing the design and construction of buildings for energy efficiency.

Section 105.2 Permits. Work exempt from permit, Number 6, amended as follows: Add the word “Platforms” to the beginning of the sentence. Number 9, strike “which are less than 24" (61 mm) deep.”

Section 108.3 Building permit valuations. Add new sentence to the end of the paragraph as follows:

The value for commonly built structures shall be determined by using the valuation table adopted by the Building Official by policy.

Appendix J Amendments. Appendix J, Grading, is as follows:

J102.1 Definitions. Add the following:

CIVIL ENGINEER. A professional engineer registered in the state to practice in the field of civil works.

CIVIL ENGINEERING. The application of the knowledge of the forces of nature, principles of mechanics and the properties of materials to the evaluation, design and construction of civil works.

EARTH MATERIAL. Any rock, natural soil or fill or any combination thereof.

ENGINEERING GEOLOGIST. A geologist experienced and knowledgeable in engineering geology.

ENGINEERING GEOLOGY. The application of geologic knowledge and principles in the investigation and evaluation of naturally occurring rock and soil for use in the design of civil works.

GEOTECHNICAL ENGINEER. See “soils engineer.”

PROFESSIONAL INSPECTION. The inspection required by this code to be performed by the civil engineer, soils engineer or engineering geologist. Such inspections include that performed by persons supervised by such engineers or geologists and shall be sufficient to form an opinion relating to the conduct of the work.

SOILS ENGINEER (GEOTECHNICAL ENGINEER). An engineer experienced and knowledgeable in the practice of soils engineering (geotechnical engineering).

SOILS ENGINEERING (GEOTECHNICAL ENGINEERING). The application of the principles of soils mechanics in the investigation, evaluation and design of civil works involving the use of earth materials and the inspection or testing of the construction thereof.

Section J103.2 Exemptions.

The Exemption section is amended with the addition of numbers 8 and 9 to read as follows:

8. An excavation that (1) is less than 2-feet (610 mm) in depth or (2) does not create a cut slope greater than 5-feet (1,524 mm) in height and steeper than 1 unit vertical in 1 1/2 units horizontal (66.7% slope).

9. A fill less than 1-foot (305 mm) in depth and placed on natural terrain with a slope flatter than 1 unit vertical in 5 units horizontal (20% slope), or less than 3-feet (914 mm) in depth, not intended to support structures, that does not exceed 50 cubic yards (38.3 m3) on any one lot and does not obstruct a drainage course.

Section J104.1: Strike period and add “on the application excavation and grading addendum and provide other information as requested.”

Section J104.3: Change section number to J104.5 and Section J104.4 change to section number J104.7. Add new Sections J104.3, J104.4 and J104.6 as follows:

J104.3 Grading designation. Grading in excess of 5,000 cubic yards (3,825 m3) shall be performed in accordance with the approved grading plan prepared by a civil engineer, and shall be designated as “engineered grading.” Grading involving less than 5,000 cubic yards (3,825 m3) shall be designated “regular grading” unless the permittee chooses to have the grading performed as engineered grading, or the building official determines that special conditions or unusual hazards exist, in which case grading shall conform to the requirements for engineered grading.

J104.4 Engineered grading requirements. Application for a grading permit shall be accompanied by two sets of plans and specifications, and supporting data consisting of a soils engineering report and engineering geology report. The plans and specifications shall be prepared and signed by an individual licensed by the state to prepare such plans or specifications when required by the building official.

Specifications shall contain information covering construction and material requirements.

Plans shall be drawn to scale upon substantial paper or cloth and shall be of sufficient clarity to indicate the nature and extent of the work proposed and show in detail that they will conform to the provisions of this code and all relevant laws, ordinances, rules and regulations. The first sheet of each set of plans shall give location of the work, the name and address of the owner, and the person by whom they were prepared.

The plans shall include the following information:

1. General vicinity of the proposed site.

2. Property limits and accurate contours of existing ground and details of terrain and area drainage.

3. Limiting dimensions, elevations or finish contours to be achieved by the grading, and proposed drainage channels and related construction.

4. Detailed plans of all surface and subsurface drainage devices, walls, cribbing, dams and other protective devices to be constructed with, or as a part of, the proposed work, together with a map showing the drainage area and the estimated runoff of the area served by any drains.

5. Location of any buildings or structures on the property where the work is to be performed and the location of any buildings or structures on land of adjacent owners that are within 15-feet (4,572 mm) of property or that may be affected by the proposed grading operations.

6. Recommendations included in the soils engineering report and the engineering geology report shall be incorporated in the grading plans or specifications. When approved by the building official, specific recommendations contained in the soils engineering report and the engineering geology report, which are applicable to grading, may be included by reference.

7. The dates of the soils engineering and engineering geology reports together with the names, addresses and phone numbers of the firms or individuals who prepare the reports.

J104.6 Engineering geology report. The engineering geology report required by J104.4 shall include an adequate description of the geology of the site, conclusions and recommendations regarding the effect of geologic conditions on the proposed development, and opinion on the adequacy for the intended use of sites to be developed by the proposed grading, as affected by geologic factors.

Add new Section J112, Grading Fees, as follows:

Section J112 Grading Fees.

J112.1 General. Fees for plan reviews and permits shall be assessed in accordance with the provisions of this section or shall be as set forth in the fee schedule adopted by the jurisdiction.

J112.2 Plan review fees. When a plan or other data are required to be submitted, a plan review fee shall be paid at the time of submitting plans and specifications for review. Separate plan review fees shall apply to retaining walls or major drainage structures as required elsewhere in this code. For excavation and fill on the same site, the fee shall be based on the volume of excavation or fill, whichever is greater.

Add new Section J113, Bonds, as follows:

Section J113 Bonds.

The building official may require bonds in such form and amounts as may be deemed necessary to ensure that the work, if not completed in accordance with the approved plans and specifications, will be corrected to eliminate hazardous conditions.

In lieu of a surety bond the applicant may file a cash bond or instrument of credit with the building official in an amount equal to that which would be required in the surety bond.

The following sections of the International Residential Code are amended as follows:

Section 105.2 Permits. Work exempt from permit shall be changed from 120 square feet to 200 square feet, in accordance with the International Building and Residential Codes as published and adopted by the state of Washington, or hereafter amended.

Add Number 12 as follows:

Re-roofing of one and two family dwellings or buildings accessory to these dwellings may be exempt for up to a maximum of a second overlay per Section R907.3.

15.02.060 Amendments to the International Plumbing Code.

The following sections of the International Plumbing Code are as follows:

The International Plumbing Code is amended as follows:

Section 102.3.2 Penalties. Strike the word “misdemeanor” and replace with the words “civil infraction” and strike the word “imprisonment” and replace with the word “as” in the first sentence.

Section 103.4.1 Permit Fees. Add the words “by resolution” to the end of the sentence after the word “jurisdiction.”

Section 103.4.2 Plan Review Fees. Strike the second paragraph and replace with the following:

The plan review fees when appropriate and applicable for plumbing work requiring plans or other data shall be set by resolution.

15.02.070 Amendments to the International Fire Code.

The following sections of the International Fire Code are as follows: Title, replace the word “Uniform” with the word “International.”

Section 101.1 Title: Insert “City of Castle Rock” for name of jurisdiction.

Sections 102.3, 102.4, and 102.5: Strike the word “existing.”

Add Section 105.8 Permit Fees:

Permit and Plan Review Fees shall be adopted by the local jurisdiction by resolution.

Section 102.3 is not adopted.

Section 109.3 Violation Penalties. This section shall be as follows: Strike the first sentence and replace with:

Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof shall be subject to penalties as prescribed by law.

Section 102.4: Strike the word “existing,” third to the last word.

Section 3404.2.9.5.1 Locations where aboveground tanks are prohibited. The limits referred to in Section 3404.2.9.5.1 of the International Fire Code in which storage of Class I and Class II liquids outside in aboveground storage tanks is prohibited are established as R-1, R-2, and C-1 zones.

Section 3804.2 Maximum capacity within established limits. The limits referred to in Section 3804.2 of the International Fire Code in which liquefied petroleum gas is restricted are established as C-2, I (R-1, R-2, C-1, not allowed). [Ord. 2004-04 § 3, 2004].

15.02.080 Amendments to the International Mechanical Code.

The following sections of the International Mechanical Code are as follows: Title, strike the word “Uniform” and replace with the word “International.”

Section 101.1 Title: Insert “The City of Castle Rock” for name of jurisdiction.

Section 106.5.2 Fee schedule. Add sentence as follows:

The permit and plan review fees are to be determined and adopted by this Jurisdiction by resolution.

Section 108.4 Violation Penalties. This section shall be as follows: Strike the first sentence and replace with:

Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof shall be subject to penalties as prescribed by law.

15.02.081 Amendments to the International Property Maintenance Code.

The following sections of the International Property Maintenance Code are as follows:

Add title, “Amendments to the International Property Maintenance Code.”

Section 101.1 Title: Insert “City of Castle Rock” for name of jurisdiction.

Section 101.2 Exceptions. Exception No. 2 is deleted and replaced with the following:

Note: Mechanical system in all other occupancies in existing building undergoing repair, alterations, or additions, and change of occupancies shall comply with this code.

Sections 101.3 Intent: Strike the word “existing” from the third to the last word in the last sentence.

Section 102.3 Application of Other Codes. Strike the word “existing” from the third to the last word of the first sentence. Strike the last sentence.

Section 103.5 Fees. Add to the end of sentence: “as set by resolution by local jurisdiction.” [Ord. 2004-04 § 3, 2004].
