15.08.010 Delimited.

The fire district limits of the city shall be the district lying within the boundaries described as follows: commencing at the intersection of Second Street and Cowlitz Avenue; thence westerly to the center of Cowlitz Avenue and Leaming Streets; thence northerly to the northern line of tract 36; thence east to the alley in tract 28 of Shintaffer Addition to Shintaffer Avenue; thence east to center of Front Street; thence in an easterly direction along the north lines of lots 6-7 and 8, block 4 of Beeks Civic Center Addition, to a point in the center of Pacific Highway; thence south along the center of Pacific Highway to a point centered at intersection of Pacific Highway between blocks 5 and 2 of Beeks Civic Center Addition; thence easterly 150 feet; thence north 40 feet; thence east to a point north of the west line of tract 138A; thence south to a point centered in Cowlitz Avenue; thence west 120 feet to a point north of the east line of tract 1 of Highway Addition; thence south to the southeast corner of tract 6 of Highway Addition; thence west to the center of Pacific Highway; thence south to center of intersection of B Street and Pacific Highway; thence west to center of intersection of Front Street and A Street; thence south to center of intersection of First Street and B Street; thence west to center of intersection of B Street and Second Street; thence north to point of beginning. 15.08.020 Building code compliance required.

All buildings and structures proposed within the fire district limit defined in CRMC 15.08.010 shall be developed in compliance with the Uniform Building Code of 1970 adopted by the city. [Ord. 397 § 2, 1973].

15.08.030 Driving over fire hose prohibited – Obstructing hydrant prohibited.

In case of fire it is unlawful for any person to drive any vehicle over any of the fire hoses. No automobile shall park or halt nearer than 15 feet to any fire hydrant. No material of any kind shall be piled within 15 feet of any fire hydrant. [Ord. 397 § 3, 1973].

15.08.040 Firemen’s police powers designated.

In case of fire the fire equipment shall have and is given the right-of-way over all traffic. The fire chief and his assistants are accorded paramount police power at all fires, and it is unlawful for any person to interfere with the firemen in the discharge of their duty or to tamper with the fire hose or apparatus. [Ord. 397 § 4, 1973].

15.08.050 Allowing moss to grow on roof prohibited.

It is unlawful for the owner of any building in the city to allow moss to grow or collect on the roof of such building in such manner as to become a fire hazard, and on notice he shall remove or cause to be removed the moss within 48 hours. [Ord. 397 § 5, 1973].

15.08.060 Violation – Penalty.

Every person found guilty of a violation of any of the provisions of this chapter shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined not less than $10.00 and not more than $100.00, together with the costs of prosecution. [Ord. 397 § 6, 1973].

15.08.070 Enforcement duty.

It is made the duty of the city police department to strictly enforce all the provisions of this chapter. [Ord. 397 § 7, 1973].

15.08.080 Permit required.

Every person shall obtain from the fire chief and/or other persons designated from time to time by the city a permit authorizing burning within the city limits of the city. [Ord. 93-3 § 1, 1993].

15.08.090 Burning of natural vegetation.

Burning of natural vegetation only is permitted within Castle Rock after obtaining the permit and the burning to be conducted with complete compliance with the following:

A. Clearance from structures, property lines and combustible materials:

1. Not less than 25 feet for pile sizes of four feet by four feet or less;

2. Not less than 50 feet for pile sizes greater than four by four feet but less than 10 feet by 10 feet.

B. A person capable of extinguishing the fire shall attend the fire at all times and must extinguish the fire before leaving the fire site.

C. A shovel and a minimum of five gallons of water or a charged hose or such other fire control device as may be approved and authorized on the permit by the fire authority or such other person or entity as may be designated by the city must be at the burning site and ready to use.

D. Only one fire may be authorized by each permit issued and no more than one fire may be ignited and it must be extinguished before another fire may be ignited as otherwise permitted by this chapter.

E. Burning may only be conducted during daylight hours.

F. No fire is permitted in or within 500 feet of forest/material without the appropriate permit being issued by the appropriate governmental authority.

G. If in the course of a burn a fire creates a nuisance, it shall be extinguished.

H. If an application is made for burning on land belonging to others, permission from the owner or owner’s designated representative shall be obtained before seeking a permit. [Ord. 93-3 § 2, 1993].

15.08.100 Provisions supplemental to other regulations.

The adoption of CRMC 15.08.080 and 15.08.090 shall be in addition to and complementary to the other provisions of this chapter and shall be supplemental to such regulations as may from time to time be adopted by the Washington State Department of Ecology and codified in WAC 173-425-010 et seq.
