18.12.020 Locations and boundaries of zones.

The designations, locations, and boundaries of the aforesaid zones are set forth on the zoning maps of the county. Said maps and all notations, references, data and other information shown thereon shall constitute Section 18.12.040. All of the unincorporated territory of the county which is not now or hereafter included on any such zoning map is classified as AG zone unless it is located within the boundaries of a federally established wilderness area in which instance it is classified as LP zone. 18.12.030 Determination of uncertain boundaries.

Where uncertainty exists with respect to the boundaries of the various zones, as shown on the zoning map or maps, the following rules shall apply:

A. Street or Alleys. Where the indicated zoning boundaries on said map are approximately street or alley lines the centerlines of such streets or alleys shall be construed to be the boundaries of such zone.

B. Rivers, Streams, Ridgelines and Other Natural Features. Where the indicated zoning boundaries on said map are approximately rivers, streams, ridgelines or other natural features, the center of such rivers or streams and the crest of such ridges or mountain tops shall be construed to be the boundaries of such zone.

C. Boundary Lines. Where the zoning boundaries are or appear to be established boundary lines or lot lines said boundary or lot lines shall be construed to be the boundaries of said zone, unless said boundaries are otherwise specified on the maps. Where lot lines or boundary are changed after the effective date of the ordinance codified in this title, the zoning boundaries shall not be changed unless specifically ordered otherwise by the board of supervisors.

D. Scale on Map. Where zoning boundary lines are not street, alley, natural features or otherwise established boundary lines, and are not otherwise clearly located, the scales on the particular zoning maps shall be used to determine their locations.

E. Determination of Zoning Boundaries. The planning commission shall determine zoning boundary locations by written decision where uncertainty exists as to the location of the boundaries of zoning districts. (Ord. 453 § 4.07, 1985)

18.12.040 List of zoning maps.

This section lists the zoning maps of the county. All zoning maps established previous to the date the ordinance codified in this title takes effect are repealed and replaced by the zoning maps listed as in this section.

18.12.050 Zoning districts and General Plan land use designations.

State law requires that a county zoning ordinance be consistent with its adopted general plan. The following table shows which zoning districts are consistent with which General Plan land use designations (see also Section 18.04.060).

NOTE: Neighborhood commercial (NC), commercial (C), industrial (IND) and institutional (INS) zoning classifications maybe applied to lands within any general plan land use designation except wilderness (W) at the discretion of the county, provided a corresponding symbol appears on the general plan land use map signifying conformance.

Combining zones may be used with and zoning classification in any general plan land use designation, unless stated otherwise elsewhere in this title.

18.12.060 Official zoning maps—Location and availability.

The official zoning maps listed and made a part of Section 18.12.040 shall be stored, kept up to date, and made available for public review in the county planning office, and at the office of the county clerk, county of Alpine, Administration Center, Markleeville, CA 96120. Said official zoning maps are prepared on clear mapping mylar and they are not to leave the clerk’s office except to be changed by the county planner pursuant to Section 18.12.080. Copies of any official map may be obtained for a fee from the clerk’s office or from the county planner. (Ord. 453 § 4.04, 1985)

18.12.070 Official zoning maps—Planning commission copies.

The county planner shall maintain a current set of copies of the official zoning maps for reference by the planning commission, copies of which may be made available to the public pursuant to Section 18.12.060. (Ord. 453 § 4.05, 1985)

18.12.080 Zoning map changes.

Zoning maps shall only be changed after following the procedures set forth in Chapter 18.84 of this title. When the board of supervisors directs that a change shall be made to one or more zoning maps pursuant to an action taken in accordance with Chapter 18.84, the county planner will see that said change(s) are reflected on the appropriate official zoning map(s) retained in the clerk’s office within thirty days of the date said zoning change takes effect. The county planner will also insure that planning commission copies are amended to reflect the change(s). The county clerk shall, within thirty days of a decision by the board of supervisors to amend this title, insure that amendments or additions to the text of this title are reflected in official county records, on the planning commission’s copies of the ordinance codified in this title, and on all subsequent copies given or sold to the public (see also Section 18.84.060).
