OBSTRUCTIONS TO WATERCOURSES

6-6.01 Permits: Required.

No person shall place, construct, or maintain any structure or obstruction, in whole or in part, within or along any watercourse within the City without first having obtained a permit therefor from the Council.

6-6.02 Permits: Applications: Drawings and Specifications: Inspections: Issuance.

Applications for the permits required by Section 6-6.01 of this chapter shall be accompanied by drawings and specifications, together with information relative to the dimensions and positions of such structure and obstruction. The Council shall examine, or cause to be examined, such drawings, specifications, and information and, if necessary, shall examine, or cause to be examined, the premises upon which it is proposed to erect or maintain such structure or obstruction. If it shall appear that such structure or obstruction can be safely erected or maintained at the place and in the manner proposed, the Council shall issue a permit therefor.

6-6.03 Dumping and Depositing Materials.

No person shall deposit in, permit to pass into, or place where it can pass into any watercourse in the City any of the following:

(a)    Dirt, rubbish, metal, rock, debris, garbage, refuse, asphalt, bitumen, tar, or residuary products of petroleum;

(b)    Refuse or wastes, liquid, or solid, from any refinery, gas house, tannery, distillery, chemical works, ink works, paint works, mill, or factory of any kind; or

(c)    Sawdust, shavings, slabs, edgings, factory refuse or wastes, slag, or other substances or materials whatsoever.

6-6.04 Violations: Penalties.

Any person occupying any land or premises within the City upon which any structure or obstruction is maintained, in whole or in part, within or along any watercourse shall be deemed guilty of a violation of the provisions of this chapter and shall be subject to the penalties set forth in Chapter 2 of Title 1 of this Code.
