11.20.010 Pier Fishing Gear Limitation.

No person shall fish upon any public wharf, dock or pier in the City with more than two fishing lines or fishing tackle at one and the same time; or have extended from any such pier, wharf or dock into the waters of the Pacific Ocean, or of the harbor or bays, more than two fishing lines or fishing tackle, at one and the same time; or shall be in charge or control of or use for the purpose of fishing from such wharf, dock or pier, more than two fishing lines or fishing tackle at one and the same time. 11.20.020 Pier Fishing Hours.

No person shall fish from any public wharf, dock, pier or sea wall within Newport Bay between the hours of ten p.m. and six a.m. of the following day. No person shall fish from the Newport Pier or Balboa Pier during the times or from places on the piers that are prohibited pursuant to Section 11.20.060 of this chapter. 11.20.030 Overhead Casting.

No person shall cast or throw over his head or shoulders any metal or mineral weight or sinker attached to any fishing line or fishing tackle, on or from any dock, wharf, pier, breakwater, jetty, seawall, or sidewalk within the City. (Ord. 95-1 (part), 1995: 1949 Code § 4229)

11.20.040 West Jetty View Park.

No person shall fish from any location within the boundaries of, or along or upon the jetty adjoining the West Jetty View Park. The West Jetty View Park shall be posted with notice that fishing is prohibited. A map showing the location of the park and overhead aerial photo depicting the park shall be maintained on file with the City Clerk. (Ord. 95-1 (part), 1995: Ord. 91-18 § 1, 1991)

11.20.050 Cleaning of Fish or Mussel.

No person shall place, cut or clean any fish, mussel, bait or other marine animal upon any bench or seat placed upon any ocean pier or upon the floor or railings of such piers. (Ord. 95-1 (part), 1995: Ord. 93-28 § 2 (part), 1993)

11.20.060 Closing the Newport Pier, Balboa Pier and/or Other Public Piers.

A.    The City Manager shall have the authority to close the Newport Pier, Balboa Pier and/or other public piers to members of the general public during certain hours. The closure shall be effective at such time as signs giving notice of the hours of closure are posted at conspicuous places on the pier.

B.    The City Manager shall have the authority to prohibit fishing on all or part of the Newport Pier, Balboa Pier and/or other public piers during certain hours to facilitate use of the pier by the general public. The prohibition shall be effective at such time as signs giving notice of the prohibition are posted at conspicuous places on the pier.

C.    No person shall remain on the Balboa Pier, Newport Pier and/or other public piers during hours of closure as established by the City Manager.

D.    No person shall fish from the Balboa Pier, Newport Pier and/or any other public piers during the times or at the places as prohibited by the City Manager.

E.    No person shall fail to comply with the request of any City employee responsible for cleaning or supervising any pier to leave or move to a specific location on the pier. (Ord. 2011-6 § 4, 2011: Ord. 95-1 (part), 1995: Ord. 93-28 § 2 (part), 1993)
