APPLICABILITY OF GOVERNMENT CODE SECTION 65912.157 (SENATE BILL 79) Revised 6/26

18.25A.010 Purpose.
The specific purposes of this chapter are to temporarily exclude certain sites from the applicability of SB 79 (2025) (Government Code Sections 65912.155 through 65912.162) because such sites already allow development at or above fifty (50) percent of the levels otherwise required under Government Code Section 65912.157(a). 18.25A.020 Applicability.
This chapter applies to sites that are: (A) zoned MU-DC-100, MU-D-120, MU-SC-120, and RM-100; and (B) located within one-quarter mile of the San Carlos Caltrain Station, including all parcels indicated on the zoning map. (Ord. 1634 § 4 (Exh. A), 2026)
18.25A.030 Exclusion.
Pursuant to Government Code Section 65912.161(b)(1), the sites identified in Section 18.25A.020 are excluded from the applicability of Government Code Section 65912.157, or successor section, until one (1) year following the adoption of the seventh revision of the housing element. The sites identified in Section 18.25A.020 remain subject to applicable local standards, including, but not limited to, General Plan and zoning standards. (Ord. 1634 § 4 (Exh. A), 2026)
