Article 1. Returned Check Policy

1-8-101 Finding.

The City Council finds and declares that returned checks are detrimental to the City’s revenues; pose an accounting burden; and represent nonpayment for services rendered or to be rendered.

1-8-102 Service charge.

Any person whose check is returned due to, but not limited to, the following reasons shall be assessed a service charge in the amount of Twenty-five and no/100ths Dollars ($25.00), which may be increased from time to time by resolution of the City Council, payable to the City of Turlock over and above the amount of the returned check:

(a) Check is drawn on an account with insufficient funds to cover the amount of the check;

(b) The person has no account with the institution on which the check is drawn; or

(c) The person instructed the institution on which the check is drawn to stop payment on same.

1-8-103 Revocation of privileges.

Any person whose check is returned twice within a twelve (12) month period to the City of Turlock shall have his or her privileges to pay by check revoked for a period of twelve (12) months from the second such occurrence.

1-8-104 Method of payment upon revocation of privileges.

Any person who has his or her check payment privileges revoked pursuant to Section 1-8-103, above, may only pay amounts owing to the City of Turlock by way of cash, money order, or cashier’s check, during the time period of such revocation. Additionally, such person is required to pay the sum of Twenty-five and no/100ths Dollars ($25.00) service fee over and above the amount reflected by the returned check.

1-8-105 Discontinuance of City service.

Because any returned check represents nonpayment for services or fees, any City of Turlock service which had been or will be commenced on behalf of a payor shall be suspended or discontinued forthwith and shall not be resumed until all monies owed to the City are paid in accordance with this Chapter in the amount reflected on the returned check plus the Twenty-five and no/100ths Dollars ($25.00) service fee.

1-8-106 Reinstatement of privileges.

Any person who has his or her check payment privileges revoked pursuant to Section 1-8-103, above, may only have such privileges reinstated after twelve (12) continuous months of good payment history and upon the review and recommendation by the City of Turlock Finance Department and the City department providing such service.

1-8-107 Penalty.

The City Council may establish a penalty over and above the cost of the service charge reflected in Section 1-8-102 hereinabove for returned checks at a sum to later be set by resolution of the City Council.
