6.15.010 Definitions.

“Animal” or “animals” shall include horses and mules.

“Fowl” shall include chickens, ducks, geese, turkeys, guineas, pigeons and like fowl.

“Person” shall mean any person, firm, partnership, corporation or association.

“Town board” shall mean the board of trustees of the town of Granby or a designated representative. [Code 1999 § 3-2-1].

6.15.020 Permit required.

No person shall keep or maintain animals as herein defined within the corporate limits of the town of Granby unless such person has a valid permit to do so, and no animals, rabbits or fowl shall be allowed to run or fly at will.

Application for a permit to keep animals, rabbits or fowl shall be made in writing to the town clerk. Following application, the town clerk shall cause the premises to be inspected and if all conditions herein provided are complied with shall authorize issuance of the permit. If a permit is denied or at the request of the town clerk, a hearing regarding approval of an application may be set before the town board. A permit shall continue unless revoked as herein provided, and shall be issued upon the payment of a permit or application fee of $10.00 for each horse or mule and an application fee of $10.00 for rabbits or fowl. 6.15.030 Permit conditions.

The town board shall authorize issuance of a permit to any person to keep animals, rabbits or fowl on certain described premises within the town of Granby upon determination that the following conditions or requirements are complied with:

(a) For horses or mules there shall be at least one acre of land exclusive of the residence and/or business building.

(b) Horses and mules shall only be allowed in the R-1 single-family low density district; R-2 multiple-family residential medium density district; R-3 multiple-family residential high density district; MH mobile home residential district; R/B residential/business district; and O open and recreation district.

(c) The number of animals shall not exceed one animal per one-fourth acre of land.

(d) The number of rabbits or fowl shall not exceed one rabbit or fowl for each nine square feet of enclosed area exclusive of shed, shelter or coop, and such shed, shelter or coop shall contain an area of not less than two square feet for each rabbit or fowl. A maximum of 20 fowls and 10 rabbits are permitted on any single property.

(e) All manure shall be removed daily from the town of Granby or shall be stored daily in fly-tight containers acceptable to the town and kept tightly closed at all times except when being stored or removed, and the contents of said fly-tight containers shall be removed from said town at least once each week; provided this provision shall not apply to manure spread as fertilizer upon cultivated ground or lawns unless such manure attracts flies or other insects or causes obnoxious odors.

(f) Drinking facilities shall be provided with adequate overflow drainage to prevent saturation of surrounding soil.

(g) Spillage and leftovers from animal, rabbit, and fowl feedings must be removed or so disposed of as to prevent fly or rodent propagation or creation of odors.

(h) The shed, shelter, pen, or enclosure for animals shall not be closer than 50 feet to any dwelling house, place of business or street. A shed, shelter, pen, or enclosure for fowl or rabbits shall not be closer than 15 feet to any dwelling or place of business on adjacent property, nor any street.

(i) All sheds or other shelters for such animals, rabbits or fowl shall be kept free of rodents and shall be thoroughly sprayed with insect spray and a deodorant at intervals of not less than twice each week during the months of June to October, inclusive, of each year, and shall be kept in good repair and a fresh covering of straw, wood shavings, or corn cobs shall be placed on the floor each day.

(j) The construction of feeding facilities and the construction, drainage, flooring, ventilation and fly screening of all sheds, coops, or other shelters shall be governed by sanitary regulations adopted by the town board. [Ord. 867 § 2, 2017; Ord. 837 § 1, 2015. Code 1999 § 3-2-3].

6.15.040 Public hearing.

Prior to the issuance of any permit (for a horse or mule) provided for under this chapter, the town board shall hold a public hearing on the question of issuance of the permit. The applicant for the permit shall cause notice of the hearing to be mailed certified mail, return receipt requested, to all landowners within 200 feet of the premises proposed to be licensed at least 15 days prior to the date of the hearing.

In granting or denying the permit, the town board, in addition to ensuring the provisions of GMC 6.15.030 are met, shall utilize the following additional criteria:

(a) Preservation of the interest of the health, safety and welfare of the community as a whole;

(b) Compatibility with and effect on the neighborhood in which the use is to be located;

(c) Mitigation measures used to alleviate on- and off-site impacts due to the development and operations of the use;

(d) Preservation of property values;

(e) Public reaction to the proposal;

(f) Likelihood of a nuisance being created; and

(g) Any other criteria deemed appropriate by the town board. [Code 1999 § 3-2-4].

6.15.050 Exclusions.

(a) The area requirements for proximity of enclosures to residences, places of business and streets in this chapter shall not be applicable to the display of fowl or animals by entrants in any show or fair authorized by the town, nor the temporary maintenance by a licensed veterinarian of animals, rabbits, or fowl during the time necessary for treatment.

(b) This chapter shall not prohibit the transportation of such animals or fowl through town. [Code 1999 § 3-2-5].

6.15.060 Revocation or denial.

(a) An employee of the town may recommend the revocation of any permit upon satisfactory evidence that the permittee is violating, or has violated, any of the conditions set forth in this chapter. Upon such recommendation being filed with the town clerk, the town clerk shall cause written notice thereof to be mailed to the permittee notifying said permittee that a hearing on such recommendation will be held at a board of trustees’ meeting in not less than 10 days from the date of mailing such notice, specifying the time and place of said hearing. If, upon such hearing, said board of trustees finds that permittee has violated conditions herein provided for such permit, the board of trustees may forthwith revoke said permit and the permittee shall be allowed 48 hours within which to rid the premises of such animals, rabbits or fowl and 10 days additional to remove any offensive or prohibited material in accordance with aforementioned requirements.

(b) Upon the denial of a permit under the provisions of this chapter, the town clerk shall cause written notice of such denial to be mailed to the applicant, notifying said applicant thereof. [Code 1999 § 3-2-6].

6.15.070 Swine and roosters.

Notwithstanding the provisions heretofore set forth, no swine or male fowl capable of crowing shall be kept by any person within the boundaries of the town of Granby, and no permit shall be issued therefor. [Code 1999 § 3-2-7].

6.15.080 Sanitary regulations.

The premises upon which animals are kept shall be maintained in sanitary condition and shall comply with all sanitary regulations adopted by the county health department. Said premises shall at all reasonable hours be subject to inspection by representatives of said health department. It shall be unlawful for any person to refuse to permit such inspection. 6.15.090 Barnyard animals.

All barnyard animals, such as cows, sheep, goats, and any other similar animals, shall not be allowed to be kept in town over 24 hours. [Code 1999 § 3-2-9].
