18.80.010 District intent.

The NC (neighborhood commercial) district is intended to be used as follows:

(A) Use Type and Intensity.

(1) Low intensity retail and services.

(2) Serve adjacent neighborhoods.

(3) One to three tenant structures.

(B) Application of District.

(1) Existing and new development.

(2) Buffering or transitional district.

(3) Spot zoning.

(C) Development Standards.

(1) Ensure development is consistent with residential scale and character.

(D) Appropriate adjacent districts: PR, R2, R3, R4, R5, TR, LR, MH, UV, IS, NC, DC, and C1.

(E) Plan Commission.

(1) Zone property NC only after determining the site is appropriate for any of the possible uses allowed in the zoning district.

(2) Be sensitive to the potential for light pollution, noise pollution and the generation of excessive vehicular traffic.

(3) Pedestrian traffic should be accommodated within each development and connected to surrounding areas.

(F) Board of Zoning Appeals.

18.80.020 Permitted uses.

The following uses are considered permitted in the neighborhood commercial (NC) district:

(A) Bank machine or ATM walk-up.

(B) Bank without drive-up window.

(C) Barber or beauty shop.

(D) Coffee shop.

(E) Delicatessen.

(F) Dwelling units (upper floors).

(G) Farmers’ market.

(H) Health spa or day spa.

(I) Home business, type 1.

(J) Home business, type 2.

(K) Home business, type 3.

(L) Ice cream shop.

(M) Office, general.

(N) Photographic studio.

(O) Recreation center or play center.

(P) Restaurant.

(Q) Retail sales, low intensity.

(R) Retail sales, medium intensity.

(S) Studio arts.

(T) Tailor or pressing shop.

(U) Tanning salon.

18.80.030 Special exception uses.

The following uses are considered a special exception in the neighborhood commercial (NC) district:

(A) Automobile gas station.

(B) Automobile sales.

(C) Bank machine or ATM drive-up.

(D) Bank with drive-up window.

(E) Bar or tavern.

(F) Billiard or arcade room.

(G) Bowling alley.

(H) Day care, adult.

(I) Day care, child.

(J) Event center.

(K) Fitness center or health club.

(L) Office, medical.

(M) Park, private.

(N) Parking lot, independent.

(O) Permanent outdoor display areas.

(P) Places of worship.

18.80.040 Development standards.

(A) Minimum lot area: 5,000 square feet.

(B) Maximum lot area: one acre.

(C) Minimum lot width: 55 feet.

(D) Sanitary sewer utility: required.

(E) Water utility: required.

(F) Minimum front yard setback: 10 feet for primary and accessory structures.

(G) Minimum side yard setback: 30 feet for primary and accessory structures.

(H) Minimum rear yard setback: 30 feet for primary and accessory structures.

(I) Maximum lot coverage: 65 percent of lot area.

(J) Minimum main floor area: 800 square feet.

(K) Maximum main floor area: 5,000 square feet for a single establishment.

(L) Minimum dwelling unit size: 800 square feet.

(M) Maximum primary structures: no limit.

(N) Maximum density: three dwelling units per acre in a multiple unit development.
