18.96.010 District intent.

The HC (highway commercial) district is intended to be used as follows:

(A) Use Type and Intensity.

(1) High intensity commercial, retail, service, and eating establishments closely accessible to an interstate and/or major highway.

(B) Application of District.

(1) Existing and new development.

(2) District areas can range from spot zoning to small pockets (a couple of lots) to medium sized areas.

(3) Along an interstate or major highway.

(4) Districts may exist within the city of Angola or the city’s extraterritorial jurisdiction.

(C) Development Standards.

(1) Require development standards that optimize accessibility while minimizing the impacts on surrounding areas.

(D) Appropriate adjacent districts: PR, AG, R5, IS, C1, C2, HC, I1, I2, and I3.

(E) Plan Commission.

(1) Zone property HC only after determining the site is appropriate for any of the possible uses allowed in the zoning district.

18.96.020 Permitted uses.

The following uses are considered permitted in the highway commercial (HC) district:

(A) Amusement park.

(B) Automobile car wash.

(C) Automobile gas station.

(D) Automobile rental.

(E) Automobile repair/body shop.

(F) Automobile sales.

(G) Automobile services.

(H) Bank machine or ATM drive-up.

(I) Bank machine or ATM walk-up.

(J) Bank with drive-up window.

(K) Bank without drive-up window.

(L) Bar or tavern.

(M) Bowling alley.

(N) Campground.

(O) Coffee shop.

(P) Coin laundry.

(Q) Dance or night club.

(R) Delicatessen.

(S) Event center.

(T) Farmers’ market.

(U) Fitness center or health club.

(V) Health spa or day spa.

(W) Hotel or motel.

(X) Ice cream shop.

(Y) Kennel.

(Z) Movie theater.

(AA) Office, construction trade.

(BB) Office, general.

(CC) Office, medical.

(DD) Paintball facility.

(EE) Parking lot, independent.

(FF) Permanent outdoor display areas.

(GG) Restaurant.

(HH) Restaurant with drive-up window.

(II) Retail sales, high intensity.

(JJ) Retail sales, medium intensity.

(KK) Self storage facility.

(LL) Semi tractor gas station.

(MM) Semi tractor wash.

(NN) Sports complex.

(OO) Technology park.

(PP) Telecommunication facility.

(QQ) Truck stop.

(RR) Wind turbine system, large.

18.96.030 Special exception uses.

The following uses are considered a special exception in the highway commercial (HC) district:

(A) Cemetery or mausoleum.

18.96.040 Development standards.

(A) Minimum lot area: one acre.

(B) Minimum lot width: 100 feet.

(C) Sanitary sewer utility: required.

(D) Water utility: required.

(E) Minimum front yard setback: 20 feet for primary and accessory structures.

(F) Minimum side yard setback: 25 feet for primary and accessory structures.

(G) Minimum rear yard setback: 25 feet for primary and accessory structures.

(H) Maximum lot coverage: 75 percent of lot area.

(I) Minimum main floor area: 1,000 square feet.

(J) Minimum dwelling unit size: not applicable.

(K) Maximum primary structures: three.
