10.32.010 Definitions.

For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

“Centre” means the Vanderburgh County Auditorium and Convention Centre situated in the city of Evansville, Vanderburgh County, Indiana.

“Centre manager” means the duly-appointed manager of the Centre.

“City” means the city of Evansville, Indiana.

“Handicapped license” means a vehicle registration plate or decal issued by the State Bureau of Motor Vehicles under IC 9-18-22-1 or a placard issued by the State Rehabilitation Services Agency under IC 5-16-9-1 through 5-16-9-7, or by another agency of this state or an agency of another state or of the federal government, which designates the vehicle as one which is used to transport handicapped persons. The handicapped license shall bear the official international wheelchair symbol, a reasonable facsimile of the symbol, or other symbol selected by such bureau or agency to designate the vehicle as one used to transport handicapped persons.

“Vehicle” means a motor vehicle as defined in Section 10.24.010(A).

10.32.020 Regulations.

Parking on the entrance drive (fronting Locust Street) or the Centre located in the city shall be regulated as follows:

A.    Measured along the centerline of the drive for its entire length, the one-half of the drive adjacent to the auditorium building is designated as a fire lane, and parking is prohibited on any portion thereof at all times.

B.    Measured along the centerline of the drive for its entire length, the one-half of the drive adjacent to Locust Street is designated as a half-hour parking area. No vehicle shall be parked in the parking area in violation of the following restrictions on parking:

1.    No vehicle shall be or remain parked or standing in or upon the parking area in excess of one-half hour;

2.    No vehicle shall be or remain parking or standing in a parking space reserved for handicapped, if any, unless the vehicle displays a valid handicapped license;

3.    No vehicle shall be or remain parked or standing in or upon the parking area other than within a parking space delineated by painted lines.

10.32.030 Signs and markings.

Signs shall be posted indicating the parking restrictions imposed by this chapter. Lines shall be painted on the surface of the parking area indicating the spaces available for parking, and parking spaces reserved for parking by permit, if any, shall be appropriately designated. The work shall be performed by the county.

10.32.040 Applications for and issuance of permits.

Permits shall be authorized and issued only upon application to, and authorization by, a committee comprised of the city clerk, the president of the board of commissioners of the county, and the Centre manager, or their designees. This committee shall also determine and authorize the marking of parking spaces or parking areas for parking by permit only. The committee shall authorize and issue permits only in conformity with the standards and guidelines set forth in this chapter.

10.32.050 Persons authorized to hold permits.

Permits may be authorized and issued only to an officer, employee, or board or commission member of a local governmental department or agency, the nature of whose duties requires both the parking of his vehicle for periods in excess of one-half hour and frequent departures and arrivals by vehicle for ingress and egress throughout the work day to the Centre.

10.32.060 Removal and impoundment of illegally parked vehicles.

Any vehicle, permitted or otherwise, which is illegally parked on the drive shall be subject to removal and impoundment at the expense of the owner of the offending vehicle. The cost of this removal and impoundment shall become a lien against the vehicle in accordance with applicable state law.

10.32.070 Enforcement.

The city is authorized to enforce the provisions of this chapter, and acceptance of this grant of authority shall be provided in an appropriate ordinance duly adopted by the common council of the city. Any person who violates the provisions of this chapter shall be subject to the penalties set forth in Section 10.32.080 and as may be provided by ordinance of the city. Nothing contained herein shall prevent the county from enforcing the provisions hereof at any time during which city enforcement officers are not on duty or are otherwise unavailable.

10.32.080 Violation--penalty.

A.    There is imposed a fine of three dollars for each overtime-parking violation of the parking regulations imposed by Section 10.32.020(B)(1). There is imposed a fine of five dollars for each violation of any other parking regulation contained in Section 10.32.020. All fines shall be paid at the office of the city clerk of the city of Evansville within thirty (30) days of the date of the violation. If any fine as herein imposed is not paid at the office of the city clerk within thirty (30) days of the date of the violation, the fine shall be increased to eight dollars.

B.    Each one-half hour after a vehicle has been found to be parked overtime shall be considered a separate offense, and the person shall be fined separately for each one-half hour of overtime parking as provided in subsection A of this section.
