10.28.010 Nuisance declared.

The city council finds, determines and declares that the bodies of motor vehicles which have been wholly or partially dismantled, and the parts of motor vehicles which are allowed to lie or remain on private or public property within the city, constitute an attractive nuisance and danger to children, a sanitation hazard and a public nuisance which should be abated and controlled.

10.28.020 On property for over five days prohibited.

It is unlawful for any person, firm or corporation to dismantle or wreck in whole or in part any motor vehicle and to permit such dismantled motor vehicle body or parts thereof to remain upon any public or private property within the city for a period in excess of five days, except as provided in Section 10.28.040.

10.28.030 Vehicle parts--Storage prohibited.

It is unlawful for any person, firm or corporation to keep, store or allow to remain upon any public or private property within the city for a period in excess of five days any new or used motor vehicle parts, except as packaged in the original container for shipment and further except as provided in Section 10.20.040.

10.28.040 Enclosure requirements.

The provisions of this chapter shall not apply where the dismantled motor vehicle bodies or new or used motor vehicle parts are stored or kept in a garage or other substantial enclosure so that they re not accessible to children; such enclosure shall be at least six feet in height and shall be locked and secured in such a manner as not to be accessible to children except when a person is on duty at the location so as to guard against injury to the children.

10.28.050 Premises maintenance.

It shall be the duty of the owner or owners, contract purchasers, lessees, or other person having the right to the possession of, and control over, property within the city, to keep their premises free from wholly or partially dismantled motor vehicle bodies, and new and used motor vehicle parts, as set forth in the chapter; and it is unlawful for any owner, contract purchaser, lessee or other person having the right to the possession and control over premises within the city, to cause, permit or suffer such dismantled motor vehicles, or new or used motor vehicle parts to remain on such property for more than five days after receiving written notice from the city to abate such nuisance.

10.28.060 Violation--Penalty.

Violation of any provision of this chapter shall be subject to punishment upon conviction by a fine pursuant to Section 1.20.020 of this code.

10.28.070 Violation--Separate for each day.

After any person, firm or corporation has been found guilty of a violation of this chapter, it shall be deemed that notice has been given as set forth in this chapter, and each day thereafter will constitute a new and independent violation of this chapter, subjecting such person, firm or corporation to the penalty set forth in this chapter.
