9.05.010 Statutory exemption.

The jurisdiction of Jefferson County is and shall be exempt from the prohibition set forth in RCW 9.41.050(4) as presently enacted and as may be hereafter modified or recodified. This exemption is enacted pursuant to RCW 9.41.050(6). [Ord. 8-94 § 1]

9.05.020 Purpose of provisions – Safety zone designated.

(1) The purpose of JCC 9.05.020 through 9.02.060 is to prohibit the carrying and/or discharging of weapons within the safety zone surrounding the Olympic and Clearwater Correction Centers. The safety zone shall be clearly marked as such with appropriate signing and includes the following described real property:

All those portions of Sections 28, 29, 32 and 33, Township 26 North, Range 11 West, Willamette Meridian, Jefferson County, Washington, described as follows:

Commencing at the northwest corner of Section 33; thence North 73°37′16″ West 1,787.66 feet to the west bank of the Snahapish River and the True Point of Beginning of this description; thence North 34°38′27″ East 334.25 feet; thence North 77°47′58″ East 946.37 feet to the west side of the Hoh Mainline; thence North 11°58′07″ West 1,109.11 feet; along west side of the Hoh Mainline; thence continuing North 11°58′07″ West 336.59 feet; thence North 74°36′10″ East 1,652.3 feet; thence North 11°54′30″ East 693.8 feet; thence South 88°58′37″ East 591.5 feet; thence South 01°50′08″ West 2,582.6 feet; thence South 20°14′04″ East 1,460.11 feet; thence South 51°05′45″ East 732.62 feet; thence North 70°44′27″ East 439.60 feet; thence South 22°00′31″ East 2,576.1 feet; thence South 06°24′10″ East 1,087.9 feet; thence South 44°37′34″ West 2,052.9 feet, thence North 33°39′44″ West 4,173.3 feet; thence westerly along the centerline of Camp Creek to its point of confluence with the Snahapish River; thence northerly along the west bank of the Snahapish River to the True Point of Beginning.

(2) It is the further intent of JCC 9.05.020 through 9.05.060 to protect the personnel and inmates of Olympia and Clearwater Correction Centers against the safety menace incident to the carrying and/or discharging of weapons within the safety zone. Nothing in JCC 9.05.020 through 9.05.060 shall prohibit the transport of weapons by vehicle, provided said transport is consistent with state law. [Ord. 7-91 § 1]

9.05.030 Definitions.

“Weapons,” as used in JCC 9.05.020 through 9.05.060 shall include, but not be limited to: pistols, revolvers, shotguns, rifles, all forms of bows and arrows and slingshots. [Ord. 7-91 § 2]

9.05.040 Violations – Penalties.

(1) Civil Penalties. Any person who violates the provisions of JCC 9.05.020 through 9.05.060 shall be subject to a penalty in the amount of not less than $100.00, nor more than $250.00.

(2) Gross Misdemeanor. In addition to the penalty imposed in subsection (1) above, any person who violates any provision of JCC 9.05.020 through 9.05.060 shall be guilty of a gross misdemeanor. [Ord. 7-91 § 3]

9.05.050 Enforcement officers and procedures.

Enforcement of JCC 9.05.020 through 9.05.060 may be by any state or county law enforcement office, state game office, state fisheries officer or personnel of the correction centers. All such enforcement officers are empowered to issue citations to and/or arrest without warrant, persons violating the provisions of JCC 9.05.020 through 9.05.060. Said enforcement officers may serve and execute all warrants, citations and other process issued by the courts. In addition, mailing by registered mail of such warrant, citation or other process to the last known place of residence of the offender shall be deemed as personal service upon the person charged. Said enforcement officers may seize and hold as evidence the weapon of any person violating the provisions of JCC 9.05.020 through 9.05.060. [Ord. 7-91 § 4]

9.05.060 Interpretation.

In the event any other county ordinance, whether or not codified, is in conflict with any of the terms of JCC 9.05.020 through 9.05.060, the more stringent shall be construed as applicable. [Ord. 7-91 § 6]
