2.22.010 Findings and recitals.

A. Civil service has been mandated by Washington law since 1935 for city and town firefighters and since 1937 for city and town police officers.

B. Current city ordinances and civil service rules provide for coverage of law enforcement officers and city police officers as defined in KCC 2.22.030 as police officers or uniform personnel, but do not provide for coverage of nonuniform police personnel.

C. On May 2, 1989, the city council directed that the city civil service include nonuniform police personnel. The city has met with representatives of collective bargaining units concerning the implementation of civil service for nonuniform police personnel. On July 20, 1988, the city civil service commission provided for amendment of its rules to provide for coverage of corrections officers, police specialists and other nonuniform police personnel.

D. The city has met with collective bargaining units representing nonuniform police personnel to negotiate changes to collective bargaining agreements related to such coverage.

E. It is the intent of this section to provide necessary amendments to the code to carry out the prior direction of the city council and to authorize agreements with collective bargaining units representing nonuniform police personnel.

2.22.020 Creation.

There is hereby created the city police department. The department shall be supervised by the chief of police. With the exception of the incumbent chief, who shall remain subject to the city’s civil service system, the position of chief of police shall be exempt from, and shall not be a classified position under the city’s civil service system. The chief of police shall be appointed by and serve at the pleasure of the mayor. All appointees to the position of chief of police are terminable at will by the mayor except for the incumbent chief who shall be subject to the city’s civil service rules and regulations relating to demotion and termination.

2.22.025 Chief of police – Duties.

The chief of police shall be the chief police officer of the city responsible for maintaining the peace of the city. The chief of police shall have the responsibility for the appointment, removal and suspension of employees of the department subject to the city’s civil service rules and regulations, the city’s personnel policies, and labor agreements. The chief shall be responsible for the management of the police department and the administration of the department’s budget as authorized and directed by the city council and the mayor. The chief of police shall also perform such other duties as may be imposed by ordinance or as directed by the mayor.

2.22.030 Definitions.

The terms, “law enforcement officer,” and “city police officer” shall cover such regular, full-time personnel of the city police department who have been appointed to offices, positions or ranks of the city police department which are herewith expressly created:

1. Chief of police;

2. Assistant chief of police;

3. Captain;

4. Lieutenant;

5. Sergeant;

6. Commissioned officer.

2.22.040 Parking enforcement aide – Position created.

There is created within the police department of the city a position designated as parking enforcement aide.

2.22.050 Same – Position classification.

The person filling the position of parking enforcement aide shall not be deemed to be a law enforcement officer as that term is used in the law enforcement offices and firefighters retirement system, nor shall the position be a classified position within the civil service system of the city.

2.22.060 Same – Duties.

The duties of the parking enforcement aide shall include patrolling assigned areas of the city to detect violations of the city’s parking regulations, to issue citations to violators of parking regulations and to authorize the towing of vehicles parked in violation of parking regulations, to appear in court to testify when so required, and to perform related work as assigned.

2.22.070 Same – Powers.

The parking enforcement aide shall not have the power of arrest, but shall have authority to issue and serve citations and complaints for violation of city parking regulations. A copy of any such complaint or citation shall be filed with the clerk of the court of traffic violations bureau within forty-eight (48) hours after its issuance. In addition, the parking enforcement aide shall have the ability to authorize the towing of vehicles parked in violation of parking regulations.
