10.16.005 Definitions.

A. "Bicycle" shall have the same definition as set forth in RCW 46.04.071 and/or 46.04.169, as now or hereafter amended.

B. "Skateboard" shall have its ordinary meaning.

C. "Wheeled devices" shall mean all other wheeled devices, including without limitation roller blades, roller skates, "razors," motorized foot scooters as defined in RCW 46.04.336 and electric personal assistive mobility devices (EPAMDs) as defined in RCW 46.04.1695, each as now or hereafter amended, but excluding electric wheelchairs or similar devices used by the rider because of medical necessity. 10.16.010 Authority to designate no biking, skateboarding and wheeled devices zones.

The city manager or his designee is hereby authorized to designate any sidewalks or portions of sidewalks within the city as no biking, skateboarding and wheeled devices zones where such action is appropriate in light of the area, conditions of the sidewalk and/or adjacent roadway, and the amount, differential speed, and congestion level of vehicular and pedestrian traffic. The city manager or his designee is authorized to erect signs on or to place any markings deemed appropriate by the city manager or his designee on any sidewalk or roadway designating the same as a no biking, skateboarding and/or wheeled devices zone. 10.16.020 Riding on sidewalks prohibited – Conditions.

A. No person shall ride a bicycle, skateboard or wheeled device upon a sidewalk within the city when any portion thereof has been designated and signed as a no biking, skateboarding or wheeled device zone in accordance with MCMC 10.16.010.

B. Whenever any person is riding a bicycle, skateboard and/or wheeled device upon any sidewalk, such person shall yield the right-of-way to every pedestrian and shall give an audible signal before overtaking and passing every pedestrian. (Ord. 2004-587 § 1)

10.16.030 Penalty for violation.

Any person violating any provision of this chapter shall have committed a traffic infraction and shall be assessed a monetary penalty not to exceed $250.00. (Ord. 2004-587 § 1)
