10.12.010 Parallel parking on Division Street from Main Street to Railroad Avenue.

It is unlawful for any person to park a vehicle upon either side of Division Street, from Main Street to Railroad Avenue, in other than a parallel manner in accordance with the signs posted.  A violation of this section may result in the impoundment of the vehicle without notification at the owners’ expense.  The fine shall be as set forth in Chapter 1.08.  (Ord. 460 §1(part), 2007:  Ord. 404 §1, 2003:  Ord. 312 §3(part), 1997;  Ord. 91-B §4(part), 1980;  Ord. 7-B §§2, 3, 1968)

10.12.020 Restricted hours of parking on Main Street.

It is unlawful for any person or corporation to park a vehicle upon the Main Street of the town from the east to west town limits between the hours of three a.m. and six a.m.  Any violation of this section may result in the removal of the vehicle without notification of the owner of the vehicle, by a registered tow truck operator at the expense of the owner of the vehicle.  A violation of this section may result in the impoundment of the vehicle without notification at the owners’ expense and a fine as set forth in Chapter

10.12.030 Parallel parking on Pope Avenue from Division Street to Brace Street.

It is unlawful for any person operating a vehicle to park the same upon either side of Pope Avenue, from Division Street to Brace Street, in other than a parallel manner in accordance with the signs posted.  It is also unlawful for any person operating a vehicle to park outside of the designated parking stripes.  A violation of this section may result in the impoundment of the vehicle without notification at the owners’ expense and a fine as set forth in Chapter 1.08.  (Ord. 460 §1(part), 2007:  Ord. 312 §3(part), 1997;  Ord. 91-B §§2, 4(part), 1980)

10.12.040 Parking on Main Street between Brace and Raymond Streets.

Parking of motor vehicles on the Main Street of the town, also known as primary State Highway No. 2, between Brace and Raymond Streets, shall be in designated parking areas only as designated by stripes painted onto the asphalt.  It is unlawful to park a motor vehicle taking up more than one designated parking space or to park outside of the stripes designating the parking space.  A violation of this section may result in the impoundment of the vehicle without notification at the owners’ expense and a fine as set forth in Chapter 1.08.  (Ord. 460 §1(part), 2007:  Ord. 404 §2, 2003:  Ord. 312 §3(part), 1997;  Ord. 114-B §§l, 2, 1981)

10.12.050 Parking unlawful west of the fire station on Broadway Street from the corner of Cole and Broadway south to the alley.

It is unlawful for any person or corporation to park a vehicle at any time west of the fire station on Broadway Street from the corner of Cole and Broadway south to the alley.  A violation of this section may result in the impoundment of the vehicle without notification at the owners’ expense and a fine as set forth in Chapter 1.08.  (Ord. 460 §1(part), 2007:  Ord. 312 §3(part), 1997;  Ord. 116-B §§l, 3, 1981)

10.12.060 Parking prohibited in portion of the alley in Block 13, original town of Wilbur.

It is unlawful for any person or corporation to park a vehicle between December 1st and March 1st of each year on the south side of the alley in Block 13 of the original town of Wilbur (block located between Division and Broadway Streets and Main Avenue and Railroad Avenue) in the following area:  seventy-four feet from the curb on Division Street to the west end of the community center building.  A violation of this section may result in the impoundment of the vehicle without notification at the owners’ expense and a fine as set forth in Chapter 1.08.  (Ord. 460 §1(part), 2007:  Ord. 312 §3(part), 1997;  Ord. 234, 1990)

10.12.070 Parking in passenger loading and unloading zone in front of school on Pope Street.

It shall be unlawful for any person or corporation to park in the loading and unloading zone in front of the Wilbur School on Pope Street for a period of more than ten minutes as designated by the signs.  (Emergency vehicles are exempt from this section.)  A violation of this section may result in the impoundment of the vehicle without notification at the owners’ expense and a fine as set forth in Chapter 1.08.  (Ord. 460 §1(part), 2007)

10.12.080 Special parking zones.

The following special zones are established on the following streets as described:

A.  Police Vehicle Parking Only.  East side of Division Street from the alley dividing Block 14 Original Townsite Addition, town of Wilbur, to a point thirty feet north of such alley.

B.  Twenty-Minute Loading Zone.  Twenty-minute passenger vehicle loading zone from eight-thirty a.m. to five-thirty p.m. Monday through Saturday on the west side of Division Street from the alley dividing the block and extending to the north of said alley a distance of thirty-five feet in Block 13, Original Townsite Addition, town of Wilbur, as designated by the sign on the east wall of the Wilbur Drug Store.  A violation of this section may result in the impoundment of the vehicle without notification at the owners’ expense and a fine as set forth in Chapter 1.08.

C.  During the parade on Wild Bill Goose Days there will be no parking on either side of Main Street during the parade from Brace Street to Raymond Street.  A violation of this section may result in the impoundment of the vehicle without notification at the owners’ expense and a fine as set forth in Chapter 1.08.  (Ord. 460 §1(part), 2007:  Ord. 328 §1, 1998;  Ord. 312 §2, 1997)

10.12.090 Defense of parking violation.

It shall be a defense of parking violations if the markings for parking spaces are so worn that it cannot be determined where the parking zones or spaces are located or if by weather so covered as not to be located.  (Ord. 460 §1(part), 2007)

10.12.100 Violation--Penalty--Effective date.

The last registered owner shall be responsible for any violation of this chapter, unless a vehicle theft report has been filed with a law enforcement agency, clearly showing that the vehicle was not in the registered owner’s possession at the time of the violation.  The term “person” as used in this chapter shall mean the registered owner(s) or authorized operator of the vehicle.  Any unoccupied vehicle unlawfully parked will be issued an infraction to the last registered owner of the vehicle with the offender copy placed in a conspicuous place on the vehicle or if weather prohibits the placement in a conspicuous place, sent by mail to the last registered owner of the vehicle.

Violation of the provisions of this chapter shall constitute an infraction with the penalty imposed in accordance with the provisions of Chapter 1.08.  (Ord. 460 §1(part), 2007:  Ord. 312 §4, 1997.  Formerly 10.12.090.)
