17.28.010 Variances.

The procedures and criteria relating to variances in the town comprehensive zoning ordinance, Ordinance 108-B (Chapter 18.52 of this code), and any future revisions, are adopted for variances from the requirements of this title.  Any subdivider may make application for a variance to any portion of Sections 17.16.030 through 17.16.130 and 17.28.060, provided the request is received concurrently with the application for the proposed short subdivision or subdivision.  (Ord. 134-B §6.1, 1982)

17.28.020 Environmental impact statements.

In the event an environmental impact statement is required on a proposed short subdivision or subdivision, then any pending time period requirements of this title shall be stayed until such time as an environmental impact statement has been completed and filed with the town clerk.  (Ord. 134-B §6.2, 1982)

17.28.030 Scope of terms.

The word “may” as used herein is permissive as indicating a use of discretion in making a decision; the word “shall” as used herein is mandatory.  (Ord. 134-B §6.3, 1982)

17.28.040 Ordinance review.

It shall be the responsibility of the planning commission to review and update this title every five years.  Furthermore, changes and/or additions shall be made whenever it is deemed necessary.  Recommendations for changes/additions shall be made by the planning commission after holding a public hearing.  Recommendations shall be given to the town council who shall approve or disapprove the recommendations of the planning commission.  (Ord. 134-B §6.4, 1982)

17.28.050 Transfer or construction prior to final plat approval.

An agreement to sell or otherwise transfer a lot prior to recording of the final plat is subject to RCW 58.17.205.  Construction or placing of a structure on a lot may be started prior to recording of the final plat, and is subject to all applicable codes and regulations of the town, provided that no occupancy permit may be issued prior to the recording of the final plat.  (Ord. 134-B §6.7, 1982)

17.28.060 Fee schedule and costs paid by subdivider.

A schedule (page 20 of the ordinance codified in this title) shows the fees to be charged the subdivider, plus other costs the subdivider is responsible for, that are incurred by a short subdivision or subdivision application.  These fees and requirements may be amended at any time by an action of the town council, or a variance (Section 17.28.010) may be requested by the subdivider.  (Ord. 134-B §6.8, 1982)

17.28.070 Summary of required mapped and written information.

A schedule (page 21 of the ordinance codified in this title) is a guide which lists sections of the ordinance codified in this title that list information required in an application for a short subdivision or a subdivision.  (Ord. 134-B §6.9, 1982)

17.28.080 Procedure chart for short subdivision and subdivision approval.

A procedure chart (pages 22 and 23 of the ordinance codified in this title) illustrates the steps in approving a subdivision application.  A procedure chart (page 24 of the ordinance codified in this chapter) illustrates the steps in approving a short subdivision application.  These charts are meant to be a guide for interested persons and reference must be made to Chapter 17.12 for a short subdivision and Chapter 17.16 for a subdivision for complete information and requirements.  (Ord. 134-B §6.10, 1982)

17.28.090 Violation--Penalty.

A.  Violators of this title will be guilty of a misdemeanor, and each parcel illegally sold or transferred shall constitute a separate offense.

B.  The town may pursue injunctive relief against violations and tax the costs of such action against the violator, together with a fine of not more than three hundred dollars and/or imprisonment of not more than thirty days.  Each day such violation continues shall be considered a separate offense.

C.  The county auditor shall refuse to accept for filing any segregation of land in violation of this title.  (Ord. 134-B §6.5, 1982)
