17.65.010 Objectives.

The objectives of this district are:

A.    Long-Term Value and Quality. By achieving uniformity in design expectations, the value of public and private investment can be sustained through the creation of a built environment that reflects quality within the City’s targeted investment areas.

B.    Design. To achieve a design aesthetic of urban form and character through guiding high-quality architecture and construction with attention to placement, relationship and orientation of structures to provide a greater sense of place with buildings facing streets. While most people will drive their autos to destinations within the district, this urban development pattern will create greater opportunities for pedestrian access to sites.

C.    Compact Mixed Use. Creating a compact concentration of multiple land uses including retail, retail service, entertainment, and office will generate the critical mass necessary to achieve economic stability and vitality of the targeted investment areas. (Ord. 2021-031604 § 6, 2021)

17.65.020 Use regulations.

A.    Permitted Uses.

1.    Any use permitted in the general or regional business districts except: fast food restaurants with drive-thru windows, freestanding taverns or bars, automobile repair shops and storage garages, or automobile service stations, unless the automobile repair shop, storage garage, or service stations are on a parcel greater than one and one-half acres and not adjacent to or across the street from residential districts. Restaurants may be freestanding.

2.    All permitted uses shall be subject to the approvals and conditions required by Chapter 17.100 and the provisions of this district.

B.    General Regulations. All uses shall be conducted wholly inside a building or buildings except outdoor seating at a restaurant or tavern and plants, garden accessories and pre-packaged materials normally sold in a retail garden center. Outdoor seating may not exceed 25% of indoor seating capacity seats, be located between the building and any adjacent residential district, or have any exterior amplified music, television or sound system. Any question about whether items are normally sold at a garden center shall be resolved by the Plan Commission. (Ord. 2021-031604 § 6, 2021)

17.65.030 Building and parking locations.

A.    Setback to Public Street.

1.    Building: 25 feet minimum.

2.    Pavement: 10 feet minimum.

3.    Accessory structures with foundations erected in association with the creation of “third places” may be located within the building setback, but not within a vision setback. Those structures include pergolas, permanent seating, band shells, decks, gazebos, or similar structures as determined by the Plan Commission.

B.    Offset.

1.    Building: five feet except where property is adjacent to a residential district, then the offset shall be 25 feet.

2.    Pavement: minimum 10 feet.

C.    Building Orientation. In order to achieve district objectives, buildings must be oriented toward the street with at least one major pedestrian entrance connected to the street or pedestrian way. A well-defined pedestrian environment must be developed between the edge of the street and the street-side facade of the building. (Ord. 2021-031604 § 6, 2021)

17.65.040 Height restrictions.

Principal building: 35 feet maximum unless the principal building is a hotel, office, or institutional use then 80 feet maximum, when such building or use is located on a major street as that is defined in Title 16. Accessory buildings: 15 feet maximum. (Ord. 2021-031604 § 6, 2021)

17.65.050 Area regulations.

A.    Floor area ratio: maximum 50%.

B.    Lot Size.

1.    Minimum area: one acre.

2.    Minimum average width: 150 feet.

C.    Landscape surface ratio (LSR): minimum 25% or the minimum area required to comply with Title 14, whichever is more restrictive.

D.    Lot coverage: maximum 75% or the minimum open space required to comply with Title 14, whichever is more restrictive. (Ord. 2021-031604 § 6, 2021)
