2.50.010 Administration.

The clerk of the court is hereby appointed and shall serve as the violations clerk who shall administer the bureau. [Ord. 2002-01 § 1]

2.50.020 Procedure.

The violations clerk shall accept written appearances, waivers of trial, admissions of violations, and payment of civil penalties in the amount and for the violation as provided below, receipt for said payment, and account for all payments per the State Board of Accounts guidelines. [Ord. 2002-01 § 2]

2.50.030 Penalty schedule.

The following schedule of ordinances and Whitestown Code provisions shall be subject to the jurisdictions of the ordinances violations bureau. The first and second admission of the same violation within a calendar year of said ordinance and/or code provision shall be subject to the civil penalty set forth herein:

*ARTICLES: piles of lumber, any collection of garbage, any tin cans, rolls of wire fencing, old iron, junk, refuse, tires, leaves or brush.

The second admission of violation of the same ordinance or code provision scheduled above within a calendar year shall be subject to the penalty set forth. Any third allegation of violation of the same ordinance or code provision scheduled above within a calendar year shall be referred to the town court. In no event shall any civil penalty collected for a single ordinance violation by the ordinance violations bureau exceed the $50.00 maximum permitted by statute. [Ord. 2002-01 § 3]

2.50.040 Right to trial.

In the event a person charged with a violation pursuant to this chapter elects to exercise the right to trial, the person shall appear before the violations clerk and deny the violation or enter a written denial with the clerk and the clerk shall schedule said defendant for trial in the normal course. [Ord. 2002-01 § 4]

2.50.050 Failure to satisfy penalty.

All persons denying a violation covered under this provision; failing to satisfy a penalty assessed by the clerk after admitting said violation; or failing to deny or admit said violation, shall be processed through the court. [Ord. 2002-01 § 5]
