2.24.010 Created--Number--Residence qualification.

There is created a board of park commissioners for the city of Colfax, consisting of five members, who shall be appointed by the mayor and approved by the city council, from citizens of recognized fitness for such positions. No person shall be ineligible as a commissioner because of sex. No commissioner shall receive any compensation for his or her services. (Prior code §2.28.010).

2.24.020 Membership--Term--Vacancies--President.

The members of said board of commissioners shall hold office in accordance with the following rules. If the board of park commissioners consists of five members, each member shall hold office for a period of five years, with terms of one of each of said members ending consecutively on the first Tuesday of January of each year for the next five years. The first commissioner shall determine by lot whose term of office shall expire each year, and a new commissioner shall be appointed annually to serve for a term of years corresponding in number to the number of commissioners in order that one term shall expire each year. Thereafter, one commissioner shall be appointed, or reappointed, annually on the first Tuesday of January each year, each appointee to serve for five years. Members of the board may be removed at any time by the mayor, with consent of the city council, and vacancies for the remainder of unexpired terms shall be filled in the same way that original appointments are made. Immediately after their appointment, members of the board shall meet and organize by electing one of their members president and such other officers as may be necessary. (Prior code §2.28.020).

2.24.030 Park defined.

As used in this chapter, "parks" means areas of land, with or without water, developed and used for public recreational purposes, including landscaped tracts, picnic grounds, playgrounds, athletic fields, camps, foot, bicycle and bridle paths, motor vehicle drives, wildlife sanctuaries, museums, zoological and botanical gardens, facilities for bathing, boating, hunting and fishing, as well as other recreational facilities for the use and benefit of the public. 2.24.040 Powers and duties--Reports.

The board of park commissioners thus constituted shall have all the powers and perform all the duties as provided by the laws of the state of Washington relating to boards of park commissioners of cities of the third class. Said board shall have the power to conduct any form of recreation or cultural activity that will employ the leisure time of the people in a constructive and wholesome manner, and may plan, promote, manage and acquire, construct, develop, maintain, and operate, either within or without city limits, parks, squares, parkways and boulevards, play and recreational grounds, and or other municipally owned recreational facilities, including community buildings, and improve and ornament the same; exercise censorship over statuary, monuments or works of art presented to the city, and shall in the name of the city accept all devises and bequests for park purposes; provide for securing, growing and maintaining trees, plants, flowers, zoological collections and other attractions therein including the authority to grant concessions and privileges herein under such restrictions and for such compensation as it shall prescribe, the revenue of which shall go into the park fund, earmarked for park purposes; provided, that no concession or privilege shall ever be granted for the sale of any intoxicating liquors in any public park, square, play or recreation ground or facility, park drive, parkway or boulevard of the city; and that no concession or privilege shall be granted for a period of more than three years unless approved by ordinance. Said board shall further have power to prescribe rules and regulations for the government and management thereof, including the power to fix charges for the use of any municipally owned or controlled park or recreation facility, provided such matters of policy prescribed in this section are presented to the city council for final approval; and it shall further be the duty of the chairman of the park board to make a written or oral report (when there is a report to be made) on the first Monday of each month to the city council, reporting their needs, together with their recommendations. All rules and regulations and use charges adopted by the board of park commissioners and approved by the city council as provided above shall be promulgated by one publication in the official newspaper of the city and shall have full force and effect from and after the date of said publication. Said rules and regulations shall be enforced by the police department of the city. (Prior code §2.28.040).

2.24.050 Superintendent--Duties.

The board of park commissioners shall have the power to appoint or designate someone to act as superintendent who is trained and properly qualified for the work, such appointment to be subject to confirmation by the majority of the membership of the city council, with removal subject also to such confirmation. Said board may delegate to such superintendent the management of the park and playground system and the appointment and supervision of employees thereof, subject to control of the board. Such superintendent may be the executive officer of the board and shall have powers and duties as prescribed by the board, and such other duties and powers as may from time to time be imposed or conferred upon him by law or by ordinance of the city. 2.24.060 Budget--Contributions.

Annually the board of park commissioners shall submit a budget to the governing body of the city for its approval. The board may also solicit or receive any gifts or bequests of money or other. personal property or any donations, acceptable to the board, to be applied, principal or income, for either temporary or permanent use for playgrounds, parks, or other recreational purposes. No moneys exceeding the yearly budget shall be expended by the park board for the city for park purposes for each current year; provided, however, this limitation shall not prohibit the park board from raising money by its own effort outside of said budget and expending the same for any park project or use without the approval of the city, except as required by Section 2.24.040, (Prior code §2.28.060).

2.24.070 Purchases.

All purchases made by the park board for the city shall be itemized and signed on city claims by the party or parties from whom purchased and filed in the office of the city clerk, to be approved by the chairman of the park board and at least one member of the finance committee of the city of Colfax; provided, however, no purchase shall be made exceeding the amount of three hundred dollars without the consent of the city council, but this limitation shall not apply to purchases of chemicals for the municipal swimming pool and for purchases made by contracts previously approved by the city council. 2.24.080 Penalties for violation.

The violation of any rule or regulation of said board made for the government or management of any city park or municipal facility constitutes a misdemeanor and is punishable by a fine not to exceed one hundred dollars, and restitution shall be made to the park fund covering the cost of the damage or loss to park property as result of such violation.  (Prior code §2.28.080).
