2.12.010 Certain appointments to be approved by city council.

A.    Any appointment made by the mayor of individuals to the positions with the city specified in Section 2.12.020 shall be approved by a vote of the majority of the entire council; provided, that a vote upon the question of whether or not an appointment made by the mayor shall be confirmed shall be taken only at a regular meeting of the council.

B.    In the event the mayor determines that it is necessary and appropriate to remove or terminate any officer designated in Section 2.12.020, then the mayor shall give written notice to the individual and to the council of such desire. The removal or termination shall become effective upon the date established by the mayor.

C.    Other than as to the chief of the fire department, the term of a department head or appointee specified in Section 2.12.020 shall be from the date of appointment and confirmation until the date of resignation, retirement, removal by the mayor, or voluntary separation from service, whichever shall first occur. The term of service, appointment, and confirmation process for the chief of the fire department shall be as set forth in Chapter 2.32. 2.12.020 Posts requiring council approval designated.

The posts upon which the votes required by Section 2.12.010 shall be taken are as follows:

A.    City clerk-treasurer;

B.    Director of public works;

C.    Director of community development;

D.    City attorney;

E.    Chief of the Elma police department;

F.    Building official/fire marshall;

G.    Chief of the Elma fire department. (Ord. 1042 §3, 2003: Ord. 1029 §3, 2002: Ord. 595 §1(part), 1976).

2.12.030 Duties and responsibilities unaffected by confirmation process.

The duties and responsibilities of the posts or positions specified in Section 2.12.020 shall remain as previously established pursuant to city ordinance or state law, and shall be unaffected by the confirmation process established by Section 2.12.010. (Ord. 595 §2, 1976).

2.12.040 Bond--Amounts fixed.

The bonds of the officers of the city designated below shall be in such amounts as may be fixed by written resolution of the council:

A.    City clerk-treasurer;

B.    Municipal court clerk;

C.    Chief of police;

D.    Municipal court judge. (Ord. 1029 §4, 2002: Ord. 292 §1, 1935).

2.12.050 Bond--Surety company restriction--Approval by city attorney required.

The surety on all bonds shall be some surety company authorized by law to do business within the state of Washington; and such bonds shall be approved by the city attorney before being accepted by the council. (Ord. 292 §2, 1935).

2.12.060 Legal advice or assistance which may be reasonably required.

In order to facilitate and insure the ability of the mayor, and the departments under his or her direction, and the council to carry forth their respective duties, the city attorney shall provide to the city, its mayor, council, and departments, all legal advice or assistance which may be reasonably required by the elected officials or the departments in carrying forth their official duties and responsibilities and making the decisions in relation to such action.
