18.05.010 Interpretation of land use matrix.

A. The land use matrix in this chapter identifies uses permitted in each individual zoning district. The zoning district is located on the vertical column and the use is located on the horizontal row of this matrix.

B. If the box at the intersection of the column and the row is empty, the use is not permitted in that district unless it is customarily incidental and accessory to a primary permitted or conditional use as determined by the administrator.

C. If the letter “P” appears in the box at the intersection of the column and the row, the use is permitted in that district as a primary use.

D. If the letter “C” appears in the box at the intersection of the column and the row, the use is conditionally permitted subject to the conditional use permit review procedures and criteria set forth in Chapter 18.38 EMC.

E. If a footnote appears in the box at the intersection of the column and the row, the use may be permitted subject to the appropriate review process indicated above and the specific conditions indicated by the corresponding footnote.

F. All applicable requirements shall govern a use whether or not they are cross-referenced in the matrix. To determine whether a particular use is allowed in a particular zoning district and location, all relevant regulations must also be consulted in addition to this matrix.

G. Unlisted uses shall be reviewed and meet the requirements of the listed use which most closely matches their characteristics. In considering whether an unlisted use has similar characteristics to a listed use, the administrator shall consider traffic generation rates, parking needs, dust, noise, smell, hours of operation, and nature of the on-site operations. B. Residential Land Use Footnotes.

1. Upon approval of an innovative cottage demonstration project per Chapter 19.46 EMC.

2. A nightwatchman’s quarters are allowed as an accessory use to a use permitted in the zone.

3. Permitted with a minimum lot size of 12,400 square feet per duplex, otherwise conditional use. Reference EMC 18.06.030.

4. Allowed as part of a live-work project. The work space must clearly constitute an accessory use of the building and property, and the use shall not result in a conversion of the property or building from primarily multifamily to primarily nonresidential use.

5. Dwellings or living quarters must be located above primary use. Parking is provided in private parking areas or garages on the basis of one parking space for each dwelling unit within 400 feet.

6. Multifamily residential and live-work uses shall be permitted only in the mixed use overlay when included within a mixed use development. (Ord. 2533 § 1 (Exh. A), 2013).
