17.36.010 Purpose.

The purpose of this district is to allow for low density residential development on large lots in order to preserve the rural character of Kerman, allow for agricultural uses and serve as a transition area between urbanizing lands and agriculture.

This district provides for three rural residential zones:  RR, RR-43, and RR-100.  The application of each zone will be based on the land use of the property, the Kerman general plan, and the availability of infrastructure.  (Ord. 90-02 §2(part), 1990).

17.36.020 Permitted uses.

Permitted uses in this district are as follows:

A.    One single-family dwelling or one single-family manufactured home consistent with the architectural standards specified in Section 17.40.050;

B.    Agricultural and residential accessory uses consistent with the standards established in Chapter 17.62;

C.    Licensed small family day-care home (six or fewer children);

D.    Home occupations consistent with the requirements of Chapter 17.18;

E.    The growing and harvesting of trees, vines, vegetables, field crops, grains, pasture and other agricultural commodities;

F.    The raising of livestock, including but not limited to sheep, goats, horses, mules, and swine.  The total number of animals shall not exceed two mature animals per acre except in the case of newborns.  Newborns less than four months in age shall not be considered a part of the calculation;

G.    Employee housing;

H.    Farmworker housing.  (Ord. 19-01 §3, 2019:  Ord. 90-02 §2(part), 1990).

17.36.030 Conditional uses.

Conditional uses in this district are as follows:

A.    Licensed large family day-care home (seven to twelve children);

B.    Licensed group care home (six or fewer persons);

C.    Nursery school;

D.    Community care facility (six or fewer persons);

E.    Public uses of an administrative, public service or cultural type including special district, city, county, state or federal facilities;

F.    Utility and communication facilities, electrical distribution substations, and water pump stations;

G.    Educational institutions and schools;

H.    Cemetery;

I.    Church;

J.    Kennel;

K.    Greenhouses, hothouses and similar types of buildings not to exceed a building area of five thousand square feet;

L.    Raising of livestock, poultry and fur-bearing animals which exceed the density requirements of Section 17.36.020;

M.    Veterinary hospital;

N.    Mobile home park consistent with Chapter 17.68;

O.    A second residential unit consistent with the requirements of Chapter 17.66;

P.    Guest house.  (Ord. 90-02 §2(part), 1990).

17.36.040 Development standards.

The following development standards, together with applicable standards specified in Chapter 17.84, shall apply to all land and structures within this district.

A.    Minimum Lot Size.  The minimum lot size shall be one-half acre.  This district may be modified to allow for larger minimum lot sizes as follows:

1.    RR-43:  Forty-three thousand square feet or one acre;

2.    RR-100:  One hundred thousand square feet or two and one-half acres.

B.    Coverage.  The building coverage for each lot shall not exceed forty percent of the total lot area.

C.    Lot Dimensions.  Lots within this district shall not exceed a depth to width ratio of 3:1.  Lot dimensions for this district shall be as follows:

1.    Lot Width.  The minimum lot width shall be one hundred twenty feet for interior and corner lots and sixty feet for cul-de-sac lots;

2.    Lot Depth.  No requirement.

D.    Building Height.  The maximum height of a residential structure shall be thirty-five feet.  Said structure shall not exceed two stories.  The maximum height of an agricultural accessory structure shall be forty-five feet.

E.    Yards.

1.    Front yard:  thirty-five feet;

2.    Rear yard:  twenty-five feet from the lot line;

3.    Side yard:  fifteen feet except on a corner lot where the street side of the lot shall have a setback of thirty-five feet;

4.    Distance Between Structures.  The minimum distance between a residential and nonresidential structure shall be thirty feet;

5.    All required yards shall extend the full width of depth of the lot and shall be open from the ground to the sky, with the following exceptions:

a.    Belt courses, cornices, eaves, sills, fireplace chimneys and other similar architectural features may extend or project into a required side yard not more than seven inches for each one foot of the width of such required side yard, and may extend or project into a front or rear yard not more than thirty-six inches.

b.    Uncovered, unenclosed porches, platforms, or landing places which do not extend above the level of the first floor of the building may extend into any front yard a distance of not more than six feet, and may extend into any side or rear yard not more than three feet.

c.    Open, unenclosed stairways or balconies not covered by a roof or canopy may extend or project into a required front yard not more than thirty-six inches.  (Ord. 90-02 §2(part), 1990).

17.36.050 Signs.

Signs shall be consistent with the requirements of Chapter 17.76.  (Ord. 90-02 §2(part), 1990).

17.36.060 Fences, walls and hedges.

A.    Fences, walls and hedges shall be consistent with the site distance provisions established in Section 17.78.070(B).

B.    Fences, walls, and hedges shall not exceed seven feet in height in any rear or side yard.

C.    Fences, walls and hedges shall not exceed forty-two inches in height in a front yard, in the side yard on the street side of a reverse corner lot, or in the rear yard area of a reverse corner lot defined by the extension of the required street side yard to the rear lot line.

D.    Swimming pools shall be entirely enclosed by a wall or fence at least five feet in height.  The wall or fence shall be equipped with self-latching gates, the latching mechanism being located not less than four feet above the ground.  The fence or wall must be installed and approved by the building inspector prior to the pool being filled with water.

E.    Fences or structures exceeding seven feet in height, to enclose tennis courts or other game areas, located within the rear half of a lot shall be composed of wire mesh capable of admitting at least ninety percent of light as measured on a calibrated light meter.

F.    All fence posts to be placed in the ground shall be treated prior to installation in order to prevent rot or insect damage.  (Ord. 90-02 §2(part), 1990).

17.36.070 Parking.

Off-street parking and loading shall be consistent with the requirements of Chapter 17.74.  (Ord. 90-02 §2(part), 1990).
